RECOMHENDATION
It is recommended that the City Council continue this matter to the June 5, 1989
City Council meeting.

On April 24, 1989, the Planning Commission determined that Use Permit 87-6 had
expired on June 1, 1988. This Use Permit was originally approved for an
off-site beer and wine sales license for an Exxon Mini Market and gasoline'sales
outlet at 14082 Red Hill Avenue (at Nisson Road). On May 1, 1989 the applicant
filed an appeal of the Commission's decision to the City Council. Under City
Code requirements, the hearing for this appeal was duly scheduled for May 15,
1989. However, a request by the applicant to continue the matter to the June 5,
1989 Council agenda was filed with staff on May 5, 1989.
CONCLUSION

Continuance of the hearing is at the request of the applicant and places no
burden on City staff to accommodate their request. To facilitate proper
advertising and notification to the public, staff will at the recommendation of
the Council, readvertise the hearing and re-notice all property owners of the
new hearing date.

Re: Exxon Appeal to City Council
Dear Ms. Wynn:
This law firm represents Exxon Corporation regarding
Conditional Use Permit Number 87'~ concerning the Exxon station at
14082 Red Hill Avenue in Tustin. Exxon's appeal of the Planning
Commission,s action concerning this use permit is scheduled to be
heard by the City Council on May 15.
Pursuant to the instructions I received over the
telephone from the City Administrator,s Office, I am writing to you
to request that Exxon's Appeal to the city council be continued to
the next_~t~ Council meeting, which I am informed is scheduled for
Exxon is requesting this continuance because both
~ the station and Exxon's dealer representative will
be out of the state on May 15.
