HUSTON, CITY MANAGER FROM: SUBJECT: COMMUNITY DEVELOPMENT DEPARTMENT VESTING TENTATIVE TRACT HAP 13701 (AKINS DEVELOPMENT) , ,/ RECOFI, IENDATION It Is recommended that the City Council · 1) Approve the Environmental Determination for the project by adopting Resolution No. 89-61; and 2) Approve Vesting Tentative Tract Map No. 13701 as recommended by the Planning Commission, by adopting Resolution No. 89-62. - BACKGROUND At.their regular meeting on April 24, 1989, the Planning Commission adopted Resolution No. 2.584 (attached), recommending to the City Council approval of Vesting Tentative Tract Map 13701. · Vesting Tentative l~ract Map 13701 proposes to subdivide a 34.5 acre site into 161 numbered and 25 lettered lots for landscape maintenance purposes, permitting the development of 161 single family detached dwelling units a density of 4.7 units per acre. The project is located within the Low Density Residehtial designation of the East Tustin Specific Plan which permits a density of 5 units per acre. The project is bounded by existing residential development (Tracts 3119, 2939, and 2742) and Tustin Memorial School to the west, Irvine Boulevard to the south, Tustin Ranch Road to the east, and La Colina Avenue to the north. Planned and anticipated development in the vicinity include: the lower edge of the Tustin Ranch Golf Course and future condominium projects to east, and a similar single family development to the north. In conjunction with the proposed project at their meeting of May 8th, the Planning Commission adopted Resolution No. 2583 (attached) approving Design Review 88-45, for the specific site plan and architectural design of the project. PROJECT DESCRIPTION/SITE PLAN ii Submitted development plans for the. project propose construction of 161 two-story single family detached dwelling units on lots measuring approximately City Council Report Tentative Tract Map 13701 M.ay 15,. 1989 Page two 5,450- 8,400 square feet i-n size. The project contatns slx unit types ranging tn size from 2543 square feet to 3336 square feet. Floor. plans lnclude a comblnatlon of 3 and '4 bedroom layouts with and without dens. The proposed dwellings' rear setbacks adjacent to the extstlng slngle famtly dwellings to the west meet or exceed the mlnimum requlred rear yard of 25 feet and the average setback of 30 feet, as required by the East Tustin Speciflc Plan. Mlntmum 20 foot front setbacks are proposed throughout the project. In conjunction with the project, the applicant proposes construction of one publlc street and thirteen prtvate streets. The entlre project will take Its primary access from Tustin Ranch Road at "A" Street, a public street wtth a 40 foot curb-to-curb width on a 60 foot right-of-way, located mid-block between Tustin Ranch Road and La Colina. "A" Street will terminate at a cul-de-sac provldlng access to Lot "K", whlch is reserved for use by the adjolnlng Tustin Memorlal School. Residential access will occur from "B" Street, a prtvate street whlch Intersects at "^" Street. Security gates at both the north and south entrances .to the project are proposed. The two gated entry areas will be treated as focal points with decorattve' landscaping-and enhanced street paving. The lnterior prlvate streets are typically 36' feet wlde curb-to-curb (allowing parking on both sides of the Street) with 5 foot wide sidewalks adjacent to curbs. Other features, of the project can be summarized as follows' A concrete block wall consistent with the theme wall approved for Tract 12870 is proposed to be constructed around the project and along the "A" Street entry. Masonry walls shall also be constructed to divide common property 1. ines within the tract with a stucco finish matching the architecture of the buildings. A street tree program is proposed that would result in the planting of larger, more mature trees than typically found in new projects, these trees would be planted in the front yard areas of the lots. The paseo entrances will provide secondary emergency access to the project in addition to providing pedestrian access. ARCHITECTURAL DESIGN ii The proposed architectural design for the project is a modern interpretation of Early California/Spanish Colonial style. The two-story buildings are proposed with sloped spanish tile roof treatments at the first as well as the second stories and six primary stucco siding colors transcending from white to beige. building mass is broken up with the use of staggered, walls and projections in Corn rnunity Development DeparT,~ent City Counct 1 Report Tentative Tract Map 13701 May 15, 1989 Page th tee the fronts and rears of the buildings. Stained ~ood, balconies, trellises, arches, decorative lighting, multi-parted and rounded windows characterize the detall of the architecture. The proposed architecture is consistent with the desired Tusttn Ranch style. A particular effort has also been made to break up the linear pattern of d~ellings as visible from Tusttn Ranch Road· ! SSUE S 1. _Tustln Memorlal School Access (Lot K) - The [rvlne Company is negotiating the Sch~l Financtn~ Agreeme~-'with (he Tustin Unified School District and have agreed to provide access from East Tustln to Tustin Memorial School. While it is anticipated that Lot K will be developed as a parking lot serving Tustin Memortal School, no specific development plans have been prepared at this time. A number of City Departments, including Public Works and Community Services, are concerned about the design of any such Improvements to ensure that no negative Impacts on "A" Street occur, and would like to retatn Design Review authority over any future improvements. The school dlstrJct has transmitted a letter to the City confirming its agreement to the proposed site and the access provided. At their meeting on April 10, ~989, tile Planning Commission approved an amendment to the Land Use Concept/Development Plan for Sector 9 to recognize the need for this access· · Interface With Existing Residential Properties to West - The westerly boundary ~°ns~st'~" of silngle' family properties"i'n unincorporated County territory. The finished grade of the subject project has been lowered in some areas to match grade levels at this boundary in order to reduce the perceived height of the proposed homes from the existing residences. Special consideration has been taken in buffering these homes from the proposed development~ with large setbacks, landscaping and a uniform wall progra, m. The applicant has proposed to construct a decorative block wall consistent with the Tustin Ranch theme wall as a single barrier between the properties. In doing so,' existing homeowner's agreements have been obtained for permission to complete the construction procedures as needed on the individual properties. Homeowners that do not agree to the construction of the common wall will have their properties avoided by Wall constructi on entt re ly. ENVIROI~ENTAL ANALYSIS Based upon review of the subject map as well as Final Environmental Impact Report 85-2 (as supplemented) it has been determined that' environmental issues relating to this project have previously been addressed. With this Information In mjnd, it Is recommended that the City CouncJ1 make the finding that requirements of the CallfornJa £nvtronmental Ouallty Act have been met and that no further environmental revlew Is required by adoption of Resolution No. 89-61. CONCLUSTON Given the analysis conducted by staff and consideration of comments from other agencies, it is concluded that the proposed project meets the requirements of the East Tustin Specific Plan, the Subdivision Map Act as adopted, and the California Environmental Quality Act. It is therefore recommended that the City Council approve Vesting Tentative Tract Map 13701. That a proper application, Design Review No. 88-45, was filed by Akins Development Company, requesting approval of a 161 detached, sing.le family dwelling unit project· B. That a public hearing was duly called, noticed and held on said application on April 24 and May 8, 1989. C. Pursuant to Section 9272 of the Tustin Municipal Code, the Commission finds that the location, size, architectural features and general appearance of the proposed development will not impair the orderly and harmonious development of the area, the present or future development therein, or the occupancy as a whole. In making such findings, the Commission has considered at least the following items: 1. Height, bulk and area of buildings. 2. Setbacks and site planning.. 3. Exterior material s and colors. 4. The Director of Community Development may also approve subsequent minor modifications to plans during plan check if such modifications are found consistent with provisions of the East Tustin Specific Plan. (1) 1.2 Unless otherwise specified, the conditions contained in this Exhibit shall be complied with prior to the issuance of any. building permits for the project, subject to review and approval by the Community Development Department. (1) 1.3 Design review approval shall become null and void unless building permits are issued within eighteen (18) months of the date on this Exhibit. (1) 1.4 The applicant shall sign and return an Agreement to Conditions Imposed form prior to issuance of building permits. PLAN SUBN I'll'AL 2.! At building plan check submittal: (3) A. SITE AND BUILDING CONDITIONS 3.1 The site plansI shall be modified as follows' A. Dri veway widths shal 1 be designed as follows' 1) Lots 1-91 shall have maximum driveway widths of 25 feet. 2) Lots 94, 95, 112 and 142 shall have maximum driveway widths of 20 feet. Be 3) Lot 141 shall have a maximum driveway width of 23 feet at its front property line. · 4) Lots to be improved with floor plan 6 other than those specified in items 2 and 3, shall have maximum driveway widths of 24 feet. 5) Lots to be improved with floor plans 4 and 5 shall have maximum driveway widths of 30 feet at front property lines. Driveways shall be of decorative paving and design. Driveways for floor plans 4 and 5 small contain landscaped dividers between the separate garage entrances, extending toward the front of each lot and shall not incorporate appearance of a circular driveway. The project entrles on "B" Street shall be modified as follows: 1) Enhanced paving and landscape medians shall not encroach into the public right-of-way of "A" Street. 2) The project entry medians shall be revised to reflect driveway egress of 24 foot minimum width. 3) The final design of the project entries shall meet the City's private street standards, as well as the applicable emergency services requirements. 4) The tree planters proposed within the intersections of "B", "I" and "K" Streets shall be relocated outside of the 36 foot minimum street widths and shall be adjacent to the respective sidewalks. Decorative paving material shall be used throughout these intersections, consisten~c with the surrounding paving material. (4) 3.2 Modi'fy building elevations and proposed exterior materials as follows- A. Provide exact 'details and exterior door and window types and treatments (i.e., framing color glass tint). B. Indicate color and type of metal railings. C. Show all downspouts and gutters. *** 3.2a Pedestrian paseos and emergency access lots shall be provided along Tustin (2) Ranch Road on Lot C and La Colina Drive on Lot F. A protective rail or guard shall be installed on top of retaining walls where there is more than a thirty (30) inch drop. Check the buildlng code and provide details for such treatment. LANDSCAp,,ING, GROUND~I AND HARDS~APE ELENENTS (7) 4.1 Submit at plan check complete detailed landscaping and irrigation plans for landscaping areas to be improved by the developer (i.e., landscaping lots, paseo lots) consistent with adopted City of Tustin Landscaping and Irrigation Submittal Requirements. Provide summary table applying indexing identification to plant materials in their actual location. The plan and table must list botantical and common names, sizes, spacing, actual location and quantity of the plant materials proposed. Show planting and bermlng details, soil preparation, staking, etc. The irrigation plan shall show locat.ion and control of backflow prevention devices, pipe size, sprinkler type, spacing and coverage. Details for all equipment shall be provided. Show all property lines on the landscaping and irrigation plan, public right-of-way areas, sidewalk wi'dths, parkway areas, and wall locations. The Department of Community Development may request minor substitutions of plant materials or request additional sizing or quantity materials during plan check. Note on landscaping plan that adequacy of coverage of landscaping and irrigation materials is subject to field inspection at project completion by the Department of Community Development. 4.2 The submitted landscaping plans at plan check shall reflect the following requirements: A. Earth mounding should be particularly provide along entrance streets. I. Landscaping adjacent to the right-of-way shall be coordinated wi th parkway landscaping. Perimeter wall(s) should be treated with vines in order to break up large expanses of wall(s) by adding greenery and color. Vines should be informally grouped with training devices installed. ' *** 4.4 All walls, fences, signs or landscaping adjacent to lots along "B" Street shall be designed to provide adequate sight distance for vehicles exiting the tract via the private driveway. In addition to larger tree treatments these areas should be provided with a variety of color and treatment of landscaping as well as a incorporation of special decorative signage or pavement treatment (i.e., walls, gates, lighting, etc.). That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement-and Subdivision Map Act as it pertains to the development of single family dwellings. E. The 1.64 acre parkland dedication required of this project was previously dedicated with rec'ordation of Tract 12870. F. That the City has reviewed the status of the School Facilities Agreement between The Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2 ~.with subsequently adopted supplements and addenda, the impacts of Tentative Tract Map 13701 on School District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities by approval of this map are adequately addressed through the reservation of a high school site and elementary site in conjunction with Tentative- Tract Map 12870, and imposition of school facilities fees as a condition of approval of Tentative Tract Map 13701. G. That the site is physically suitable for the type of development proposed. H.
