HUSTON, CITY MANAGER COMMUNITY SERVICES DEPARTMENT CONSENT CALENDAR NO. 5 1/2/90 v Inter - Com SUBJECT: ENGINEERING SERVICES TO EVALUATE EXISTING LIGHTING AT MAGNOLIA TREE PARK RECOMMENDATIONS 1. Approve agreement with RWR Pasco Electrical Engineering for engineering services to evaluate existing security lighting at Magnolia Tree Park. 2. Appropriate $3500 to complete the study. Staff will request additional funds if deemed necessary for the installation of lights upon completion of study. BACKGROUND A status report was given to the Council in November regarding the shooting incident at Magnolia Tree Park. At the Peppertree Homeowners Association meeting there were two issues of concern in regards to the park. One was that the 10 P.M. curfew be enforced and the second was that the security lighting be improved for the area. Staff has met with Todd Ferguson, President of the Peppertree Homeowners Association regarding the concerns. The Police Department has been contacted and with assistance from the Homeowners Association have been enforcing the 10 P.M. curfew. A proposal from RWR Pascoe Lighting will address the second concern for the adequate security lighting. The scope of services includes meeting with the Homeowners Association, necessary site visits to Magnolia Tree Park, and preparation of a report to analyze existing security lighting and to provide recommendations to bring the existing security lighting up to current standards. This agreement has been reviewed and approved by the City Attorney's Office. Upon completion of the report, staff will report the findings to Council and request additional funding to authorize working Engineering Services drawings and installation of the additional lighting if necessary. l Susan M. M. curfew at the Park be rigidly enforced (we recognize our responsibility to observe and report violations of the curfew). 2) that the after -curfew lighting around the tennis courts/ park perimeter be increased (see the enclosed map). Tustin is blessed to have professionals such as yourself, who help us present solutions to community problems for City Council consideration, rather than asking them to consider our problems. Between the Client: and the Consultant: CITY OF TUSTIN RWR PASCOE ENGINEERING, INC. 300 CENTENNIAL WAY 151 KALMUS DRIVE, STE K-1 TUSTIN, CA 92680 COSTA MESA, CA 92626 for work on the PROJECT: Evaluation of Existing Security Lighting at Magnolia Tree Park The Client and the Consultant agree as set forth below: TERMS & CONDITIONS OF AGREEMENT Between Client and Consultant Article 1 BASIC SERVICES 1.1 The Consultant shall coordinate with the Client with respect to the Consultant's services in such a way that the Consultant's duties and responsibilities shall be co -extensive with those of the Design Team. The Consultant shall perform his services in character, sequence, and timing so that they will be coordinated with services of the Client and other Consultants for the project. The Consultant's services shall conform to the original or revised schedule and budget for the project as provided by the Client. The relationship of the Consultant to the Client shall be that of an independent contractor performing professional duties of the Client in accordance with this Agreement. 1.2 The Consultant shall attend all coordination meetings that require his input. 1.3 Refer to Exhibit "At' for specific project services and/or conditions. Article 2 WORK NOT INCLUDED/EXTRA SERVICES 2.1 The Consultant shall furnish at his expense to the Client or other consultant's all copies of information required for the Consultant's services. The Client shall furnish at his expense information and existing prints of required for the Consultant's services. Copies required by reviewing agencies shall be paid for by the Client. CITY OF TUSTIN AGREEMENT December 12, 1989 Page Two of Four L I G H T I N G C O N S U L T A N T S 2.2 The Consultant shall be reimbursed for work resulting from changes or revisions made by the Client and/or Project Owner and also for any additional items not mentioned in Articles 1 and 2 above. Article 3 COMPENSATION 3.1 Compensation for Article 1 "Basic Services" shall be based upon a time and material basis at our current hourly rates as outline in Paragraph 3.3 below, not to exceed Three Thousand Two Hundred Dollars ($3,200.00). 3.2 Compensation for Article 2 "Construction Support" shall be based upon our hourly rates plus expenses. 3.3 For the purposes of hourly extra services and/or revisions for the basic services, the Consultant shall invoice the Client at the following rates: Principal $90.00 Associate/Project Manager $75.00 Designer $60.00 Drafting $40.00 Clerical $30.00 3.4 The above proposed fee is valid six months from date hereof. Article 4 INVOICE AND PAYMENTS 4.1 At the end of each calendar month during which the Consultant performs work in connection with work described, the Consultant shall tender an invoice to Client setting forth the amount due. 4.2 The Client shall pay the total amount due under invoice within thirty (30) days after receipt of invoice. Accounts over thirty (30) days are subject to a service charge of 1.5% per month on unpaid balances. In the event the Consultant is required to employ the assistance of an attorney to secure payment the Client will be liable for all court and attorney costs. I- RWRNzZ099F� E L E C T R I C A L E N G I N E E R S • CITY OF TUSTIN AGREEMENT December 12, 1989 Page Three of Four Article 5 ABANDONMENT L I G H T I N G C O N S U L T A N T S In the event the entire or part of the project is abandoned, the Client shall by written notice advise the Consultant to stop work in those areas being abandoned. At such time, the compensation will be the last progress billing plus a mutually agreed upon amount of work executed since that billing. All work shall terminate until such time the Client by written notice advises the Consultant to continue such work. Article 6 ELECTRICAL DOCUMENTS All reports and documentation prepared by the Consultant are and shall remain the property of the Consultant until such time that all Consultant's compensation has been paid. They are not to be used on other projects or extensions to this project without prior written approval from Consultant and with appropriate compensation to the Consultant. Article 7 ARBITRATION All questions in dispute under this Agreement may be submitted to arbitration when practical and in accordance with the provision of the American Arbitration Association. The prevailing party shall be entitled to reasonable attorney's fees to be fixed by the Arbitrator; or in the event there are judicial proceedings instead of arbitration, reasonable attorney's fees shall be fixed by the court. Article 8 INSURANCE Each party to this Agreement shall carry and maintain public liability, property damage and workmen's compensation insurance, and in addition, insurance to protect him from claims arising out of the performance of his professional services caused by the acts, errors or omissions of each party of his employees or others for whom he is legally responsible. Article 9 SCOPE OF AGREEMENT This is the entire Agreement between the parties and there are no conditions, agreements or representations between the parties except as expressed herein.
