BACKGROUND Recognizing the danger posed by the great number of potentially hazardous buildings in California, the State legislature in 1986, enacted the unreinforced masonry building law (Chapter 250, Statutes of 1986; SB 547 [Alquist); Government Code Section 8875 et. seq.). The law calls for identifying and mitigating hazards in unreinforced masonry (URM) buildings only by January 1, 1990. Unreinforced masonry buildings have performed, particularly poor in every damaging California earthquake and have been considered a major threat to life. Although not every URM building will collapse in a significant earthquake, a large number of them will have some degree of life threatening failure. Under the law, all local jurisdictions in California's Seismic Zone 4 were required to submit the following by January 1, 1990 to the State Seismic Safety Commission. 1. Identification of all URM buildings that are potentially hazardous. 2. Proposed mitigation program to reduce the hazard. Background Recognizing the danger posed by the great number of potentially hazardous buildings in California, the State legislature in 1986, enacted the Unreinforced Masonry Building Law (Chapter 250, Statutes of 1986, SB 547 [Alquist]; Government Code Section 8875 et. seq.). The law requires every local jurisdiction in Seismic Zone 4 to create a list of "potentially hazardous buildings" that identifies buildings which contain walls constructed of brick or other masonry materials, built before earthquake resistant codes were enforced and which do not have steel bars embedded in the walls. Such buildings, commonly called unreinforced masonry (URM) buildings, may not withstand earthquakes well, and they have caused many injuries and deaths in large earthquakes such as the Loma Prieta Earthquake of October 17, 1989. The law requires notifying owners of these potentially hazardous buildings and suggests development of hazard mitigation programs. Under the law, jurisdictions must comply with the following by January 1, 1990. 1. Survey and identify all URM buildings that are potentially hazardous. 2. Develop a program to mitigate the hazard. 3. Submit information on potentially hazardous buildings and the proposed hazard mitigation program to the Seismic Safety Commission. II. Purpose and Scope of Work The purpose of this report is to respond to the minimum legal requirements of SB 547. In so doing, the report is divided into the following additional sections: Identification of URM hazardous buildings, and; the proposed hazard mitigation program. The report is meant to constitute the first step in implementing a comprehensive earthquake risk reduction and hazard mitigation program for unreinforced masonry buildings in the City of Tustin. III. Identification of unreinforced Masonry Hazardous Buildings A. Definition of Potentially Hazardous Buildings Under the law, a "potentially hazardous building is defined as "any building constructed prior to the adoption of local building codes requiring earthquake resistant design of buildings and constructed of unreinforced masonry wall construction. Potentially hazardous buildings include all buildings of this type, Community Development Department including, but not limited to, public and private schools, theatres, places of public assembly, apartment buildings, hotels, motels, fire stations, police stations, and buildings housing emergency services, equipment, or supplies, 'such as government buildings, disaster relief centers, communication facilities, blood banks pharmaceutical supply warehouses, plants and retail outlets." The following buildings are exempt from the legal requirements of the SB 547: 1. Warehouses and similar buildings with few occupants, unless used for emergency services or supplies (Warehouses that have been converted to retail, office or residential occupancies are not exempt). 2. Residential buildings with five or fewer dwelling units. 3. Buildings owned by the federal or state government (buildings owned by local jurisdictions are not exempt) . State law encourages protection of structures that are historically or architecturally significant; historic buildings are, as a result, treated a bit differently under the URM law. URM buildings designated as "historic" if already on lists or registers are exempt from inclusion on the list of potentially hazardous buildings. However, if these buildings are found to be hazardous, they should be included in any mitigation program developed by a City. Historic building hazard mitigation is required to follow the State Historical Building Code (Section 18950 through 18961 of the Health and Safety Code and Part 8 of Title 24 of the California Administrative Code). B. Survey Methodology The identification of URM buildings in the City of Tustin included. determining which buildings in the City were potentially hazardous and their current uses, daily occupant loads, and other information. In surveying buildings to identify those that were potentially hazardous, the following six steps were taken. 1. Building Division office records were reviewed including information collected in the City's recently completed Cultural Resources Survey. Community Development Department C. 2. Field inspection was made of the City and potentially hazardous buildings were identified based on collected field information and a review and verification of office records. The survey team included qualified inspectors experience in structural engineering with a thorough knowledge of seismic requirements as related to the types of building conditions to be covered in the survey. 3. A preliminary list of potentially hazardous buildings was compiled based on items 1 and 2 above. Property owners of each identified building were then contacted and asked to identify whether they had information that would indicate their building was not unreinforced masonry and did not need strengthening or had already been strengthened against earthquake hazards during past renovation work. 4. Upon receipt of information contained in item no. 3 above, a revised preliminary list of potentially hazardous buildings was prepared. 5. Each structure on the revised list was field checked one additional time and all survey results were analyzed including review and discussion with the City's outside building plan check consultants. Minimum information collected on all structures on the list also included but was not limited to the following: a. Street address and assessor's parcel number. b. Date of construction, type of construction. C. Property owner information. d. Current use of each building and maximum potential occupancy and square footage. e. Black and white and color photographs. f. A description of each building and possible hazards. 6. Final list and survey completed. Survey Results It is estimated that the City of Tustin has eight unreinforced. masonry buildings subject to the provisions of SB 547 all located within the "Old Town" area of Tustin and within the City's Cultural Resources Overlay District. Figure 1 identifies the general vicinity and specific location of unreinforced masonry buildings in Tustin. Table 1 provides background on each identified "Potentially Hazardous Building". Information on Table 1 is also supplemented by survey form information on each building contained in Appendix A. While the majority of the buildings are primarily in retail commercial uses there is also a restaurant, bar and social lodge which can create a larger number of potential occupants in these buildings. All identified buildings are privately owned. While each building does not currently qualify as a historical property as determined under Section 37602 of the Health and Safety Code, all buildings identified in the URM survey have also been recently identified in a preliminary Cultural Resources Historical Survey conducted by the City of Tustin with the very likely possibility that they will be locales designated as having historical significance in the future. Proposed Hazard Mitigation Program After identifying potentially hazardous buildings, the URM Law also requires the City to develop a mitigation program for reducing hazards to the community. The following is an outline of the proposed program. A. Immediate Program Elements to be Implemented Notification of owners of buildings identified as potentially hazardous by February 1, 1989. The owner of each building identified as potentially hazardous must be notified by law. Until actual development of a mandatory program for retrofit of existing buildings in the City, owners will be informed of the status of their buildings as "potentially hazardous and encouraged to begin reducing potential dangers. They will be provided with information on acceptable earthquake standards such as utilization of the strengthening standards contained in the Uniform Code for Building Conservation and/or the Seismic Safety Commission Model Code (a copy of the letter to be sent is attached as appendix B). B. Program Elements to be Implemented by July 1, 1990 1. Financial incentives for Seismic Retrofittincq In an effort to provide incentives to encourage owners to begin a schedule for retrofitting potentially hazardous buildings, the City will make available Community Development Block Grant (CDBG) funds for engineering and design, planning and construction costs for any seismic reinforcements up to a maximum of $2,000,. the program should be available and fully operational by March 1, 1990. 2. Preparation of an ordinance to effect the seismic safety provisions of SB 547 indicating requirements Community Dove lopment Department for Hazard Building mitigation. Said ordinance will be: a. A result of careful consideration of the City's objective to achieve seismic safety coupled with the conservation and preservation of its historical resources. b. Result of a review of existing model ordinances including the Seismic Safety Commission Model ordinance and the Uniform Code for Building Conservation. C. Enforceable in a timely and reasonable manner. d. Result of community participation. 3. Monitoring Records on the status of compliance for each potentially hazardous building will be maintained to verify any mitigation program schedule and compliance with deadlines contained in anticipated ordinances are met. This law requires every local jurisdiction in Seismic Zone 4 to identify all "potentially hazardous buildings", which are defined as buildings that contain walls constructed of brick or other masonry materials, and that are not reinforced. Such buildings, commonly called "unreinforced masonry buildings", do not withstand earthquakes well, and they have caused many injuries and deaths in large earthquakes. The City of Tustin has completed and compiled a list of "potentially hazardous buildings" consisting of approximately eight unreinforced masonry buildings within the City of Tustin. As we mentioned in our previous letter to you and as determined from your response to us and verification of technical data, the building referenced above is considered an unreinforced masonry building and has been included on a list of "potentially hazardous buildings" until additional verification is provided that indicates the building meets minimum earthquake standards or the building is structurally altered to conform to such standards. The State requires jurisdictions to enact local ordinances or other mitigation programs to reduce the hazard posed by these buildings. The City of Tustin is currently developing an ordinance that will require structural repairs to your building. It is expected that an ordinance will be in effect by July 1, 1990. Public hearings to discuss the ordinance will be held in the near future. Should you wish to be notified of said hearing dates, please contact the City of Tustin Community Development Department. In the meantime, you should be aware that unreinforced buildings can collapse and endanger lives during earthquakes, even moderate earthquakes. The City would, therefore, strongly encourage you to begin planning seismic strengthening of your building even before adoption of an ordinance by the City. A model ordinance which contains acceptable standards for strengthening buildings prepared by the State Seismic Commission is attached as well as provisions contained in the Uniform Code for Building Conservation. In an effort to provide incentives to encourage owners to begin a schedule for retrofitting potentially hazardous buildings, the City anticipates making available, by application to eligible property owners, grant funds for engineering, design, planning and/or construction of seismic reinforcements up to a maximum of $2,000.
