ZONE CHANGE 68-166 OF CAROLINE BORCHARD HEARINGS TO CONSIDER REZONING FROM U (UNCLASSIFIED) DISTRICT TO R-3 (MULTIPLE RESIDENTIAL) DISTRICT PROPERTY FRONTING 470' ON THE WEST SIDE OF WILLIAMS STREET, APPROXIMATELY 1000' SOUTH OF MAIN STREET. Hearing opened at 7:37 PoM. Location Of the subject property was pointed out by Mr. Supinger. There being no protests or comments, the hearing was declared closed at 7:39 P.M. Mr~ Supinger presented Planning Commission recommendations for approval. Moved by Kllngelhofer, seconded by Miller that Zone Change 68-166 of Caroline Borchard be approved and the-City Attorney directed to draft the necessary ordinance for the next regular meeting. Carried unanimously. VII. 1. ORDINANCE NO. 385 OLD BUSINESS AN ORDINANCE PROVIDING FOR THE ABATEMENT AND REMOVAL AS PUBLIC NUISANCES OF ABANDONED, WRECKED, DISMANTLED OR INOPERATIVE VEHICLES OR PARTS THEREOF FROM PRIVATE PROPERTY OR PUBLIC PROPERTY NOT INCLUDING HIGHWAYS AND RECOVERY OF COSTS OF ADMINISTRATION THEREOF AS AUTHORIZED BY SECTION 22660 OF THE VEHICLE CODE. ORDINANCE NO. 388 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE TUSTIN CITY CODE RELATIVE TO FINANCE. Moved by Coco, seconded by Miller that Ordinance ~o.. 388 have second reading by title on~. C"~ied unanimously. Moved by Klingelhofer, seconded by Coco that Ordinance NO. 388, amending the Tustin City Code relative to finance, be passed and adopted. ZC-68-164 OF GARDEN LAND COMPANY LTD. Moved by Miller, seconded byRing that Ordinance No. 389 have second reading by title only. Carried unanimously. Noes: None. Absent: None. 4. ORDINANCE NO. 390 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, REZONING PROPERTY ON APPLICATION NO. ZC 68-165 OF HESPERIAN FOUNDATION LTD. Moved by Miller, seconded by Klingelhofer that ~rdinance No. 390 have second reading.by title only. Carried unanimously. Moved by Klingelhofer, seconded by Coco that Ordinance No. 390, rezoning property on application ZC 68-165 of Hesperian Foundation Ltd., be passed and adopted. Carried by roll call. RESOLUTION NO.930 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, STATING OPPOSITION TO THE CONTINUANCE OF THE ORANGE COUNTY HARBOR DISTRICT AS A SEPARATE TAXING AUTHORITY. Council Minutes 3/4/68 Pg. 3 Councilman Miller. stated that this matter had. been discussed by the Council at several previous meetings, and he felt that this Resolution exactly expresses the feeling of the Council. Moved by Miller, seconded by Coco that Resolution No. 930 be read by title only. Carried unanimously. MOved by Coco, seconded by Ring that ResolUtion No. 930, stating opposition to the continuance of ~'Ke Orange County Harbor District as a separate taxing authority, be passed and ad0ptqd. Carried by roll call. Ayes: Mack, Klingelhofer, Coco, Miller, Ring. Noes: None. Absent: None. Mayor Mack directed that members of the legislature be notified of this action. VIII', NEW 1. RESOLUTION NO. 929 BUSINESS A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, RELATIVE TO HOSTING THE 1976 SUMMER OLYMPICS. Moved by Coco, seconded by Klingelhofer that Resolution No. 929 be read by title only. Carried unanimously. Moved by Klingelhofer, seconded by Ring that Resolution No. 929, relative to hosting the 1976 Summer Olympics, be passed and adopted. Carried by roll call. Ayes: Mack, Klingelhofer, Coco, Miller, Ring. Noes: None. Absent: None. 2. RESOLUTION NO. 931 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE IMPROVEMENT OF "D" STREET BETWEEN FIRST STREET AND LAGUNA ROAD, AND AUTHORIZING AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS. Moved by Coco, seconded by Ring that Resolution No. 931 be read by title only. Carried unanimously. Moved by Ring, seconded by Klingelhofer that Resolution No. 931, approving plans and specifi- cations for improving "D" Street between First Street and Laguna Road and authorizing and directing the City Clerk to advertise for bids, be passed and adopted. COMMUNICATION FROM TUSTIN CHAMBER OF COMMERCE RELATIVE TO SIGN ORDINANCE. ~ayor Mack explained previous workshops held with representatives of the City Council, Chamber of Commerce, Planning Commission, and members of the City staff. Council Minutes 3/4/68 Pg. 4 A discussion .foliowed relative to referring this matter to the Planning Commission for public hearingr or the holding of further workshops. It was stressed that time was an important factor and some action should be taken in the immediate future. Mr. Gill explained that ~opies of the correspon- dence and recommended revisions could be sent to the Planning Commission and this matter referred to the Commission for their next meeting for decision as to whether to hold further workshops or to immediately set a date for a public hearing. ~ayor Mack directed that copies of the recommended revisions be given to the Planning CommisSion immediately and this matter be placed on the next Commission agenda for decision and action. 4. TRAVEL REQUEST - 1968 CITY CLERKS' INSTITUTE APRIL 24, 25, and 26, 1968. Moved by Coco, seconded by Ring that the City Clerk be authorized to attend the annual ~ C'~s' Institute to be held in Palo Alto April 23-26, 1968 and to incur all necessary costs at City expense° Carried. 5. TRAVEL REQUEST - MIDWINTER CONFERENCE OF THE UNITED STATES CIVIL DEFENSE COUNCIL - WASHINGTON, D.C. It was the opinion of the Council that more information as to the contents of the report to be made by the Civil Defense Director in Washington should be available, and asked if this report could not be presented in paper form. If requested to attend this United States Civil Defense Council conference, costs should be paid by the requesting party. ~oved by Klingelhofer, seconded by Ring that the Civil Defense Director be permitted time off to attend the United States Civil Defense Council conference, but the City to incur no expense° Councilman coco felt that he could not vote on this without further information and felt the Council could request some form of summary of the Civil Defense Director's r~port. Above'motion carried. 6. AWARD OF CONTRACT FOR IMPROVING TRACT NO. 5726 TO R. J. NOBLE COMPANY IN THE AMOUNT OF $21,118.20, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE TtIE NECESSARY DOCUMENTS. (Marshall Lane, Carroll Way, and Santa Clara Avenue - southerly of Santa Clara Avenue and westerly of Yorba) Council Minutes 3/4/68 Pg. 5 Moved by Ring, seconded by Coco that the contract for improving TractNo~ 5726 be awarded to R. Jo- Noble Company in the amount of $21,118.20, and the Mayor and City Clerk be authorized to execute the necessary documents~ Carried. 7. APPROVAL OF DEMANDS Moved by Ring, seconded by Klingelhofer that demands be approVed in the amount of $96,116.01. Carried° IX. OTHER CITY ADMINISTRATOR BUSINESS 1. Legislative Bulletin Mr. Gill requested that the Council submit any comments regarding legislative bills, as submitted, by the next regular meeting. 2. Orange County Division, League of Cities Mr. Gill stated that the Orange County Division of the League of California Cities would have their hearing on the Harbor District at their Executive Meeting on March 14th. CITY ATTORNEY 1. Costa Mesa - request for consideration of a resolution to the State Legislature urging the passage of certain state legislation providing for the right of cities to regulate topless waitresses. Mr. Rourke stated that the bill as introduced is not a help to Tustin or other cities as to topless and that it is felt by several City Attorneys that this bill should be opposed as it is not helpful. Some City Attorneys feel that it could Go some good in some other matters covered and is better than nothing. Mr. Rourke said he saw no point in taking a position one way or the other. X. Orange County Division, League of California Cities - February 8th minutes of Executive Board meeting. 3 .F. L. Wakefield, Assemblyman - distribution of students by race 4. Saddleback junior College District - request for support in April bond election Mayor Mack noted that Tustin's Congressman is supporting this issue. Council Minutes 3/4/68 Pg. 6 Councilm'an Rinq state~ that he felt that it was allright for Councilmen to supp6rt this as individuals, but not as a City Council. 5. Costa Mesa Sanitary District - Resolution 68-191 regarding hours of operation for County Disposal facilities. XI. OTHER CITY COUNCIL BUSINESS 1.Mayor Mack presented a Proclamation declaring March 24th through March 30th as "Chamber of Commerce Week" to Mr. Barletta, Tustin Chamber President° 2. Mr. Gill was requested to contact Council candidates and set a date for an orientation meeting to furnish candidates with information, previous and present Council policies, and to make all facts available to all candidates.
