This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk's office for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the books located at the Police Department, Tustin Library and, on the evening of the meeting, at the rear of the Council Chambers. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited in the Council Chambers; however, if you desire .to smoke, an outside speaker has been provided. I. CALL TO ORDER/PLEDGE OF ALLEGIANCE II. GIFT TO THE TUSTIN AREA SENIOR CENTER FUND FROM THE CHURCH OF JESUS CHRIST OF LATTER DAY SAINTS, IRVINE STAKE, YOUTH GROUP V. PUBLIC HEARINGS 1. PROPOSED ADOPTION OF UPDATED EDITIONS OF MODEL CONSTRUCTION CODES WITH LOCAL MODIFICATIONS Codes are rewritten on a three-year interval with all changes and updates as voted on and adopted at the International Conference of Building Official's Annual Code Change Conference. Recommendation by the Community Development Department: 1. Adopt the following Resolution No. 90-1 setting forth findings in conformance with State law for certain local modifications and changes to the Uniform Codes: RESOLUTION NO. 90-1 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, SETTING FORTH FINDINGS WITH RESPECT TO LOCAL CONDITIONS WITHIN THE CITY OF TUSTIN WHICH MAKE CERTAIN MODIFICATIONS AND CHANGES TO THE UNIFORM BUILDING CODE, THE UNIFORM PLUMBING CODE, AND THE NATIONAL ELECTRICAL CODE REASONABLY NECESSARY FOR HOUSING OCCUPANCIES 2. Hold first reading by title only and introduction of the following Ordinance No. 1043: ORDINANCE NO. 1043 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SPECIFIED SECTIONS OF ARTICLE 8 OF THE TUSTIN CITY CODE ADOPTING 1988 CODES AS THE BUILDING REGULATIONS OF THE CITY OF TUSTIN CITY COUNCIL AGENDA PAGE 1 JANUARY 15, 1990 2. PROPOSED ADOPTION OF UPDATED EDITION OF UNIFORM FIRE CODE WITH LOCAL MODIF 'CATIONS The Uniform Fire Code promulgated by the International Conference of Building Officials and Western Fire Chiefs Association is revised every three years. Recommendation by the Community Development Department: 1. Adopt the following Resolution No. 90-5 setting forth findings in conformance with State law for certain local modifications and changes to the Uniform Fire Code: RESOLUTION NO. 90-5 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, SETTING FORTH FINDINGS WITH RESPECT TO LOCAL CONDITIONS WITHIN THE CITY OF TUSTIN WHICH MAKE CERTAIN MODIFICATIONS AND CHANGES TO THE UNIFORM FIRE CODE REASONABLY NECESSARY FOR HOUSING OCCUPANCIES 2. Hold first reading by title only and introduction of the following Ordinance No. 1042: ORDINANCE NO. 1042 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REPEALING SPECIFIED SECTIONS OF ARTICLE 5 OF THE TUSTIN CITY CODE AND ADOPTING THE UNIFORM FIRE CODE AND UNIFORM FIRE CODE STANDARDS, 1988 EDITIONS. WITH AMENDMENTS THERETO AND THE UNIFORM FIRE CODE 1989 SUPPLEMENT AS THE FIRE PROTECTION REGULATIONS OF THE CITY OF TUSTIN PUBLIC INPUT (At this time members of the public may address the City Council regarding any items not on the agenda within the subject matter jurisdiction of the City Council provided that NO action may be taken on off -agenda items unless authorized by law.) VII. CONSENT CALENDAR All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. 1. APPROVAL OF MINUTES - JANUARY 2, 1990, ADJOURNED REGULAR MEETING 2. APPROVAL OF DEMANDS IN THE AMOUNT OF $1,133,935.81 RATIFICATION OF PAYROLL IN THE AMOUNT OF $157,460.55 3. 1990 CANDIDATES FORUM IN CITY FACILITY Direct staff to approve the Chamber of Commerce's application for a Candidates Forum as recommended by the Administrative Services Department. 4. REQUEST FOR PROPOSALS FOR PROFESSIONAL AUDITING SERVICES Approve the Request for Proposal for professional auditing services as recommended by the City's Audit Committee and authorize the Finance Director to advertise and otherwise distribute the RFP as recommended by the Finance Department. DISTRICT AGREEMENT NO. 12-028 A-11 I-5/SR-55 RECONSTRUCTION MITIGATIOr Approve Minute Order and authorii he Mayor and City Clerk to execute District Agreement No. 12-u28 A-1 as recommended by the Public Works Department/Engineering Division. 6. REQUEST FOR TREE REMOVALS Approve requests for tree removals at the following locations: 14172 Raleigh Place, 17381 Roseleaf Avenue and 17411 Parker Drive; and deny requests for tree removals at the following locations: 14522 Hyannis Port and 560 S. Pacific Street as recommended by the Public Works Department/Field Services Division. 7. RESOLUTION NO. 90-6 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING PLACEMENT OF STOP SIGNS AT TWO INTERSECTIONS LOCATED IN THE CITY OF TUSTIN (RAINTREE/FIG TREE, FIG TREE/CHERRYWOOD) Adopt Resolution No. 90-6 authorizing the placement of stop signs at the subject locations as recommended by the Public Works Department/Engineering Division. 8. RESOLUTION NO. 90-7 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR TRAFFIC SIGNAL IMPROVEMENTS AT MAIN STREET AND STONEGLASS, MAIN STREET AND EL CAMINO REAL, AND WALNUT AVENUE AND FRANKLIN AVENUE, AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS Adopt Resolution NO. 90-7 approving plans and specifications for subject project and directing the City Clerk to advertise for bids as recommended by the Public Works Department/Engineering Division. 9. RESOLUTION NO. 90-8 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REQUESTING THE ORANGE COUNTY TRANSPORTATION COMMISSION TO INCLUDE WITHIN THE ORANGE COUNTY UNIFIED TRANSPORTATION TRUST (OCUTT) FUND THE IMPROVEMENT OF RED HILL AVENUE Adopt Resolution No. 90-8 requesting the Orange County Transportation Commission to include projects from the City of Tustin in the 1990-91 OCUTT program as recommended by the Public Works Department/Engineering Division. 10. LAMBERT SCHOOL LEASE RENEWAL Renew the lease with the Tustin Unified School District for use of Lambert School for a period of one year commencing on February 1, 1990, and ending January 31, 1991, and authorize the Mayor to execute the same fiscal impact as recommended by the Community Services Department. 11. BID REJECTION ON ENTRY MONUMENT SIGNS Reject bid received from B.C. Unlimited and authorize resolicitation of bids for installation of new entry signs as recommended by the Community Development Department. 12. APPROVAL OF MEMORANDUM OF UNDERSTANDING WITH TUSTIN MUNICIPAL EMPLOYEES' ASSOCIATION Direct the City Manager to execute the Memorandum of Understanding with the Tustin Municipal Employees' Association as recommended by Administrative Services Department. ORDINANCE NO. 1041 - CONTRACT BETWEEN CITY COUNCIL AND CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM BOARD OF ADMINISTRATION The following Ordinance No. 1041 had first reading by title only and introduction at the January 2, 1990 City Council meeting. ORDINANCE NO. 1041 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF TUSTIN AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM Recommendation: M.O. - Ordinance No. 1041 have second reading by title only. M.O. - Ordinance No. 1041 be passed and adopted. (Roll call vote) X. OLD BUSINESS 1. STATUS REPORT - JOHN WAYNE AIRPORT NOISE MONITORING PROGRAM (JWA) , COALITION FOR A RESPONSIBLE AIRPORT SOLUTION (ORAS), AIRPORT SITE COALITION (ASC) AND HELICOPTER OVERFLIGHT PROGRAM TASK FORCE (HOPTF) Update on the John Wayne Airport Noise Monitoring Program (JWA), Coalition for a Responsible Airport Solution (CRAS) , Airport Site Coalition (ASC) and Helicopter Overflight Program Task Force (HOPTF) . Recommendation: Receive and file subject report as recommended by the Community Development Department. 2. REQUEST FOR WAIVER OF STREET DEDICATION FOR IRVINE BOULEVARD/NEWPORT AVENUE (CHEVRON, USA) This item was previously continued from the January 2, 1990 Council meeting at the request of both staff and Chevron, USA. Recommendation: Continue this item and refer it to the Tustin Community Redevelopment Agency for evaluation as recommended by the Public Works Department/Engineering Division. 3. COUNCIL MEETING SCHEDULE Report regarding the changing of City Council meetings to the second and fourth Mondays of the month and the Planning Commission meetings to the first and third Mondays of the month. Recommendation: Pleasure of the City Council. 4. 170 EL CAMINO REAL Summary of the status of the property located at 170 E1 Camino Real as requested by the City Council at their meeting of January 2, 1990. NEWSRACK ORDINANCE Mayor Pro Tem Kennedy requested the Children's Legal Foundation analysis of the newsrack ordinance prepared by the City Attorney's office be agendized for discussion. Recommendation: Pleasure of the City Council. XI. NEW BUSINESS 1. PROPOSED GUIDELINES FOR CHURCHES LOCATED IN THE INDUSTRIAL DISTRICTS On January 2, 1990, the City Council requested staff submit the Policy Guidelines for review. Recommendation: Receive and file subject report as recommended by the Community Development Department. 2. PROCLAMATION Mayor Pro Tem Kennedy is requesting appropriation of funds for the development and printing of a new proclamation. Recommendation: Pleasure of the City Council. 3. AWARD OF CONTRACT FOR RECREATIONAL VEHICLE STORAGE LOT.. LAURELWOOD HOMEOWNERSI ASSOCIATION Bids were opened January 9, 1990, for subject project and the low bid by Modern Asphalt, Inc. was 49% over the engineer's estimate of $112,872.20. Recommendation: Award the contract for the subject project to Modern Asphalt, Inc. in the amount of $168,292.15 as recommended by the Public Works Department/Engineering Division. 4. ACQUISITION OF PROPERTY Councilman Prescott requested the City Council discuss the possible acquisition of a vacant parcel for sale on Prospect Avenue between Main Street and Third Street. The site is adjacent to the City Water Department. Recommendation: Pleasure of the City Council. S. FOLLOW-UP TRAFFIC SIGNAL WARRANT ANALYSIS - BRYAN AT FARMINGTON Staff evaluation of subject intersection regarding traffic signal warrants. Recommendation: Approve the installation of a traffic signal at the intersection of Bryan Avenue and Farmington Road and direct staff to include this item in the upcoming 1990-91 Capital Improvement Budget as recommended by the Public Works Department/Engineering Division. Recommendation: Pleasure of the City Council. XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - JANUARY 81 1990 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of January 8, 1990. 2. BANNERS AND TEMPORARY USE PERMITS FOR PROPERTIES LOCATED ALONG TUSTIN EAST DRIVE Review of the status regarding banners displayed at the properties located along Tustin East Drive per direction at a meeting of the City Council on January 2, 1990. Recommendation: Receive and file subject report as recommended by the Community Development Department. 3. VANDENBERG WELL SITE PROJECT At their January 2, 1990 meeting, the City Council requested an update on the status of the Vandenberg Lane water well project. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 4. TRASH RECEPTACLES AT BUS LOCATIONS At a previous City Council meeting, staff was requested to review areas throughout the City for the potential placement of solid waste/trash receptacles adjacent to the OCTD bus stop locations.
