BACKGROUND: In April 1989, the City of Tustin entered into District Agreement No. 12-028 with the California Department of Transportation. That agreement provided for Caltrans to fund improvements to City streets that will be impacted by the reconstruction of the I-5/SR-55 interchange. The improvements are intended to mitigate traffic congestion that will ccur as a result of the interchange reconstruction. Subject action is an amendment to the initial agreement that provides for refinement of distribution of funding for the work to be done. The scope of the work to be done remains the same as before: a) Widening First Street at Tustin Avenue and signalization of the intersection. b) Widening of the west side of Yorba Street between Irvine Boulevard and First Street. c) Modification of traffic signals at the intersections of Yorba Street at First Street and Irvine Boulevard. d) Restriping of First Street, Yorba Street, and Irvine Boulevard. Bob Ledendecker irector of Public Works/City Engineer BL: REJ:mv THIS 19 its and 12 -ORA -5/55 Stage 2 12209 - 101641 District Agreement No. 12-028 A-1 AMENDMENT TO AGREEMENT AMENDMENT TO AGREEMENT, ENTERED INTO ON is between the STATE OF CALIFORNIA, Department of Transportation, referred acting by and through to herein as "STATE," CITY OF TUSTIN a body politic and a municipal corporation of the State of California, referred to herein as City RECITALS 1. The parties hereto entered into an Agreement (Document No. 6791) on April 3, 1989, said AGREEMENT defining the terms and conditions of a cooperative project to provide for improvements to CITY streets impacted by STATE's reconstruction of Route 5/55 Interchange referred to herein as PROJECT. 2. Said AGREEMENT set the STATE's share of cost for PROJECT at $434.000 by Stage 2 and it has now been determined that Stage 3 is required with no increase in cost to PROJECT and that cost for each stage of PROJECT should be addressed separately. IT IS THEREFORE MUTUALLY AGREED 1. That Section I, Article 4 of the original AGREEMENT is amended to read "To deposit with CITY within 25 days of receipt of billing therefor (which billing may be forwarded immediately following CITY's respective bid advertising dates of the construction contract for Stage 1, Stage 2, and Stage 3 of PROJECT) the following: a. The amount of $340,000, which figure represents the STATE's share of construction costs required -to complete Stage 1 of PROJECT. b. The amount of $71,000, which figure represents the STATE's share of construction costs required to complete Stage 2 of PROJECT. C. The amount of $23,000, which figure represents the STATE's share of construction cost required to complete Stage 3 of PROJECT. STATE'S total obligation for PROJECT shall not exceed the amount of $434,000. Said construction costs for all stages are shown on Exhibit A, attached and made a part of this AGREEMENT." Revised Exhibit A, attached and made a part of this AMENDMENT supersedes Exhibit A shown in the original AGREEMENT. 2. To add to Section III, Article 2 of the original AGREEMENT "CITY will be responsible for the construction cost of PROJECT in excess of $434,000." 3. That Section III, Article 7 of the original AGREEMENT is amended to read "STATE will only participate in Stage 1 of PROJECT work that will be completed prior to the closure of the Fourth Street at Route 5 and Route 55. STATE will only participate in Stage 2 of PROJECT work that will be completed prior to the closure of First Street at Route 5 and Route 55. 4. To add Article 9 to Section III of original AGREEMENT to read "After opening of bids for each stage, STATE'S required deposit under Section I, Article 4, will be revised based on actual bid prices for that stage with STATE's total obligation for PROJECT not to exceed the amount of $434,000." S. The other terms and conditions of said AGREEMENT (Document No. 6791) shall remain in full force and effect. 6. This AMENDMENT TO AGREEMENT is hereby deemed to be a part of Document No. 6791.
