PROPOSED ORDINANCE NO. 382 HEARINGS AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE ZONING ORDINANCE NO. 157, AS AMENDED, AND THE TUSTIN CITY CODE RELATIVE TO CIRCUSES , CARNIVALS, FAIRS AND OTHER AMUSEMENTS AND THE CONDUCT OF OUTDOOR SALES. Hearing opened at 7:32 P.M. There being no comments or objections, the hearing was declared closed at 7:33 P.M. VII · OLD 1. a)ORDINANCE NO. 377 BUSINESS AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING BY REFERENCE ORANGE COUNTY ORDINANCE NO. 2159, WHICH IS AN ORDINANCE RELATING TO ANIMAL CONTROL, WELFARE, LICENSE AND HEALTH REQUIREMENTS. Moved by Miller, seconded by Klingelhofer that Ordinance No. 377, adopting by reference Orange County Ordinance No. 2159, have first reading by title only. Carried unanimously. b) RESOLUTION NO. 924 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING A FEE SCHEDULE FOR SERVICES OF THE ORANGE COUNTY HEALTH .DEPARTMENT RELATIVE TO ANIMALS. Mr. Gill explained' that the Planning Commission had initiated a change of zone on the small corner parcel of C-1 property but that at the request of the owner, Mr. Sullivan, the Commission had with- drawn its in~ttation of this zone change. NEW 1.a) RESOLUTION NO. 922 BUSINESS A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF ORANGE TO PERMIT THE COUNTY CLERK OF SAID COUNTY TO RENDER SPECIFIED SERVICES TO THE CITY OF TUSTIN, RELATING TO THE CONDUCT OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON APRIL 9, 1968. Absent: None. b) RESOLUTION NO. 926 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY 0N TUESDAY, THE 9th DAY OF APRIL, 1968, FOR THE ELECTION OF CERTAIN OFFICERS OF SAID CITY AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF OF CALIFORNIA RELATING TO GENERAL LAW CITIES. RESOLUTION .NO. 923 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING COUNCIL POLICY NO. 20-11 RELATIVE TO CONFLICT OF INTEREST. Moved by Ring, seconded by Miller that Resolution No. 923 be read by title only. ~arried unanimously. Ayes: Mack, Klingelhofer, Coco, M!ller, Ring. Noes: None. Absent: None. Minutes Mr. Gill stated that the Department Heads have read and approved this Policy. At this time he does not know how many employees are engaged in outside activities. Each e~ployee who does so engage - under this Policy - will fill out the form for his approval. 3. RESOLUTION NO. 925 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING INITIATION OF PROCEEDINGS IN EMINENT DOMAIN TO ACQUIRE A CERTAIN 4.128 ACRE PARCEL AT RED HILL AVENUE AND THE ORANGE COUNTY FLOOD CONTROL CHANNEL. Councilman Miller pointed out that the acquisition of this property relates to the re-evaluation of fire services. One of the recommendations of the Underwriters Board was that we acquire an additional fire station to service the industrial part of the City and that'this will have a beneficial effect on all the fire insurance rates in the City. This is also a site for a much needed corporation yard. Co.un.cilman Ring stated that this will not only reduce the fire zone rate, but gives better access for vehicles for the heavy density apartment areas south of the freeway. Xn answer to questioning by Councihnan Klingelhofer, Mr~ Gill stated that this is action by the. City to acquire the property by eminent domain and the City is taking condemnation action. The property owners have been notified and there has been no opposition. Above motion to adopt Resolution No. 925 carried by r~ll call. Ayes= Mack, Elingelhofer, Coco, Miller, Ring. Noes: None. Absent: None. 4. ESTABLISHING COST OF CANDIDATES STATEMENT OF QUALIFICATION PURSUANT TO SECTION 10012.5 OF THE ELECTION CODE. Carried. ' Council Minutes 1/15/68 Pg. 5 5; APPROVAL OF DEMANDS Moved by Miller, seconded by Klingelhofer that demands in the amount of $16,665;6~ be paid. Councilman Ring conu~ented that the reason for the relatively low figure is~hat the January 15th payroll is not included. Councilman Ring also pointed out that.the $3,600 reimbursement to the State for the City's deposit for landscapin~ under the Newport Avenue bridge of the Santa Aria Freeway is another step that the Cnuncil and City has taken forward toward the beautification of the City. Mr. Gill stated that bids on this will be opened by the State o~ February 8th and construction should start within a month of bid opening. In answer to questioning by Councilman Miller relative to landscaping from Newport to approximately the Youth Center, Mr. Gill stated that most of the problem area was on private land and not on State property. This agreement for landscaping under the Freeway is somewhat unique and the City will be maintaining it until such time as the Freeway maintenance gets this far which will probably be 1970 or 1971 when the Freeway will be landscaped and maintenance~ be done past the Tustin area. The landscaping of private property has been discussed with the o~mers, but neither the City or State has any ~urisdiction over it. Councilman Klingelhofer suggested that this be referred to the Parks and Recreation Commission and we might find receptive ears to the beauti- fication of this property. It was~also suggested that perhaps the Chamber of Commerce could be helpful in this matter. IX. OTHER CITY ADMINISTRATOR BUSINESS 1. Police. Summary Mr. Gill informed the Council that as of the first meeting in February, the Council will be receiving a Police Stmunary. 2. Harbor District Mr. Gill stated that he had attended the Local Agency Formation Commission hearing on the Harbor District matter, and the hearing was deferred to February 21st. Hebelieved this would be discussed at the February 8th League meeting. He has spoken to some Managers and understands that other cities will be taking action similar to thatof Tustin. Councilman Klingelhofer urged the'attendance of as many Councilmen who could respond at this League meeting on February 8th at Freidmann Hall in Orange.
