AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA,
AMENDING THE ZONING ORDINANCE NO. 157, AS
AMENDED, AND THE TUSTIN CITY CODE RELATIVE
TO CIRCUSES, CARNIVALS, FAIRS AND OTHER AMUSE-
MENTS AND THE CONDUCT OF OUTDOOR SALES.

Mr. Gill stated that the staff has. requested that
this ma~ter be continued to the January 15th
Meeting.

BUSINESS FOR CONSTRUCTION OF A CENTER ISLAND ON FIRST
STREET FROM "H" STREET TO NEWPORT AVENUE. -

CoUncilman Klingelhofer stated that he would concur
with the Chamber of Commerce request that this be
deferred until the February 5th Meeting in order
that they may have an opportunity to study this.

Ordinance No. 383, approving ZC-67-161 of G.L.A.

SUPERVISORS OF THE COUNTY OF ORANGE TO CANCEL
TAXES.

unanimously.

3. TRAVEL REQUEST - SPRING MEETING, CITY MANAGERS'
DEPARTMENT, LEAGUE OF CALIFORNIA CITIES.
Moved by Miller, seconded b~ Klingelhofer that the
City Administrator be authorized to attend the
Spr/ng Meeting, Cfty Managers' Department, League
~f California Cities in Palm Springs, February 28th
to March let, and to incur all necessary costs at
City expense. Carried.
4. TRAVEL REQUEST - ANNUAL CONFERENCE OF THE
CALIFORNIA CIVIL DEFENSF AND DISASTER COUNCIL.

BUSXNESS
1. ORANGE COUNTY HARBOR DISTRICT
Mr. Gill presented correspondence from the Local
Agency Formation Co~ission relative to request of
the City of Huntington Beach to be detached from
the Orange County Harbor District.
Councilman Miller stated that the ~arbor District
has been a ma~teE of concern to the Council before.
It would be well for the City to take some action
on this. The Council has consistently felt that the
imposition of a County-wide tax on an equal basis
is not fair when a major benefit accrues to the cit' s
on the beach and cities such as Tustin and inland
cities pay exactly the same tax rate.
Councilman Klingelhofer stated that.he concurred with
Councilman Miller. Huntington Beach is apparently
having some difficulty working with the Orange County
Harbor District in settling some matters of juris-
diction or some arrangements for taking care of
some of their beach property.
Moved by Klingelhofer, seconded by Miller that the
City Council send a letter to the Local agency
Formation'Commission requesting this Commission to
contlnue their hearing to a later eime in order that
we m~ght have the opportunity for further study on
the matter. Included in this letter should be the
tentative feeling of the Council that we are in '
sympathy with Huntington Beach and their grievance
o~ their applioation, and that by deferment, the
City of Tustin and other cities in the County of
Orange would be afforded .the opportunity for further
study.

Mayor Mack stated that he believed that the
Council has made it quite plain in the past that
we were not happ with the present situation of
taxing for the H~rbor District, and requested that
a letter be sent to the Harbor District asking
them to spell out specifically how a citizen of
Tustin is directly affected by this tax.
Councilman Klingelhofer felt that the League of
Cities should have an opportunity to discuss this,
and that a deferment would provide time for
discussion by the League.
Above motinn carried.
Counc~'lman Klingelhofer stated that' he wo~ld
appreciate a copy of the letter to LAFC be sent
to Mayor Honold with a note stating that the
Council feels this is worthy of consideration.
Councilman Miller asked that copies be sent to all
cities in the County. If it is felt that there is
interest, the Council would soon find this out.
Ma~For Mack directed that a copy of the letter to
the Local 'Agency Formation Commissi/on be sent to
Mayor Honold, the League of California Cities, Orange
County, and to each of the 25 cities in the County.
2. RESOLUTION NO. 921
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA OF INTENTION TO ABANDON
AND VACATE A PORTION OF A PUBLIC STREET ON
BROWNING AVENUE, BETWEEN WALNUT AVENUE AND NAVY
WAY, IN THE CITY OF TUSTIN, CALIFORNIA.
Mr. Gill explained that this portion of Browning
Avenue at the present time' is an alignment of
Browning and not a constructed street. This is
superimposed by the new development on the Irvine
Lands by the Bob Grant Development Co.

Resolution No. 921, of intention to abanuon and
vacate a portion of a public street on Browning
Avenue, be passed and adopted. Carried by roll
