HUSTON, EXECUTIVE DIRECTOR COMMUNITY DEVELOPMENT DEPARTMENT TIME EXTENSION, DESIGN REVIEW 87-33 RECOMMENDATION It is recommended that the Redevelopment Agency approve the request for a 12 month extension of Design Review 87-33 by adoption of Resolution No. RDA 90-3. BACKGROUND On December 21, 1987, the Redevelopment Agency approved Design Revie 87-33 for construction of a 25,281 square foot retail cente. This center is to be located on a 1.9 acre parcel at the .lortheast corner of El Camino Real and Newport Avenue. On November 71 1988, the Agency granted a 12 month extension for the project given the extraordinary efforts needed to remove soil contaminates from the site. The applicant has requested another 12 month extension as the site clean up from soil contaminates has taken a significantly greater amount of time than originally anticipated (Attachment A). The applicant is presently making progress in soil clean-up and working drawing plan check is virtually complete. SUMMARY Staff has reviewed the applicant's request and considers the request for extension to be valid due to the soil contamination problems of the site. The applicant has been making progress since the last extension. RDA 90-3 A RESOLUTION OF THE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING A SECOND TIME EXTENSION OF THE APPROVAL FOR DESIGN REVIEW 87-33 FOR CONSTRUCTION OF A 25,281 SQUARE FOOT RETAIL SHOPPING CENTER AT 1011 EL CAMINO REAL. The Redevelopment Agency of the City of Tustin does hereby resolve as follows: I. The Redevelopment Agency finds and determines as follows: A. Pursuant to the adopted South/Central Redevelopment Plan, the Redevelopment Agency shall approve all site plans and architectural designs of any project proposed within the Redevelopment Agency Project Area. B. A proper application, (Design Review No. 87- 33) has been filed on behalf of L.A. Land Company requesting authorization to construct a 25,281 square foot retail shopping center at 1011 E1 Camino Real. This project was approved by the Agency on December 21, 1987. C. A Negative Declaration has been approved in conformance with the California Environmental Quality Act by adoption of Resolution RDA 87- 19. D. The project is in conformance with the Town Center Redevelopment Plan. E. An extension of time is needed to complete the clean-up efforts from soil contamination. II. Shingleton Director of Community Development Federal Express Community Development Department City of Tustin 300 Centennial Way Tustin, CA 92680 Re: Request for Extension of Design Review Approval No. 87-33 Retail Center at 1011 El Camino Real Dear Ms. Shingleton: We hereby request a twelve-month extension of Design Review Approval No 87-33 which currently expires December 21, 1989. The approval was originally granted December 21, 1987 and an extension was granted November 7, 1988 as the clean-up of hydrocarbon (gasoline) contamination on the site was still incomplete preventing the transfer of property and the start of construction. According to discussions with our architect it is our understanding that we have now made all xrections to the construction drawings required by the planning and building departments and, expect for one remaining fire department issue regarding our water service connection, the plans are approved and ready for permit. The remediation of the contamination on the site due to leakage from pre-existing underground tanks has slowly progressed. The contaminated soil was excavated, treated, and replaced down to 25 feet. A system for removing the contaminants from below this level has been approved by the various agencies involved including Orange County Health Department, the lead agency for overseeing clean-up projects in our area. The underground portion of the system has been installed and inspected. All that remains to our knowledge is the installation of the above ground filtering equipment for the remediation system and clarification of some issues contained in two of the several reports that make up the Site Remediation Plan. We have been told by Orange County Health that they anticipate meeting the last week of December with the current owner of the site, the environmental consultants who prepared the Plan and ourselves to resolve any outstanding items standing in the way of final Orange County approval. Once this approval Js received, the property will be transferred to us and construction can begin.
