HomeMy WebLinkAboutCC MINUTES 2000 09 05 MINUTES REGULAR MEETING OF THE CITY COUNCIL CITY OF TUSTIN, CALIFORNIA SEPTEMBER 5, 2000 CALL TO ORDER The meeting was called to order by Mayor Thomas at 7:11 p.m. in the Council Chamber, 300 Centennial Way, Tustin, California. The Invocation was given by Councilmember Potts and the Pledge of Allegiance was led by Councilmember Saltarelli. ROLL CALL Council Present: Jeffery M. There were no members in the audience and Public Input was closed. Mayor Thomas announced the City Council would convene in closed session to confer with its labor negotiator, Arlene Marks, Human Resources Manager, regarding 1 ) Tustin Police Management Association; and 2) Tustin Police Officers Association. PUBLIC HEARING - None CONSENT CALENDAR ( ITEMS 1 THROUGH 11 ) it was moved by Potts, seconded by Worley, to approve the Consent Calendar as recommended by staff. Motion carried 5-0. 1. APPROVAL OF MINUTES - AUGUST 21, 2000 REGULAR MEETING Recommendation: Approve the City Council Minutes of August21,2000. 2. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,354,482.10 and ratify Payroll ~n the amount of $401,715.26. 3. PLANNING COMMISSION ACTION AGENDA - AUGUST 28, 2000 All actions of the Planning Commission become final unless appealed by the City Council or ,. member of the public. AGREEMENT FOR CITY'S PARTICIPATION IN THE NEWPORT BAY/SAN DIEGO CREEK WATERSHED FEASIBILITY STUDY Recommendation: Approve the Agreement with the County of Orange to provide funding for the U.S. Army Corps of Engineers Feasibility Study in the Newport Bay/San Diego Creek Watershed and authorize execution of the Agreement by the Mayor and City Clerk as recommended by the Public Works Department/Engineering Division. 400-70 5. AUTHORIZATION TO EXPEND FUNDS, SOLE SOURCE VENDOR Recommendation: Authorize staff to utilize budgeted funds to purchase the Dictaphone Freedom Recording System as recommended by the Police Department. 270-85 6. CEDAR GROVE PARK STATUS OF ON-SITE PARKING Recommendation: Refer this item to the City's Parks and Recreation Commission to identity and evaluate altematives for providing additional parking for Cedar Grove Park as recommended by the Public Works DepartmentJEngineenng Division. 920-65 7. RESOLUTION NO. 00-63, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE CLASSIFICATION PLAN Recommendation: Adopt Resolution No. 00-63 changing the classification title of Human Resources Manager to Human Resources Director, the title of Senior Personnel Analyst to Senior Human Resources Analyst and the title of Personnel Analyst to Human Resources Analyst as recommended by the Human Resources Manager. 510-25 8. CLAIM OF KARl WATSON - CLAIM NO. 00-18 Recommendation: Reject the claim and direct the City Clerk to send notice thereof to the claimant and the claimant's attorneys as recommended by the City Attorney. 180-10 9. CLAIM OF RANDI SHAPIRO - CLAIM NO. 00-28 Recommendation: Reject the claim and direct the City Clerk to send notice thereof to the claimant and the claimant's attorneys as recommended by the City Attorney. 180-10 10. CLAIM OF JEFF PITTMAN - CLAIM NO. 00-21 Recommendation: Reject the claim and direct the City Clerk to send notice thereof to the claimant and the claimant's attorneys as recommended by the City Attorney. 180-10 11. CLAIM OF SON NGUYEN - CLAIM NO. 00-14 Recommendation: Reject the claim and direct the City Clerk to send notice thereof to the claimant and the claimant's attorneys as recommended by the City Attomey. 180-10 REGULAR BUSINESS ( ITEMS 12 THROUGH 13 ) 12. RECREATION PROGRAMMING AT HEIDEMAN AND BESWICK SCHOOLS Patrick Sanchez, Director of Parks and Recreation, reported that a rewew of recreation and sports programming for Heideman and Beswick Schools revealed the need for renewed effod in providing after-school activities; and partnerships would be formed with the local American Youth Soccer Organization program, Skyhawks program and local leadership for fall, winter, and spring programs, commencing this year. It was moved by Potts, seconded by Worley, to continue to direct Parks and Recreation Services Department to provide after school programs at both Heideman and Beswick Schools in cooperation with the school principals. Motion carded 5-0. 1020-60 13. MEDIA ONE STATUS REPORT Councilmember Doyle commented on the concerns of senior citizens and questioned if the new service would require a cable-ready television to have a box in order to get HBO. Council/Steve Sawyer and Del Heintz, AT&T Repre,,sentatives/staff discussion followed regarding costs of the addressable converter box and remote control; cable-ready televisions would not require a box unless the resident desired more channels than basic cable provided; complaint calls of repeated cable outages and poor customer service continued to occur; educating residents regarding the new service had commenced; changes would begin to affect residents ~n approximately two months and should be completed by December 2000; %'1i .......... "CoO: '' ~ efforts were being made to improve customer service; high-speed internet service through AT&T Roadrunner Express, digital telephone and television would be a part of AT&T's future rebuild; satellite had been a significant marketplace competitor; the new cable boxes would be furnished free of charge for two months; charges were pro-rated for cable outages with credit back to customers; local programming would now be broadcast on channel 3 instead of channel 33; and Cox Communications had received approval To install s fiber optic line directly into the Council Chamber to facilitate Council meeting broadcasts. It was moved by Saltarelli, seconded by Doyle, to receive and file the Media One status report. Motion carried 5-0. 400-10 PUBLIC INPUT Media One/AT&T Cable Peter Gabridge, Berklee Maughan, and Ellen Burkey spoke on Media One/AT&T rate increase with same service level; a VCR could still be used on channel 3; the Federal Communications Commission and Media One agreement allowed service upgrades in exchange for rebates; and local events and hours needed to cover events should be included in the upcoming franchise agreement. Council/staff discussion followed regarding a new franchise agreement; language should include a specific amount of ocal programming; local government no longer had the power to regulate cable rates/boxes; areas serviced by Cox Communication had similar complaints regarding local programming; Council meeting coverage was included in the current franchise agreement; and the City had enough information to negotiate a good franchise agreement with Media One or other providers. OTHER BUSINESS / COMMITTEE REPORTS MCAS-Tustin ....... Council thanked staff, Cedric Sampson and Mayor Pro-Tem Wo~ey for their time and effort spent in Sacramento fighting recent Santa Ana Unified School Distdct proposed legislation to acquire land on MCAS-Tustin. New Trash Franchise Agreement Councilmember Ports requested agendizing at the October 2, 2000 meeting discussion of the City's new trash franchise agreement. Traffic Congestion Mayor Pro-Tem Worley complained about the traffic jam at Tustin F~anch/Pioneer F~oads during the morning when parents were dropping their children off at school and requested the Police Department direct traffic. Labor Day Weekend Mayor Thomas commented on the beautiful Labor Day weekend weather. ADJOURNMENT - Mayor Thomas adjourned the meeting at 7:55 p.m. The next regular meeting of the City Council was scheduled for Monday, September 18, 2000, at 7:00 p.m. in the Council ....
