HomeMy WebLinkAboutPH 1 VACATE CHAMPION 02-05-90r DATE: JANUARY 30, 1990 TO: WILLIAM HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION PUBLIC HEARING N0. 1 2-5-90 Inter - Com SUBJECT: VACATION AND ABANDONMENT OF CHAMPION WAY WESTERLY OF JAMBOREE ROAD RECOMMENDATION It is recommended that upon the completion of the public hearing for the subject vacation and abandonment of Champion Way and if the City Council desires to proceed with said vacation and abandonment proceedings, that the attached resolution be passed and adopted at their meeting of February 5, 1990. BACKGROUND At their meeting of January 2, 1990, the City Council adopted Resolution No. 90-4 declaring it's intention to vacate and abandon Champion Way westerly of Jamboree Road and fixing a time and place for the public hearing thereof. The public hearing has been set for the February 5, 1990 City Council meeting at 7:00 P.M.. After the public hearing has been opened, public testimony, if any, has been received and the public hearing closed, the City Council if it so desires, can vacate and abandon Champion Way westerly of Jamboree Road with the passage and adoption of the attached resolution. This resolution provides for permanent easements per Section 8330 of the Streets and Highways Code, for all existing public utilities within vacated and abandoned Champion Way. Additionally, this vacation/abandonment proceeding provides the process for the street to become a private street to provide access to Lots 21 and 22 of Tract No. 12870 via Lot "LLL" of Tract No. 12870 (Amendment No. 2) Once the adopted resolution is recorded at the County Recorders Office, the proceedings on this abandonment action are complete. The City Council finds and determines: A. The City Council duly adopted its resolution No. 90-4, declaring its intention to vacate and abandon Champion Way, described in Exhibit "A" and shown on Exhibit "B" attached hereto and incorporated herein by this reference, and fixing a time and place of public hearing thereon. B. Said resolution has been duly published according to law; and C. Said notices of said hearing have been posted as required by law; and D. A public hearing has been duly called, noticed and held according to law, and all persons interested in or objecting to the proposed vacation and abandonment appearing at said hearing were heard. E. Said portion of streets are not necessary for present or prospective public street purposes, except for public utilities. F. That the Planning Commission by adoption of Resolution No. 2725 dated December 11, 1989, has determined that the subject property should be declared excess to the City's needs and disposed of for private street purposes. G. Categorical exemption from EIR requirements. II. The City Council hereby orders the vacation and abandonment of Champion Way described in Exhibit "A" and shown on Exhibit "B" attached hereto, subject to the reservation of easements per Section 8330 of the Street and Highway Code. III.
