HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT CONSENT CALENDAR NO. 10 2-5-90 Inter - Com SECOND AMENDMENT TO FINAL TRACT MAP 12870 RECOMMENDATION It is recommended that the City Council approve second amendment to Final Tract Map 12870 by adoption of Resolution No. 90-11. BACKGROUND Final Tract Map 12870 was recorded in May of 1988, establishing streets and lots for Phase III of the Tustin Ranch. All streets established with the recordation of Final Tract Map 12870 were public streets. The applicant has submitted a request to the Public Works Department to vacate Champion Way, (a public street) in order to create a private street as shown on Attachment I. Under separate approvals, the applicant proposes to construct a private street and landscape improvements for Champion Way. In order to accommodate the proposed private street improvements, which involves widening the street section and shortening the street's length, the applicant is requesting approval to amend the final map for Tract 12870 to adjust the boundaries of the lots adjoining the subject streets (Lots 21 and 22) of Tract 12870. On December 11, 1989, the Planning Commission adopted Resolution No. 2726 (attached), recommending City Council approval of the requested second amendment to Final Tract Map 12870 . At that time, the Planning Commission also adopted findings that the proposed street vacation was consistent with the City's General Plan the Commission also approved design reviews for two adjacent development projects on Lots 21 and 22 subject to City Council approval of this second amendment to Final Tract Map 12870. DISCUSSION The proposed second amendment to Final Tract Map 12870 would adjust the boundaries of the Champion Way right-of-way and the adjacent builder and landscape lots to create a private street entry for an expected 630 dwelling units and an estimated 1,386 residents. City Council Report Second Amendment to Tract 12870 February 5, 1990 Page 2 The proposed amendment includes the following: Champion Way becomes lots "LLL". A small area for transition in the vicinity of the intersection of Champion Way and Jamboree Road would remain public as required by the Public Works Department. The street width of Champion Way would be widened from 56 feet to a maximum of 93 feet to accommodate a median and decorative street improvements (separate projects to follow shall provide details on these improvements). ° The street length of Champion Way would be reduced from approximately 450 feet to approximately 380 feet, resulting in an increased depth of Lots 21 and 22 at their shared boundary from 235 feet to 309 feet. Landscape lots "GG" and "HH" would be eliminated since all landscaping and street maintenance responsibilities would be under private ownership. ° Lot 21 is reduced in size from 13.428 acres to 13.408 acres as a result of the lot line adjustments. This has no effect on the proposed density of the project proposal on lot 21 (Tract 13824). Lot 22 is reduced in size from 12.808 acres to 12.791 acres as a result of the lot line adjustments. This would reduce the maximum permitted number of dwelling units on this site; however, has no effect on the project proposed on Lot 22 (Tract 13786). Landscape lot "FF", located between Lot 21 and Jamboree Road, is reduced in size from 0.678 acres to 0.657 acres as a result of the widening of Champion Way. Landscape lot "II", located between Lot 22 and Jamboree Road, is reduced in size from 0.517 acres to 0.496 acres. The proposed widening and shortening of Champion Way, the elimination of lots "GG" and "HH" and the reduction in size of lots 21, 22, FF and II would not result in a substantial deviation from the purpose and intent of the approved final map. Maintenance responsibilities for all improvements within lot "LLL" Community Development Department City Council Report Second Amendment to Tract 12870 February 5, 1990 Page 3 will be the responsibility of a Master Homeowner's Association that will include future developments on lots 21 and 22 of Tract 12870. CONCLUSION Given the analysis conducted by staff and consideration of comments from outside agencies, it is concluded that the proposed second amendment to Final Tract Map 12870 meets the requirements of the State Subdivision Map Act, State Planning Law, the East Tustin Specific Plan, the Tustin City Code and the California Environmental Quality Act. It is, therefore, recommended that the City Council approve the second amendment to Final Tract Map 12870 subject to the conditions contained in Exhibit A of Resolution No. 2726. The Planning Commission of the City of Tustin, California does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That the Irvine Company has proposed that the City of Tustin vacate Champion Way west of Jamboree Road. B. That Section 65402 of the California Government Code provides that no street shall be vacated or abandoned if the adopted General Plan or part thereof applied thereto until such street vacation or abandonment has been submitted to and reported upon by the planning agency as to conformity with said adopted General Plan or part thereof. C.
