SUBJECT: ACCEPTANCE OF PUBLIC GRADING AND DRAINAGE IMPROVEMENTS ALONG
JAMBOREE ROAD BETWEEN TUSTIN RANCH ROAD AND SANTIAGO CANYON
ROAD (RELOCATED)
RECOMMENDATION:
That the Tustin City Council adopt the attached resolution accepting
works of improvement and authorizing the recordation of the notice of
completion for grading and drainage improvements along Jamboree Road
between Tustin Ranch Road and Santiago Canyon Road (Relocated).
Assuming no claims or stop payment notices are filed, it is further
recommended that, 30 days after the date of recordation of the notice of
completion, the Council authorize payment of the final 5% retention
amount of $495,314.94. This amount, together with previous payments of
$9,410,983.81, represents 100% of the final contract amount of
91906,298.75.
BACKGROUND:
The subject project consists of grading and drainage improvements along
Jamboree Road between Tustin Ranch Road (Station 211+00±) and Santiago
Canyon Road/Relocated (Station 394+93 ), a distance of 3.5 miles. The
project was located within two jurisdictions, the City of Orange and the
City of Tustin, with Tustin acting as the lead agency for the project.
On October 2, 1989, the City Council accepted a portion of this grading
and drainage work within the City of Tustin between Tustin Ranch Road
(Sta. 211+00±) and the northerly city limits (Sta. 309+80±). This early
acceptance of a portion of the contract was initiated so that the street
paving and utility contract could be accelerated to provide a June 1990
completion date for the entire project.
This project is funded by the following assessments districts in both
cities:
AD No. 86-1 City of Orange
AD No. 86-2 City of Tustin/City of Orange
AD No. 86-1 is located solely within the jurisdiction limits of the City
of Orange while AD No. 86-2 is located in both the jurisdictions of
Orange and Tustin. Assessments for funding the project costs are
applied to each assessment district within each respective jurisdiction.
Each of the local agencies' general funds will not be impacted.
DISCUSSION:
This project has now been completed by the contractor, E. L. Yeager
Construction Company, to the satisfaction of the Public Works
Departments in both the City of Orange and the City of Tustin.

The final contract amount for this project is $9,906,298.75 which
represents a contract overrun of 67.49% over the original contract
amount of $5,914,489.60. There were twenty-seven contract change orders
on this project totaling $3,991,809.15. A recap of each change order is
outlined on the attached Exhibit "A". Sufficient funds existing in both
AD 86-1 (Orange) and AD 86-2 (Orange/Tustin) are enough to cover the
entire cost of the project.
The larger contract change orders were caused by unforeseen geotechnical
conditions requiring additional excavation and recompaction of cut
slopes in two major locations, retaining walls, and additional pipe"
°encasement for the protection of three major water lines as well as the
increase in scope of the project. The City Council has been previously
advised of these change orders as they occurred. The increase in
project scope included approximately 1,700 additional lineal feet of
roadway grading which was to have been completed under a separate
..contract.
she total project costs inclusive of contract change orders will be
spread throughout the AD No. 86-2 assessment boundary areas based upon
the original Engineer's Report for the formation of the District.
It is requested that the Tustin City Council pass and adopt the attached
resolution accepting the works of improvement and authorizing the,
recordation of the notice of completion for the grading and drainage
improvements along Jamboree Road between Tustin Ranch Road and Santiago
Canyon Road (Relocated).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN ACCEPTING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF
COMPLETION FOR GRADING AND DRAINAGE
IMPROVEMENTS ALONG JAMBOREE ROAD BETWEEN
TUSSTIN RANCH ROAD AND SANTIAGO CANYON ROAD
(RELOCATED)
WHEREAS, E. L. Yeager Construction Company, Inc., having a
contract with the City of Tustin to construct the hereinafter
described public work and improvement; and
WHEREAS, the City Engineer has duly certified to the
construction- and completion of said public improvements
hereinafter mentioned in manner satisfactory to the City Council
of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has
completed said public improvement hereinafter more particularly
described in accordance with the provisions of the contract
documents and the notice of completion and acceptance of said
public work and improvement should be filled and payment of the.,
balance due said contract authorized in accordance with the
contract documents.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Tustin that said public work and improvement be, and the
same is hereby accepted. Said public work and improvement is
more particularly described as follows:
Grading and Drainage Improvements Along Jamboree Road
Between Tustin Ranch Road and Santiago Canyon Road
(Relocated)
AND BE IT FURTHER RESOLVED that the City Engineer of the
City of Tustin be, and is hereby authorized to execute and file
a notice of completion and acceptance of said public work and
improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council
lof the City of Tustin on February 5L 1990.
