HomeMy WebLinkAboutCC 22 PUBLIC IMPROV'S 02-05-90DATE: TO FROM JANUARY 29, 1990 WILLIAM HUSTON, CITY MANAGER CONSENT CALENDAR NO. 22 } 2-5-90 Inter - Com PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS ON TUSTIN RANCH ROAD, MYFORD ROAD, JAMBOREE ROAD, BROWNING AVENUE, IRVINE BOULEVARD AND BRYAN AVENUE RECOMMENDATION: That the Tustin City Council adopt the attached resolution accepting works of improvement and authorizing the recordation of the notice of completion for public improvements along Tustin Ranch Road, Myford Road, Jamboree Road, Browning Avenue, Irvine Boulevard and Bryan Avenue. Assuming no claims or stop notices are filed, it is further recommended that, 30 days after the date of recordation of the notice of completion,. the City Council authorize payment of the final 5% retention amount of $59,774.69. This amount together with previous payments of $1,135,719.13, represents 100% of the final contract amount of `1,1951493.82. BACKGROUND: The subject project consisted of landscape axed irrigation improvements on both the perimeter landscaped areas and, median islands on the streets, and sidewalks within the parkway areas as noted below: * Tustin Ranch Road between Bryan Avenue and Irvine Boulevard - both perimeter areas and median islands. * Westerly side of Myford Road between Bryan Avenue and Irvine Boulevard - perimeter areas only. * Westerly side of Jamboree Road between Bryan Avenue and Irvine Boulevard - both the perimeter areas and median islands. * Southerly side of Irvine Boulevard between the westerly City limits (west of Tustin Ranch Road) and Jamboree Road - perimeter area only. * Easterly side of Browning Avenue between 350 and 1400 feet northerly of Bryan Avenue - perimeter landscaped area only. * Northerly side of Bryan Avenue between Browning Avenue and Jamboree Road - both perimeter areas and median islands. -Mhese improvements were funded by both The Irvine Company and Assessment istrict No. 85 -las follows: Agency The Irvine Co. JANUARY 29 1990 PAGE 2 DISCUSSION: These landscape, irrigation and sidewalk improvements have now been completed by the contractor, Tracey and Haigh Landscaping, Inc. of Rancho Santa Margarita, to the satisfaction of both The Irvine Company staff and the City's Public Works Department. The final contract amount for this project is $1,195,493.82 which represents a contract overrun of 42.1% over the original contract amount. Two thirds of this overrun or $237,735.00, was due to an increase of scope of the original project. This increase included the landscape irrigation and sidewalk improvements along the northerly side of Bryan Avenue between the Edison substation and Myford Road. This area was initially delayed, at the request of The Irvine Company, from the original contract so that the overall project would not be delayed. It is requested that the Tustin City Council pass and adopt the attached isolution accepting the works of improvement and authorizing the ._ecordation of the notice of completion for the landscape, irrigation, and sidewalk improvements along Tustin Ranch Road, Myford Road, Jamboree Road, Browning Avenue, Irvine Boulevard and Bryan Avenue. Bob Ledendecker Director of Public Works/City Engineer BL:mv Attach. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16' 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 90-23 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR LANDSCAPE, IRRIGATION AND SIDEWALK IMPROVEMENTS ALONG TUSTIN RANCH ROAD, MYFORD ROAD, JAMBOREE ROAD, BROWNING AVENUE IRVINE BOULEVARD AND BRYAN AVENUE WHEREAS, Tracey and Haigh Landscaping, Inc., having a contract with the City of Tustin to construct the hereinafter described public work and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the notice of completion and acceptance of said public work and improvement should be filled and payment of the balance due said contract authorized in accordance with the contract documents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement be, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: Landscape, irrigation and sidewalk improvements along Tustin Ranch Road between Bryan Avenue and Irvine Boulevard, Myford Road between Bryan Avenue and Irvine Boulevard, Jamboree Road between Bryan Avenue and Irvine Boulevard, Browning Avenue between 350 and 1400 feet northerly of Bryan Avenue, and Bryan Avenue between Browning Avenue and Jamboree Road AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin be, and is hereby authorized to execute and file a notice of completion and acceptance of said public work and improvement described herein as required by law. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin on February 5,_ 1990.
