SUBJECT: GREEN VALLEY BUILDING SETBACKS
RECOMMENDATION:
Pleasure of the City Council.
BACKGROUND:
At the December 41 1989 City Council meeting, staff agendized the
attached report dated 10-31-89 for City Council consideration and at
that time, Mr. Maughan requested additional time to contact the property
owners regarding a new alternative of sidewalk removal on Green Valley
Avenue.
Mr. Maughan also requested from the City a list of current Green Valley
Avenue property owners, their addresses and telephone numbers. This
'.st was mailed to Mr. Maughan on December 12, 1989.
Subsequent to the December 4, 1989 Council meeting, Mr. Maughan had
requested that a questionnaire -type letter on City letterhead be sent to
all property owners along Green Valley polling them on their thoughts
regarding the removal of the sidewalks along Green Valley Avenue.
The City Attorney's office was consulted on the possible removal of the
existing sidewalks along Green Valley Avenue as an issue of liability to
the City. It was their opinion that the removal of the sidewalks could
create an issue of liability which otherwise may not exist if the
sidewalks are kept. Additionally, the cost of defending against
lawsuits should be taken into consideration along with the potential for
a finding of liability.
DISCUSSION:
It appears that the relocation of the sidewalk (7.0 ft. wide as measured
from the curb face) adjacent to the curb would be the only viable
solution to provide the twenty -foot setback from the back edge of
sidewalk, except for the one residence located at 14331 Green Valley
Avenue. As indicated in the 10-31-89 memo, the sidewalk widths in this
area may be able to be reduced in width to provide the twenty -foot
setback.
The estimated cost of this sidewalk relocation is $39,800.00.

RECOMMENDATION:

BACKGROUND:
On August 21, 1989, Mr. Berklee A. Maughan presented four concerns to
the City Council of which one concern related to the substandard
building setbacks from sidewalk/street right-of-way line. These
setbacks vary in dimension from 13.4 feet to 15.5 feet. The majority of
the setbacks 'were measured at 15 -plus feet. The normal setback
dimension from face -of garage to sidewalk/street right-of-way is 20
feet.
e Green Valley resident's request was to have the City honor the
junty of Orange variance which would allow parked vehicles to encroach
within the, sidewalk area. The City Attorney's office has subsequently
issued a memorandum indicating that the City cannot honor the County
variance to allow encroachment within the street right-of-way (copy
attached).
An additional statement had been made by Mr. Maughan that the residents
had previously requested that the sidewalk be relocated adjacent to the
curb at the time of a previous sidewalk repair contract administered by
the City in Spring of 1981. At that time ten 1pcations along Green
,Valley were repaired. Budgeting at that time did not include any
sidewalk relocation due to the area having been recently annexed to the
City in December 1980.
DISCUSSION:
Staff has reviewed Green Valley Avenue with respect to relocating the
sidewalk adjacent to the curb and has surfaced the following
information:
1. Current parkway width (curb face to property line) is 12.0 feet.
2. A 4 -foot wide sidewalk exists two inches from the property line
with a landscaped area 7.33 feet wide between the back of curb
and sidewalk.
Three street lights exist on the westerly side of the street and are
located 2.5 feet behind face of curb.
4. Nineteen curbside mailboxes exist approximately 2.5 feet behind the
face of curb.

5. Eight trees, exist within the landscaped area between the curb and
sidewalk.
6. There are 20 driveways taking access to Green Valley Avenue. Four
driveways have a 20 -foot or greater garage setback the back of
sidewalk, fifteen have a 15.0 to 15.5 -foot garage setback from the
back of sidewalk, and one driveway has a 13.4 -foot setback from the
back of sidewalk.
In the event the sidewalk was to be relocated adjacent to the curb,
staff would suggest a 7 -foot wide sidewalk as measured from curbface.
This would provide a minimum of a 20 -foot setback for all driveways
except one. The driveway located at 14331 Green Valley Avenue would be
limited to an 18.4 -foot setback between garage and back of sidewalk.
The 7 -foot wide sidewalk would provide a clear area for pedestrian use
behind street lights and mailboxes of 4 feet. The sidewalk in front of
14331 Green Valley Avenue could possibly be reduced in width to 5.5 to
6.0 feet if there is no conflict with the mailbox location. The
dewalk adjacent to 14322,*' -14352, 14351 and'14341 could remain in its
_-esent location because of adequate setbacks. All driveway approaches
at the location of sidewalk relocation would also require removal and
replacement.
The estimated cost for the sidewalk relocation and drive apron
reconstruction,along Green Valley Avenue is $39,800.00. This work could
be funded either by general fund monies or by an Assessment District
wherein each property owner would fund the proportional share of work
and administrative cost related directly to their property. This
estimate is based upon preliminary plans and will require refinement
once construction level plans have been prepared.
