Pleasure of the Council.
BACKGRQUNP-
The President of the Tustin Historical Society, David Nisson, has
contacted the Community Services Department regarding the use of
the Senior Center for a general membership meeting on February 20,
1990. Mr. Nissan stated that the fees, particularly the refundable
deposit ($150), would be a hardship on the membership. Mr. Nisson
also indicated that he wished to hold all of their general
membership meetings at the Senior Center which would be five or six
a year.
The Council reviewed building rental policies in August, 1988,with
the adoption of the Senior Center Operating Plan and again in
October, 1989, when the fee schedule for the Senior Center was
adopted. Council policy directs that fees be charged to cover
costs f maintenance and operation of facilities. The Council Also
requires that groups using the facility provide insurance in the
amount of $1'llion naming the City as an additional insured.
Fees and insurnce requirements are normally not waived for non-
profit organizations requesting meeting space as they pay a much
lower rate than private groups. Attached is the application and
letter requesting a waiver of fees.
Current non-profit hourly rates at the Senior Center are $17 per
hour for a local non-profit group. The insurance cost for a
meeting is $77.33. The fee for use of the kitchen is $2 per hour.
The fiscal impact if Council waived the fees would be minimal, $116
per meeting or $580 per year. However, the Council may set a
precedent and other groups may request the same consideration
resulting in loss of revenue. If the Council wishes only to waive
the insurance requirement and cover the Historical Society under
the City's liability insurance the only charge would be for use
fees, $38 a meeting, plus the $150.00 refundable deposit. This
would provide some savings to the Historical Society.
In 1989, 37 percent of the building rentals were made by local non-

profit groups. This was the largest percentage of users, but had
the lowest percentage of costs recovered.
ALTERNATIVES
1. Waive all fees. 1 Cover the activity under City liability
umbrella. The fiscal impact loss of $38 revenue per meeting.
Advantages
Fiscal impact would be minimal.
Disadvantages
A precedent may be set. Other groups may come forward and
request the same consideration. The City would be risking
liability by covering this activity.
2. Waive insurance requirement. Charge the facility use fee and
refundable deposit.
Advantages
The cost of maintenance would be covered. If the building was
clean and not damaged, the refundable deposit would be
returned. This would provide some savings for the Historical
Society.
Disadvantages
The City's liability, though minimal with this type of
activity, would be at risk.
3. Refer back to the Parks and Recreation Commission. Direct the
Commission to review policies regarding fees and cost
recovery.
Advantages
The Parks and Recreation Commission is Council's advisory
group regarding policy matters.
Disadvantages
Only Council can make decisions regarding changes in policy.
This could add three to four months to the process. The
Historical Society's first meeting is scheduled for February

4. Enforce the policy by not waiving fees.
Advantages
Basic costs would be recovered as directed by Council policy.
The City's liability would not be risked.
Disadvantages
The Tustin Area Historical Society believes that the fee is
a hardship on the membership.
