Adopted Resolution Nos. RDA 03-10, 03-78, 03-79, and introduced Ordinance No. 1276. PUBLIC HEARING (ITEMS I THROUGH2) , JOINT CITY COUNCIL/REDEVELOPMENT AGENCY PUBLIC HEARING AND ADOPTION OF THE MCAS TUSTIN REDEVELOPMENT PLAN Mayor Worley opened the joint public hearing at 7:18 p.m. Pam Stoker, City Clerk, recalled the roll of the City Council and called the roll of the Tustin Redevelopment Agency. The following members of the audience spoke in support of adoption of the MCAS Tustin Redevelopment Plan. Don Wagner, South Orange County Community College District Tom Robershaw, 14782 Ridgeboro Place, Tustin, CA Donna Burt, Tustin Unified School District Dante Gumucio, Public Economics, Inc. There were no other speakers on the subject and the public statement portion of the joint .public hearing was closed. It was moved by Thomas, seconded by Davert, to adopt the following Resolution No. RDA 03-10: RESOLUTION NO. RDA 03-10 - A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN, CALIFORNIA, FINDING AND DETERMINING THAT THE USE OF MONIES FROM THE LOW AND MODERATE INCOME HOUSING FUND OUTSIDE THE BOUNDARIES OF THE MCAS TUSTIN REDEVELOPMENT PROJECT AREA WILL BENEFIT THE PROJECT AREA AND AUTHORIZING THE EXPENDITURE OF SUCH FUNDS. Motion carried 5-0. It was moved by Kawashima, seconded by Davert, to receive and approve by Minute Action, the Supplement to the Report to City Council for the MCAS-Tustin Redevelopment Plan. Motion carried 5-0. Assistant City Manager Christine Shingleton indicated that Resolution No. 03-81 was not needed, thus no action was required. Table consideration of Resolution No. 03-81: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING FINDINGS IN RESPONSE TO WRITTEN OBJECTIONS RECEIVED FROM AFFECTED TAXING ENTITIES OR PROPERTY OWNERS ON ADOPTION OF THE REDEVELOPMENT PLAN FOR THE MCAS-TUSTIN REDEV[--LOPMENT PROJECT. It was moved by Thomas, :seconded by Davert, to introduce and have first r~.~ading by title only of Ordinance No. 1276. ANNEXATION 158 Mayor Worley opened the public hearing at 7:50 p.m. The following member of the audience spoke in opposition to Annexation 158: Mary Kincaid, 13815 Grovesite Drive, Santa Ana There were no other speakers and the public hearing was closed. It was moved by Thomas, seconded by Kawashima, to adopt the following Resolution No. 03-75: RESOLUTION NO. 03-75- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING THE FINAL NEGATIVE DECLARATION AS ADEQUATE FOR ANNEXATION NO. 158 AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. Motion carried 5-0. It was moved by Thomas, seconded by Kawashima, to adopt the following Resolution No. 03-76: RESOLUTION NO. 03-76 --A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, MAKING APPLICATION TO AND REQUESTING THE LOCAL AGENCY FORMATION COMMISSION OF ORANGE COUNTY TO TAKE PROCEEDINGS PURSUANT TO THE CORTESE- KNOX-HERTZBERG LOCAL GOVERNMENT ORGANIZATION ACT OF 2000 FOR THE CITY OF TUSTI N TO ANNEX APPROXIMATELY 11.41 ACRES OF PROPERTY WITHIN ITS SPHERE OF INFLUENCE AND FILE ANNEXATION NO. 158. Motion carried 5-0. Approved CONSENT CALENDAR (ITEMS3THROUGH 11 ) Item No. 11 was removed from the Consent Calendar by Councilmember Davert. It was moved by Thomas, seconded by Bone, to approve the remainder of the Consent Calendar as recommended by staff. Motion carried 5-0. 3. APPROVAL OF MINUTES -- MAY 19, 2003 REGULAR MEETING Recommendation: Approve the City Council Minutes of May 19, 2003. Approved . APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $963,963.59 and ratify Payroll in the amount of $451,01 9.81. AWARD OF CONTRACT FOR CUSTODIAL SERVICES FROM JULY 1, 2003 THROUGH JUNE 30, 2004 WITH THE OPTION OF THREE, ONE- YEAR EXTENSIONS Recommendation: Award the Custodial Services Contract, for Fiscal Year 2003/2004 to Pacific Building Care, Inc., in the amount of $203,364.12, and authorize the Mayor and City Clerk to execute the contract documents on behalf of the City. APPROVAL OF AMENDMENT NO. 6 TO COOPERATIVE AGREEMENT NO. C-95-993 WITH ORANGE COUNTY TRANSPORTATION AUTHORITY FOR PROJECTS FUNDED BY MEASURE M Recommendation: Approve Amendment No. 6 to Cooperative Agreement No. C-95-993 with the Orange County Transportation Authority, and authorize the Mayor and City Clerk to execute the Agreement on behalf of the City. GASB 34 COMPLIANCE VALU~ATION SERVICES FINAL REPORT Recommendation: 1. Adopt the report entitled "Final Report, GASB 34 Compliance Valuation Services;:" 2. Adopt the recommended capitalization policy for capital and infrastructure assets~ at $100,000; 3. Adopt the capitalization policy for the City's fixed assets at $5,000 as recommc;nded by the City's Audit Committee; and 4. Adopt the useful life of infra:structure assets as recommended by the Consulta~nts and detailed on Page 8 of the report. Adopted Resolution No. 03-77 . REMOVED FROM CONSENT CALENDAR EXCLUSIVE AGREEMENT TO NEGOTIATE WITH VESTAR DEVELOPMENT II, LLC FOR THE TUSTIN LEGACY RETAIL SITE (PARCELS 10 AND 11) Christine Shingleton, Assistant City Manager, indicated that minor changes were made to agreement and requested Council approval. It was moved by Bone, seconded by Thomas, to approve the revised exclusive agreement with Vestar Development II, LLC. Motion carried 5-0. Adopted Ordinance No. 1271 REGULAR BUSINESS (ITEMS 12 THROUGH 14) 12. ORDINANCE NO. 1271 -- APPROVING CODE AMENDMENT 03-003 RELATING TO SECOND RESIDENTIAL UNITS It was moved by Thomas, seconded by Davert, to have second reading by title only and adoption of Ordinance No. 1271. Pamela Stoker, City Clerk, read the following Ordinance No. 1271 by title only: ORDINANCE NO. 1271 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADDING TUSTIN CITY CODE SECTIONS 9222.a.5 AND 9223.a.7; AMENDING SECTIONS 9224.b, 9225.a.2, 9226.a.1, and 9297; AND REPEALING TUSTIN CITY CODE SECTIONS 9222.b.3, 9222.b.4, 9223.b.1, 9226.b.6, AND 9226.b.7 RELATING TO SECOND RESIDENTIAL UNITS. Motion carried 5-0 (roll call vote). Budget workshop set for June 16, 2003 at 5:30 pm 13. FISCAL YEAR 2003-04 BUDGET WORKSHOP Council unanimously concurred to schedule a workshop to review the budget for Fiscal Year 2003-04 on June 16, 2003 at 5:30 p.m. Adopted Resolution No. 03-73 14. FINAL PARCEL MAP 2002-106 It was moved by Davert, seconded by Kawashima, to adopt the following Resolution No. 03-73: Minutes - City Council June 2, 2003 - Page 6 RESOLUTION NO. 03-73 --A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL PARCEL MAP 2002-106 TO SUBDIVIDE A 1.62 ACRE PARCEL CURRENTLY DEVELOPED WITH A CAR WASH, CONVENIENCE STORE, AND FUELING STATION CANOPY AND A RETAIL BUILDING INTO TWO (2) PARCELS FOR CONVEYANCE PURPOSES. Motion carried 5-0. None SECOND PUBLIC INPUT OTHER BUSINESS CHILI COOK-OFF Council thanked staff and the Parks and Recreation Commissioners for making the Chili Cook-off a successful event. JOHN LAING HOMES Council commented on their attendance at the MCAS Tustin groundbreaking for the John Laing Homes project; the first residential project was now under construction; and it was an exciting event. TENNIS TOURNAMENT Councilmember Davert congratulated Mayor Worley on reaching the finals in a local tennis tournament. TUSTIN UNIFIED SCHOOL DISTRICT Councilmember Davert inquired on the status of a joint, m(:.;eting with the Tustin Unified School District and the City Council. Bill Huston, City Manager, indicated that staff was currently working on framing the issues for Council and would be providing more information ¢.0 Council at a later date. WATER YARD Councilmember Bone asked staff if the spouts at the water yard h~:]d been turned off during the recent street fair. Tim Serlet, City Engineer replied they were having operational issues and the contractor would be looking into the problem. WAR MUSEUM Councilmember Bone stated that the County Veterans Affairs organization was considering building a war museum at the MCAS Tustin. MAN AND WOMAN OF THE YEAR Mayor Worley and Councilmember Bone congratulated the Man ,and Woman of the Year, Don Shubin and Mary Hill. SENATE BILL 100 Councilmember Bone reported that Senator Joseph Dunn was s oonsoring Senate Bill 100 which would extend retirement benefits to 100°1;,. WIRELESS A, NTENNA Councilmember Thomas commented on future discussions for wireless antenna sites within the City. TUSTIN LITTLE LEAGUE Mayor Pro Tem Kawashima remarked Councilmembers Davert and Thomas at ceremonies- the event was well attended. on his attendance as well as the Tustin Little League closing TUSTIN POLICE DEPARTMENT Mayor Pro Tem Kawashima announced the Police Department's Open House would be held on June 14, 2003. CONCERTS IN THE PARK Mayor Pro Tern Kawashima mentioned the Concerts in the Park events would be starting soon; ,and added that a karaoke contest had been added to this year's schedule of events. FOURTH OF JULY Mayor Pro Tem Kawashima announced the upcoming Fourth of July fireworks show at Tustin High School and the Tustin Meadows Parade. TUSTIN HIGH SCHOOL Mayor Pro Tem Kawashima commented that Tustin High School was considering building a new school at MCAS Tustin. STATE OF THE CITY Mayor Worley announced that the State of the City event would be held on June 13, 2003. COMMITTEE REPORTS ORANGE COUNTY SANITATION DISTRICT Mayor Pro Tem Kawashima reported the Orange County Sanitation Board voted to raise sanitation rates 15% instead of the proposed 20% increase. ADJOURNMENT- Mayor Worley adjourned the meeting at 8:15 p.m. The City Council scheduled a budget workshop on June 16, 2003 at 5:30 p.m. in the Clifton C. Miller Community Center and the next regular meeting of the City Council was scheduled for Monday, June 16, at 7:00 p.m. in the Council Chamber at 300 Centennial Way.
