Commissioner Rasparian moved, Le Jeune seconded to approve Design
Review 89-83 by adopting Resolution No. 2746, revised as follows:
Page 1, 1.1: remove "also" from line 8, and 11to bell from line
10.
Page 1, 1.3: add "all building permits" after "unless".
Page 3 is a duplicate and should be removed and the remainder
subsequently renumbered.
Page 5, 6.1: remove "is required" from line 7 of paragraph 2.
STAFF CONCERNS
7. Report on Actions taken at January 15, 1990 City Council
meeting.
Presentation: Christine Shingleton, Director of Community
Development
COMMISSION CONCERNS
Commissioner Baker asked if Carl's Jr. appealed the decision of the
last meeting regarding their pole sign request.
The Director replied that they had appealed. However, the new
request was substantially revised and should come before the
Commission again before going on to the City Council.
Commissioner Shaheen expressed his concern about the Community
development of the City, especially the downtown area. He asked
if there was a way to modify that area now.
The Director replied that as part of a program over the next 12
months, the Cultural Resources Advisory Committee will be looking
at developing to maximize opportunities in Old Town. One
alternative is mixed-use, but there is a high degree of sensitivity
to retain the R-1 district.
Commissioner Le Jeune asked about the expansion of the Health Care
Medical Center at Newport and Sycamore.
Staff replied that with the Conditional Use Permit that was
granted, they have one (1) year to make progress, but nothing has
occurred to date.
The Director noted that they may be having financial problems, and
that they may be making a decision in the next thirty (30) days to
sell the property.

Commissioner Le Jeune asked if there was an enforceable dish
ordinance, and any current properties were under code enforcement;
noted that he felt that the staff should review the blinking lights
issue around the City at night; asked if the center at Newport and
Walnut would be authorized to have different colored curb striping;
that there seems to be a significant lack of enforcement of the
two-hour parking requirement along B Street.
The Director replied that there are some dish violations under code
enforcement at present, and that the court found the City's
requirements to be valid; that seasonal -style blinking lights and
small neon signs inside the building were permitted as long as they
do not exceed the approved square footage; that the parking code
does not specify that all striping be the same at one center; and
that they would look into the parking problem along B Street.
Commissioner Rasparian noted a sign that was in disrepair at the
corner of Newport and Irvine Blvd; reiterated that he felt that
the red -lining of the curb in front of San Remo's Market should be
done independently of the construction; and asked about the status
of the Sign Code.
The Director replied that it would be referred to code enforcement;
that the contractor had to have the curb red -lined before the City
would issue a Certificate of Occupancy, but after the determination
of intersection obstruction. She noted that she would draft a memo
to Public Works for an update; and that there would be a status
update at the next meeting regarding the Sign Code.
Commissioner Baker asked if the construction site at Newport and
Bryan has ceased; and asked if there was any problem with toxic
leakage at the site.
Staff replied that it is finishing the Plan Check process and has
to wait for construction plans to be approved before it can
continue with the precise grading; and discussed the status of the
Newport/Bryan site and the Newport/E1 Camino site.
ADJOURNMENT
At 7:47, Commissioner Pontious moved, Shaheen seconded to adjourn
to the next regular scheduled meeting of the Tustin Planning
Commission on February 12, 1990 at 7:00 p.m. in the City Council
Chambers, 300 Centennial Way, Tustin, California. Motion carried
5-0.
