APPROVAL OF Moved by Miller, seconded by Coco, that minutes of MINUTES October 2, 1967 regular meeting be.approved as mailed. Carried. Moved by Miller, seconded by Klingelhofer, that minutes of October 11, 1967 regular adjourned meeting be approved. Motion carried. Councilman Coco abstained. VI. PUBLIC 1. AMENDMENT TO LEASE - BOYS' CLUB OF TUSTIN HEARINGS Hearing opened at 7:35 P.M. Mr. Herbert Watson, Executive Director of the Boys' Club of Tustin, stated that Mr. VerLyn Jensen, President, had been detained in San Francisco and requested a two week continuance. Moved by Miller, seconded by Coco, that the hearing on the amendment to Boys' Club of Tustin lease be continued to the meeting of November 6th. Carried. BEAUTIFICATION AWARD Mayor pro tem Klingelhofer spoke on the formation of the Tustin Beautification Committee which is a joint City-Chamber of Commerce approved project. Awards are to be made quarterly and a trophy will be awarded annually. These awards are to be pre- sented in two categories - New Development and Existing Structures. Mayor pro tem Klingelhofer presented the first award for Outstanding Achievement - Existing Structure to John Jamieson, and Lee and Harry Wagner for Lee's Lamp Shop at the corner of Main and "D" Streets. PROPOSED ORDINANCE NO. 372 AMENDING ORDINANCE NO. 157, ZONING ORDINANCE RELATING TO DAY NURSERIES AND NURSERY SCHOOLS. Hearing opened at 7:42 P.M. There being no comments or objections, the hearing was declared closed at 7:43 P.M. Moved bV Miller, seconded by Coco, that the hearinq be continued to November 6th meeting pending further information lfrom the staff. Carried. 3. APPOINTMENT OF PLANNING COMMISSIONER - TERM OF NOVEMBER 18, 1967 THROUGH DECEMBER 31, 1971. Hearing opened at 7:46 P.M~ Mayor pro tem Klinqelhofer asked if there were any further applications. Mrs. Lee Wagner of 17331 Jacaranda, Tustin, requested consideration for this vacancy. Mrs~ Wagner stated that she has operated a business in the City'.for six years; that she has lived within the City for three years; that she has always taken an active part in City functions and is vitally interested in Tustin's future. Mrs. Eleanor Jacobson of 15501 Village Drive, restated her reasons for her application as set forth in her original request of April 26, 1967. Mayor pro temKlingelhofer announced the following applications on file for this vacancy: Roger McCune Lowell Dukleth Howard Larnard Don Combs Mr. Don Combs stated his concern for the future growth of Tustin and his desire to participate in this growth. There being no further comments and no objections, the hearing was declared closed. Moved by Coco, seconded by Miller, that Mr. Howard Larnard be appointed to serve on the Planning Commission for the term of November 18, 1967 through December 31, 1971. Motion carried unanimously. Councilman Coco stated that he was pleased with the quality of.the applicants and hoped that all the applicants would keep their letters on file for future consideration. REQUEST OF TUSTIN POLICE DEPARTMENT EXPLORER BUSINESS POST NO. 811 - for permission to paint house numbers on City curbs Explorer Post No. 811 Captain John Dic~ submitted the Post proposal to-the Council and explained the method of solicitation, type of paint to be used, etc. Councilman Miller.s~ated that the Council was con- cerned with the method of soliciting funds, and that he wanted the best impression possible for the Post. He suggested that a trial block be con- tacked to see just what the reception would be. Officer James Hein, Senior Advisor of the Post, spoke on behalf of the Explorers and stated that they were willing to send information flyers in advance .and that each resident will be contacted by a uniformed Explorer. M~or pro tem Klingelhofer felt that each resident should be contacted first and informed that this is a City authorized project and what the donations are to be used for. Moved by Miller, seconded by Coco, that the Council grant permission to the Explorer Post to paint ~use numbers on curbs for identification purposes in accordance with specifications of the Public Works Department. Carried. 2. ORDINANCE NO. 368 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, REZONING PROPERTY ON APPLICATION NO. ZC-67-159 OF SIEGEL. Moved by Miller, seconded by Coco, that Ordinance No. 368 have second reading by title only. Carried unanimously. Moved by Coco, seconded by Miller, that Ordinance No. 368, rezoning property on Application No. ZC-67-t59 of Siegel, be passed and adopted. Carried by roll call. Ayes: Klingelhofer, Coco, Miller. Noes: None. Absent: Mack, Ring. 3. ORDINANCE NO. 369 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, PREZONING PROPERTY ON APPLICATION PZ-67-105. Moved by Coco, seconded by Miller, that Ordinance No. 369 have second readinq by title only. Carried unanimously. ORDINANCE NO. 370 AN ORDINANCE OF THE CITY OF TUSTIN ADOPTING THE TUSTIN TRAFFIC ORDINANCE REGULATING THE USE OF AND TRAFFIC UPON THE STREETS, SIDEWALKS, AND OTHER PUBLIC AND PRIVATE PLACES IN THE CITY, AND THE USE, PARKING AND CONTROL OF VEHICLES THEREON, AND REPEALING ORDINANCE NO. 328 AND ALL ORDINANCE AMENDATORY THEREOF, AND ADOPTING. BY REFERENCE THE 1964 EDITION OF THE UNIFORM TRAFFIC QRDINANCE OF THE LEAGUE OF CALIFORNIA CITIES. Councilman Miller stated he would like a clari- fication on the section pertaining to bicycle licensing as to yearly renewal and Section 3416 requiring a license except for those bicycles owned and operated by non-residents of the City which are regularly and duly licensed by any other municipality. He questioned whether this included or excluded County residents. Moved by Miller, seconded by Coco, that the second reading of this Ordinance be deferred until the November 6th meeting when the Chief of Police can be present. Carried. 5. ORDINANCE NO. 371 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING SPECIAL SPEED ZONES, THROUGH STREETS, PLACEMENT OF STOP SIGNS AND DESIGNATION OF GRADE CROSSINGS, ETC. Moved by Miller, seconded by Coco, that Ordinance No. 371 have second reading by title only. Carried unanimously. RESOLUTION NO. 902 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, OPPOSING THE PRINCIPLE OF FEDERAL TAX SHARING. Councilman Miller explained the context of this Resolution, stating that it is the feeling of the Council that taxes should be levied at different levels of government 'for their own use and not by the Federal government and returned to Counties and Cities an the form ofgrant-in-aid programs. Moved by COCo, seconded by Miller, that Resolution No. 902 be r.ead.by title only. Carried unanimously. Moved by Miller, seconded by Coco, that Resolution No. 904 be read by title only. Carried ~nanimously. Absent: Mack, Ring.. ,! 8. APPOINTMENT OF PARKS AND RECREATION COMMISSIONER - Term to expire December 31, 1969. Mayor pro tem Klin~elho~er announced the following applicants on file for this vacancy: George Ritsi Howard Larnard Richard Edgar Don Combs Lowell Dukleth Councilman Coco stated th=at once again there was an outstanding li~t of qualified applicants and again one who has shown tenacity and interest in serving his City. Moved by Coco,'seconded-by Miller, that George Ritsi be appointed to fill the vacancy. on the Parks and · Recreation Commission for the term of November 2, 1967 through December 31, 1969. Hotion carried unanimously. Councilman Coco read the following excerpt from Mr. Ed Bering's letter of resignation: "Mr. Quentin Fleming is to be particularly commended for his unstinting efforts and energetic leadership as Chairman of the Commission. It is his creative thinking that has been responsible for many of the Commission's accomplishments". Counciiman, Coco further=stated that this was quite a tribute to Mr. Fleming, and he is to be congratulated. Upon request of Councilman Miller, the City Attorney was directed to draft a Resolution of commendation for Mr. Bering to be presented at the next Council meeting. VIII. NEW 1. BEAUTIFICATION AWARD ·BUSINESS Presented earlier on the agenda. Council Minutes 10/16/67 Pg. 6 2. APPROVAL OF SOIL TEST - Civic Center Site Moved by Miller, seconded by Coco, that a Foundations Investigation Report be obtained 'at a cost not to exceed $650.00. The Council noted that the only comments to date regarding the Civic Center have been letters of ' approval from the Chamber of Commerce and from Quentin Fleming, and the editorial in the Tustin News° Mayor pro tem Klingelhofer sclicited comments and stated that formal communications would be appreci- ated. Councilman Miller stated that in his oplmlon'the. purchase of this proposed site is a way of saving money in the future. This is an excellent price and it would be foolish not to acquire the land at this time and future land prices would be out of sight. Above motion carried. 3. MODIFICATION OF STANDARD SUBDIVISION POLICY Request for a 4 foot sidewalk on Red Hill Avenue within Tustin Meadows project (east side of Red Hill between Walnut and A.T.& S.F. Railroad). Mr. Whe&lock, Director of Public Works, explained this request for a 4 foot sidewalk along a block wall on Red Hill Avenue and the fact that the Homeowners' Association would maintain the land- scaped portion of the'parkway. Mr. Uheelock said he did not feel this request to be detrimental nor would it be in any future requests with the same stipulation for maintenance. In answer to questioning, Mr. Rourke stated that the City could have an agreement with the developer to assure this maintenance. Moved by Miller, seconded by Coco, that the request be granted subject to receipt of an agreement for maintenance of parkway acceptable to the City Attorney and City Administrator. Carried. 4. ORDINANCE NO. 373 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE TUSTIN CITY CODE RELATIVE TO LICENSING OF ENTERTAINERS. Mr. Rourke explained that the existing Ordinance covers the licensing of the owner of an establish- ment with entertainment. This Ordinance adds that each individual entertainer must obtain a permit before performing in the City. It is more effective to have the individual licensed and it is an aid to the Police Department. He pointed out that this is not a revenue measure. The $5.00 fee covers only the cost involved. Moved by Miller, seconded by Coco, that Ordinance No. 373, relative to licensing oi entertainers have first reading by title only. Carried unanimously. Council Minutes 10/16/67 Pg. 7 5. APPROVAL OF DEMANDS Moved by Coco, seconded by Miller, that demand. s in the amount of $56,897.95 be paid. Carried. IX. OTHER 1. CITY ADMINISTRATOR BUSINESS 1). Orange County Flood Control Correspondenc~ Councilman Coco explained the substance of the letter in answer to correspondence from the Orange County Flood Control District to the County Planning Commission relative to the drainage problems in the southern area. Moved by Coco, seconded by Klingelhofer, that the Council authorize the sending of the proposed letter to the Chief Engineer of the Flood Control District. After a discussion by the Council regarding reasons for a strong letter and the necessity for a letter at this time, it was suggested that this matter be deferred awaiting a full Council. Above motion failed. Councilmen Klingelhofer and Miller voting no. 2. CITY ATTORNEY None X. INFORMATION Following correspondence received: AND CORRESPONDENCE 1. Correspondence relative to Blanket Fidelity Bond referred to City Administrator. 2. Resolution regarding voiding of traffic citations from Grand Jury and related report on Tustin Police Department procedures on traffic citations - H. Gill 3. U.S. Senate Bill 1306 Bank of America. Council directed that further information be made available at the next Council meeting. 4. Civic Center Comments - Quentin Fleming, Tustin Chamber of Commerce, and Tustin News Editorial. 5. Quarterly Report - TuStin Chamber of Commerce. The Council complimented Mr. Waitman, Mr. Barletta and the Chamber on their thorough and compre- hensive report. 6. Resolution relative to Labor Code - Tustin Chamber of Commerce. 7. Letter of Appreciation - Congressman Utt 8. 73rd National Conference on Government - National [,iunicipal League. CITY COUNCIL BUSINESS 1) Report on Revised Criteria for Planning Commission Appointment Councilman Coco reported that he had met with the Chamber of Commerce sub-committee on this matter and that a tentative draft will be presented to the Chamber in the near future. 2) Dralnage and Gutter Problems In answer to questioning by the Council, Mr. Wheetock stated that they are now sweeping problem areas twice a week.
