This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk's office for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the books located at the Police Department, Tustin Library and, on the evening of the meeting, at the rear of the Council Chambers. Listening devices for the hearing impaired are available upon request from the City Clerk. RECOVERY OF CITY INCURRED COSTS OF THE ABATEMENT OF A PUBLIC NUISANCE LOCATED AT 170 EL CAMINO REAL On February 21, 1989, the City Council adopted Resolution No. 89- 25 declaring the property located at 170 E1 Camino Real a "public nuisance" and required performance of certain work that included clearance of the property and securing of the structure. Recommendation: Adopt the following Resolution No. 90-20 approving a special assessment of three thousand seven hundred twenty-five dollars and forty-three cents ($3,725.43) as recommended by the Community Development Department: RESOLUTION NO. 90-20 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ASSESSING THE PROPERTY LOCATED AT 170 EL CAMINO REAL FOR THE COST INCURRED BY THE CITY FOR THE ABATEMENT OF DANGEROUS BUILDINGS CITY COUNCIL AGENDA PAGE 1 FEBRUARY 20, 1990 2. ANNEXAV 149 - NEWPORT AVENUE/WAS i TO THE CITY OF TUSTIN Annexation 149 was initiated by the City Council on September 5, 1989 in response to property owners in the subject area. Recommendation by the Community Development Department: 1. Open protest hearing. 2. Summarize the determination made by LAFCOIs Resolution No. 89- 63. 3. Receive and file written protests from property owners. 4. Accept public testimony. 5. Inquire if anyone else wishes to submit a written protest or to withdraw a protest previously filed. 6. Close the Public Hearing (or continue the Public Hearing to the next meeting if the Council desires). 7. Direct staff to certify the value of written protests on February 20th or report back at the City Council's March 5, 1990 meeting. 8. Either adopt the following Resolution No. 90-25 approving Annexation 149, or direct staff to return on March 5, 1990 with an appropriate resolution: RESOLUTION NO. 90-25 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ORDERING TERRITORY DESIGNATED AS "ANNEXATION 149 - NEWPORT/WARREN" BE ANNEXED TO THE CITY OF TUSTIN VTI. PUBLIC INPUT (At this time members of the public may address the City Council regarding any items not on the agenda within the subject matter jurisdiction of the City Council provided that NO action may be taken on off -agenda items unless authorized by law.) VIII. CONSENT CALENDAR All matters listed under Consent Calendar are considered routine and will be enacted by one motion. There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. 1. APPROVAL OF MINUTES - FEBRUARY 5, 1990, REGULAR MEETING 2. APPROVAL OF DEMANDS IN THE AMOUNT OF $2,1771478.16 RATIFICATION OF PAYROLL IN THE AMOUNT OF $227,646.16 3. RESOLUTION NO. 90-26 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING VOTING PRECINCTS AND POLLING PLACES, APPOINTING PRECINCT BOARD MEMBERS AND FIXING COMPENSATION FOR THE GENERAL MUNICIPAL ELECTION ON TUESDAY, APRIL 10, 1990, CALLED BY RESOLUTION NO. 89-176 OF THE CITY COUNCIL Adopt Resolution No. 90-26 establishing precincts, polling places, precinct board members and compensations for the April 10, 1990 General Municipal Election as recommended by the City Clerk's Office. CITY COUNCIL AGENDA :'AGE 2 FEBRUARY 20, 1990 4. MID -YEA: (QUEST FOR NEW POSITION, TEA METER READING/CUSTOMER SERVICE boPERVISOR Approve a new position in the Water Enterprise to be at the same level as a Maintenance Supervisor but to be titled Customer Service Supervisor and approve a supplemental appropriation from the unappropriated reserves of the Water Enterprise in the amount of $40,500 to fund this position for the balance of the current fiscal year as recommended by the Finance Department. S. RESOLUTION NO. 90-32 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE DESTRUCTION OF CERTAIN CITY RECORDS, DOCUMENTS AND PAPERS IN THE POSSESSION OF THE POLICE DEPARTMENT OF THE CITY OF TUSTIN NO LONGER REQUIRED FOR THE CONDUCT OF CITY BUSINESS PURSUANT TO THE AUTHORITY GRANTED BY SECTIONS 34090, 34090.5 AND 34090.7 OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA Adopt Resolution No. 90-32 allowing the destruction of selected records, documents and papers as allowed by law as recommended by the Police Department. 6. RESOLUTION NO. 90-30 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, RELATING TO THE COMPENSATION OF PART- TIME EMPLOYEES OF THE CITY OF TUSTIN Adopt Resolution No. 90-30 adjusting part-time salaries as recommended by the Administrative Services Department. 7. RESOLUTION NO. 90-29 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING THE DESTRUCTION OF CERTAIN RECORDS Adopt Resolution No. 90-29 allowing for destruction of applications and testing materials for recruitments which have been closed for over two years as recommended by the Administrative Services Department. S. 1990 L.P. REPERTORY AGREEMENT Approve 1990 agreement with L.P. Repertory and authorize staff to execute same as recommended by the Community Services Department. 9. RESOLUTION NO. 90-27 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, IMPLEMENTING AB 4680 REGARDING THE MODEL FILMING PERMIT PROCESS Approve the Model Filming Permit Process as submitted by the California Film Commission and revised by the Community Development Department by adoption of Resolution No. 90-27, as submitted or revised, as recommended by the Community Development Department. 10. AB 939 - COUNTYWIDE WASTE MANAGEMENT TASK FORCE Approve designation of the Orange County Waste Management Commission as the countywide task force required by AB 939 as recommended by the City Manager. 11. RESOLUTION NO. 90-33 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE CLASSIFICATION PLAN Adopt Resolution No. 90-33 amending the Classification Plan of the City of Tustin to include the management position of Resident Project Engineer; approve compensation of Resident CITY COUNCIL AGENDA PAGE 3 FEBRUARY 20, 1990 Project jineer at $65.77 per h( and authorize an annual increase -o equal the Consumer Price .index as recommended by the Administrative Services Department. 12. ACCEPTANCE OF PUBLIC IMPROVEMENTS AND RELEASE OF BONDS FOR TRACT NO. 13053 Accept the public improvements within Tract No. 13053 and authorize the release of the following bonds in the indicated amounts: Faithful Performance Bond No. 1253 - $888,200.00; Labor and Materials Bond No. 1253 - $444,100.00; and Monumentation Bond No. 1254 - $18,000.00 as recommended by the Public Works Department/Engineering Division. 13. RESOLUTION NO. 90-34 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR MAIN STREET RECONSTRUCTION - OCUTT PHASE III, PACIFIC STREET TO ROUTE 55 Adopt Resolution No. 90-34 accepting said work and authorizing the recordation of the Notice of Completion as recommended by the Public Works Department/Engineering Division. 14. RESOLUTION NO. 90-31 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, RELATING TO THE COMPENSATION OF CONFIDENTIAL EMPLOYEES Adopt Resolution No. 90-31 relating to the compensation of Confidential employees as recommended by the Administrative Services Department. 15. AGREEMENT REGARDING ASSIGNMENT OF RIGHTS AND DELEGATION OF OBLIGATIONS - LAURELWOOD R.V. STORAGE AREA RECONSTRUCTION Approve and authorize the Mayor and City Clerk to execute subject agreement as recommended by the Public Works Department/Engineering Division. IX. ORDINANCES FOR INTRODUCTION - NONE X. ORDINANCES FOR ADOPTION - NONE XI. OLD BUSINESS 1. STATUS REPORT - JOHN WAYNE AIRPORT NOISE MONITORING PROGRAM (JWA) , COALITION FOR A RESPONSIBLE AIRPORT SOLUTION (ORAS), AIRPORT SITE COALITION (ASC) AND HELICOPTER OVERFLIGHT PROGRAM TASK FORCE (HOPTF ) Update on the John Wayne Airport Noise Monitoring Program (JWA), Coalition for a Responsible Airport Solution (CRAS), Airport Site Coalition (ASC) and Helicopter Overflight Program Task Force (HOPTF) . Recommendation: Receive and file subject report as recommended by the Community Development Department. -- XII. NEW BUSINESS 1. ORANGE COUNTY EMERGENCY SERVICES FEES Councilman Prescott has requested that this matter regarding chargesfor emergency services be placed on the agenda for discussion. WAIVER OF CONDITIONAL USE PERMIT FEES FOR NURSERIES OR NURSERY SCHOOL (CHILD CARE CENTERS) At the meeting of February 5, 1990, Councilman Prescott requested that staff investigate the feasibility of waiving conditional use permit fees associated with child care centers. Mayor Edgar also directed staff to investigate ways for the City to be aggressive in attracting child care operators to the City. Recommendation: Adopt the following Resolution No. 90-35 exempting Day Nurseries or Nursery Schools from a Conditional Use Permit Fee as recommended by the Community Development Department: RESOLUTION NO. 90-35 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, MODIFYING THE CITY'S PLANNING FEES TO EXEMPT DAY NURSERIES/NURSERY SCHOOLS FROM PAYMENT OF CONDITIONAL USE PERMIT FEES 3. AWARD OF CONTRACT FOR TRAFFIC SIGNAL IMPROVEMENTS AT MAIN AND STONEGLASS, MAIN AND EL CAMINO REAL, AND WALNUT AND FRANKLIN Bids were opened February 13, 1990 for subject project and the low bid by Intersection Maintenance Service was 3.3% under the Engineer's estimate of $150,100.00. Recommendation: Award the contract for the subject project to Intersection Maintenance Service in the amount of $145,000.00 as recommended by the Public Works Department/Engineering Division. 4. RELOCATION OF SEWER PUMP STATION NO. 6168(R) AND CONSTRUCTION OF FORCEMAIN AND GRAVITY SEWER FOR JAMBOREE ROAD EXTENSION Bids for subject project were opened on February 15, 1990. The low bid by S.C. Engineering is 14.7% below the Engineer's estimate of $425,000. Recommendation: Award the contract for the subject project to S. C. Engineering in the amount of $362,370.50 as recommended by the Public Works Department/Engineering Division. 5. AB 929 MANDATORY RECYCLING On October 30, 1989, Assembly Bill (AB) 939 was chaptered into law restructuring the California solid waste management program in California and impacting the way cities and counties must address solid waste issues in the future. Recommendation: Receive and file subject report as recommended by the Public Works Department/Administrative Division. 6. LEGAL FEES (JOHN KELLY AND EARL PRESCOTT VS. RONALD HOESTEREY) Councilman Kelly requested this matter be placed on the agenda. Recommendation: Pleasure of the City Council. CITY COUNCIL AGENDA PAGE 5 FEBRUARY 20, 1990 7. INITIAT: OF ZONE CHANGE PROCEDURI 'OR ANNEXATION 149 In previous public hearings on Annexation 149, the City has committed to rezoning the subject area to be consistent with the North Tustin Specific Plan. Recommendation: Instruct staff to initiate zoning of Annexation 149 to maintain consistency with the North Tustin Specific Plan as recommended by the Community Development Department. XIII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA FEBRUARY 12, 1990 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of February 12, 1990. 2. KEY INTERSECTION ACCIDENT SURVEILLANCE A recent memo from the City's Consulting Traffic Engineer provided information to the Council as to the monitoring of 16 intersections in the City. The Council expressed interest in the information and requested a more detailed list. CLOSED SESSION The City Council will recess to Closed Session to meet with its designated representatives regarding labor relations matters pursuant to Government Code Section 54967.6; and to consider personnel matters pursuant to Government Code Section 54957.
