SUBJECT: FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS - MAIN STREET RECONSTRUCTION
OCUTT PHASE III, PACIFIC STREET TO ROUTE 55 (PROJECT #700089)
RECOMMENDATION:
That the City Council at their meeting of February 20, 1990 adopt the attached
resolution accepting said work and authorizing the recordation of the Notice of
Completion.
Assuming no claims or stop payment notices are filed, it is further recommended
that 30 days after the date of recordation of the notice of completion, that
the Council authorize payment of the final 10% retention amount of $19,296.19.
This amount, together with previous payments of $173,665.72, represents 100% of
the final contact amount.
BACKGROUND:
This project encompassed the reconstruction of the street pavement section on
Main Street from Pacific Street (south) to the Route 55 overpass. Originally
included in this project was the construction of new cross gutter, curb returns
and wheelchair ramps at the intersection of Main Street and Pacific Street
(north), and the replacement of curb and gutter and the installation of street
light conduit at various locations.
Construction of new cross gutter, curb returns, wheelchair ramps, a catch basin
and a short length of storm drain at the intersection of Main Street and Myrtle
Avenue, as well as, additional replacement of curb and gutter were added to
mitigate drainage problems. OCUTT funding has been increased from $74,473 to
$92,410 for this project due to the added work.
The work has been completed to the satisfaction of the Engineering Division.
The final contract amount is $192,961.91. This represents an overrun of 24.7
percent, from the original contract amount of $154,771.10, which reflects the
additional drainage mitigation measures.

RESOLUTION NO. 90-34
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF TUSTIN, CALIFORNIA,
ACCEPTING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE
OF COMPLETION FOR MAIN STREET
RECONSTRUCTION - OCUTT PHASE III,
PACIFIC STREET TO ROUTE 55
WHEREAS, Vernon Paving Company, with the City of Tustin to
construct the hereinafter described public work and improvement;
and
WHEREAS, the City Engineer has duly certified to the
construction and completion of said public improvements
hereinafter mentioned in a manner satisfactory to the City Council
of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has
completed said public improvement hereinafter more particularly
described in accordance with the provisions of the contact
documents and the notice of completion, and acceptance of said
public work and improvement should be filed and payment of the
balance due said contract authorized in accordance with the
contract documents.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
of Tustin that said public work and improvement be, and the same
is hereby accepted. Said public work and improvement is more
particularly described as follows:
MAIN STREET RECONSTRUCTION - OCUTT Phase III,
Pacific Street to Route 55, Project No. 700089
AND BE IT FURTHER RESOLVED that the City Engineer of the City
of Tustin be and is hereby authorized to execute and file a notice
of completion and acceptance of said public work and improvement
described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council
of the City of Tustin on the 20th day of February, 1990.
