That the City Council adopt Resolution No. 90-31 relating to the
compensation of Confidential employees.
BACKGROUND:
As Council is aware, last month the City and T.M.E.A. came to an
agreement regarding compensation and benefits. It is customary to
increase Confidential employees' salaries equal to increases given
general employees. The attached Resolution accomplishes this. In
addition, since the Confidential employees are unrepresented, it
has been the City's practice to ensure that their salaries are
increased retroactive to January 1, 1990. This Resolution provides
for that, and it will ensure recruitment and retention of our
valuable Confidential employees.

RESOLUTION NO. 90-31
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, RELATING TO THE COMPENSATION
OF CONFIDENTIAL EMPLOYEES
WHEREAS, the City now desires to provide increases
in compensation to its employees and modifications of certain
benefits as a result of conference with respective Department
Heads and subsequent to recommendations of the City Manager.
NOW, THEREFORE, the City Council of the City of
Tustin, California, does hereby resolve as follows:
Section 1. Compensation Provisions: Effective
January 1, 1990, existing salary of all Confidential employees
shall be increased as reflected on the attached salary
schedule.
Effective July 1, 1990, Confidential employees shall receive
a one percent increase in base salary.
Effective March 1, 1991, Confidential employees shall receive
a salary increase to bring employees to the median total
compensation. Median total compensation shall be determined
using January 1, 1991, data from the Orange County division
of the League of California Cities Salary and Benefits Survey.
Total compensation shall be determined using the same
methodology and survey cities as parties utilized in arriving
at total compensation median for the T.M.E.A. City of Tustin
January 1, 1990, Meet and Confer process. Each Confidential
employee shall receive a minimum of four percent increase in
base salary.
Pursuant to Article 2, Section 3, paragraph 2, of the current
Tustin Municipal Employees Association Memorandum of
Understanding, T.M.E.A. members will vote regarding whether
to defer two percent of March 1, 1991, salary increase to
apply to medical premiums. Whatever is determined by the
T.M.E.A. vote will also apply to Confidential employees.
Effective March 1, 1992, Confidential employees shall receive
a salary increase to bring employees to the median total
compensation. Median total compensation shall be determined
using January 1, 1992, data from the Orange County division

Section 2. Retirement: Effective December 24,
1984, the City shall pay seven percent of the employee's
portion of the Public Employees Retirement System
contribution.
Effective December 31, 1992, the City shall amend its contract
with the Public Employees Retirement System to provide single
highest year for Confidential employees.
Section 3. Medical and Dental Insurance: Effective
January 1, 1990, the City shall contribute a maximum of
$423.90 per month per employee toward health insurance
coverage. Any employee in a health insurance plan and
category which has a total monthly premium less than $423.90
shall not pay for health insurance.
Section 4. General Leave: Confidential Employees
shall be granted an additional day of General Leave effective
January 1, 1990.
Section 5. Tuition Reimbursement: Full-time
Confidential employees will be eligible for reimbursement by
the City of tuition for professional and technical courses
subject to the same conditions and related Council policy
statements as affect the members of T.M.E.A. unit, as outlined
in the current Memorandum of Understanding.
Section 6. Modified Work Schedule: The City has
agreed to conduct a feasibility study with respect to the
implementation of a modified work schedule. Confidential
employees will be included in this study.
Section 7. Administrative Regulations: The City
Manager is authorized to issue written administrative
personnel regulations designed to augment or clarify the
provisions of this Resolution.

Personnel Analyst, Executive Coordinator, Office Coordinator,
Secretary --Administrative Services Department, and Department
Clerk --City Manager's office.
Passed and adopted at a regular meeting of the City
Council of the City of Tustin, California, held on the 20th
day of February, 1990.
