APPROVAL OF Moved by Klingelhofer, seconded by Miller, that minutes MINUTES Of September 5th regular meeting and September 13t~ special meeting be approved. Carried. VI. PUBLIC 1. ZC-67-159 OF JOHN H. SIEGEL HEARINGS TO CONSIDER THE APPLICATION OF JOHN H. SIEGEL FOR ZONE CHANGE 67-159 FOR THE RECLASSIFICATION OF PROPERTY FRONTING 772 FEET ON THE SOUTH SIDE OF MAIN STREET BETWEEN NEWPORT AVENUE AND BRYAN AVENUE FROM C-1 (RETAIL COMMERCIAL) DISTRICT TO R-3 (MULTIPLE FAMILY RESIDENTIAL) DISTRICT. Hearing opened at 7:35 P.M. Mr. Supinger presented staff report and recommendations of the Planning Commission for approval of this Zone Change. Mr. John Siegel, applicant, spoke on the following justifications as submitted with his application: 1. The subject property is not suitably or desirably located for development in accordance with its present Retail Commercial District Classification. 2. The requested classification would permit a development more compatible with the existing multiple residential uses of adjoining prop- erties. 3. The ~equested classification does not conflict with the aims of the TuStin Area General Plan. There being no objections or further comments, the hearing was declared closed ~t 7:40 P.M. Councilman Coco stated that he was confident that the Town Center Study would be completed in the near future and that rather than delay the applicant, the Council should grant this request tonight. Above motion carried by roll call. Ayes: Mack, Klingelhofer, Coco, Miller. Noes: None. Absent: Ring. 2. PREZONE 67-105 TO CONSIDER THE PLANNING COMMISSION INITIATED PREZONING OF THE PROPOSAL BY THE SADDLEBACK MEDICAL DEVELOPMENT (PZ-67-105) FOR PREZONING TO THE PC (PLANNED COMMUNITY) DISTRICT, APPROVAL OF DEVELOPMENT PLAN AND DEVELOPMENT STANDARDS FOR AN EIGHTY-SIX (86) BED PROPRIETARY GENERAL CARE HOSPITAL WHICH WILL ULTIMATELY CONTAIN 250 BEDS. SITE FRONTS 330 FEET ON THE SOUTH- EAST SIDE OF NEWPORT AVENUE AT MYRTLE AVENUE AND CONTAINS APPROXIMATELY 4.8 ACRES. Hearing opened at 7:42 P.M. Staff report and Planning Commission recommendations for ~pproval presented by Mr. Supinger. There being mo objections or comments, the hearing was declared closed at 7:44 P.M. Moved by Coco, seconded by Miller, that Prezone 67-105 be.approved and the.City Attorney directed to draft the necessary Ordinance for presentation at the next regular Council meeting. ORDINANCE NO. 366 - Second reading BUSINESS AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, REZONING AND PREZONING PROPERTY ON APPLICATION NO. 67-158 OF HATCH. Moved by Coco, seconded by Klingelhofer, that Ordinance No. 366 have second reading by title only. Carried unanimously. Moved by Coco, seconded by Miller, that Ordinance No. 36~, approvlng the rezonlng and prezoning of property on Application 67-158, be passed and adopted. Carried by roll call. Ayes: Mack, Klingelhofer, Coco, Miller. Noes: None. Absent: Ring. Cguncilman Ring arrived at 7:47 P.M. 2. ORDINANCE NO. 367 - Second reading AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REZONING PROPERTY ON APPLICATION NO. ZC-67-157. Moved by Klingelhofer, seconded by Ring, that Ordinance No. 367, approving rezoning of propert~ on Application NO. ZC-67-157, be passed and adopted. Carried by roll call'. Ayes: Mack, Klingelhofer, Coco, Miller, Ring. Noes: None. Absent: None. 3. RESOLUTION NO. 901 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, GRANTING A VARIANCE ON APPLICATION NO. V-67-189 OF WINN. Moved by Klingelhofer, seconded by Ring, that Resolution No. 901 be read by title only. Carried unanimously. Moved by Ring, seconded by Klingelhofer, that Resolution No. 901, granting a Variance on Appli- cation No. 67-189 Of Winn, be passed and adopted. Carried by roll call. Ayes: Mack, Klingelhofer, Miller, Ring. Noes: None. Absent: None. Abstained: Coco. VIII. NEW 1. FINAL MAP - TRACT NO. 6478 BUSINESS Moved by Klingelhofer, seconded b~ Coco, that Final Map, Tract No. 6478, be approved and the Mayor and City Clerk be authorized to execute the necessary documents. Carried. 2. FINAL MAP - TRACT NO. 6470 Moved by Miller, seconded by Ring,.that Final Map, Tract No. 6470, be approved, and the Mayor and City Clerk be authorized to execute the necessary documents. Carried. 3. APPROVAL OF DEMANDS Moved by Klingelhofer, seconded by Ri~, that demands in the amount of $24~442.34 be paid. Carried. IX. OTHER 1. CITY ADMINISTRATOR BUSINESS Mr. Gill stated that the Council had several letters in their folders and that he had no comments unless the Council wished to discuss them. Councilman Coco commented on the report regarding residence requirements of Planning Commissioners, stating that it appeared that all cities in Orange County had either a residency requirement or policy and that Tustin would be unique if they changed the present requirements. He did not think that this should necessarily Call a halt to further consider- ation. Councilman Coco said that the Chamber's recommendations for a criteria of vested interest seems to have some merit and suggested further Council Minutes 9/18/67 Pg. 4 study directed toward possibly coming up with a series of criteria, oneof which would be vested taxable interest, another might be residency within the School District or perhaps other criteria. Mayor mack appointed Councilman Coco to work with the Legislatkve Committee of the Chamber on this to see if they can come up with a reasonable suggestion. 2. CITY ATTORNEY None X. INFORMATION The following reports and correspondence were AND received: CORRESPONDENCE 1. City of TuStin Statement of Condition of Funds in the City Treasury. 2. California Highway Commission - relative to off-ramp from Santa Ana Freeway at Newport Avenue. ~r. Gill stated that a hearing on this off-ramp may be held before the State Highway Commission October. 24th. He will know ~n two weeks if the hearing is to be held. 3. Personnel Activity Register 4. Minutes Of Orange County Division, League of California Cities 8/24/67. 5. Assembly Joint Resolution No. 29 from Bob Monagan, Assembly Minority Leader. 6. Tustin Building Department Reports - Fred Brook XI. OTHER 1. CITY COUNCIL BUSINESS ' 1) Councilman Klingelhofer requested that Mr. Gill report back as to policy of the City or State law for posting cul-de-sacs as "Not a Through Street". Mr. Gilt stated th'at the City policy has been ~at if you could see the end of the street from the corner, it was not posted, but that he would prepare a more concise report. ,,- 2) Mayor Mack commented on the report from the Director of Public Works regarding steps being taken to alleviate the condition at Acacia and Amaganset which was brought to the attention of the Council by Mr. Thomlinson. Mr. Gill stated that Mr. Thomlinson had not been contacted in writing since the change in street sweeping but would be as soon as other similar problem areas are corrected. Council Minutes 9/18/67 Pg. 5 3) Mayor Mack, with approval of the Council, ordered that the Chairman of the Planning Commission or his delegate be authorized to attend the League of California Cities Conference in San Francisco October 15th through October i8th to fill the reservation vacancy. 4) Councilman Miller requested that, relative to the tax sharing concept, a Resolution be adopted urging that Federal taxes be reduced and money be left at home rather than Federal taxation and then begging to get it back again. Mr. Rourke was directed to draft a resolution onthis matter for the next Council meeting. 2. PUBLIC None XII. ADJOURNMENT Moved by Miller, seconded by Ring, that the meeting be adjourned. Carried.
