SUBJECT: HOLD HARMLESS AGREEMENT - O. C. S. O.
Recommendation
That Council execute the proposed Hold Harmless Agreement
with the Orange County Sheriff's Department for use of
the facility at the South Coast Gun Club for shotgun
familiarization and transitional training from revolvers
to semiautomatic weapons.
Background
The Orange County Sheriff's Department is requesting the
Hold Harmless Agreement from agencies wishing to use their
facilities for special events and not requiring a member
of the Orange County Sheriff's Department to be present
during the special event. Not requiring a member of the
Sheriff's Department to be present gives agencies more
access to the special equipment during days and hours when
Sheriff's personnel are not available or necessary.
In past shotgun familiarization courses, there has not
been any special help or monitoring by the facility being
used. The entire event is set up, monitored and run by the
Tustin Police Department personnel and training officer.
The request by the Orange County Sheriff's Department is
within past procedural practices.
This Agreement has been reviewed by and is acceptable to
the City Attorney.

HOLD HARMLESS AGREEMENT
ORANGE COUNTY SHERIFF'S DEPARTMENT
In consideration of being permitted to use the facilities of the
Orange County Sheriff's Department at the South Coast Gun Club,
which is limited to the range which is fenced and designated to
the Orange County Sheriff's Department, for the purpose of special
shooting events during the pre -arranged designated days and times,
the City of Tustin agrees that neither the South Coast Gun Club
nor any officer or employee thereof is responsible for any damage
or liability occurring by reasons of anything done or omitted to
be done by the City of Tustin or any of its officers or employees
under or in connection with their use of the said facilities and
City shall defend, indemnify and save harmless the Orange County
Sheriff's Department and the South Coast Gun Club from all claims,
suits or actions of every name, kind and description brought for
or on account of injuries to or.death of any person or damage to
property resulting from anything done or omitted to be done by
City under or in connection with its use of said facilities.
