415 WEST SIXTH STREET
RECOMMENDATION:
That the Tustin City Council provide direction/clarification on:
1. Responsibility for cost of tree removal/trimming and other
related work for a private development.
2. Removal of healthy trees or adverse trimming within public
rights-of-way over the objection of the adjacent property owner.
3. Trimming- of trees on private property for reasons other than
eliminating hazardous conditions on public property.
BACKGROUND:
Mr. and Mrs. Jeff Thompson, 405 West Sixth Street are proposing to move
a structure from 640 West First Street to 405 West Sixth Street via the
following streets:
* Easterly on First Street to El Camino Real
* Southerly on E1 Camino Real to Main Street
* Easterly on Main Street to Newport Avenue
* Southerly on Newport Avenue to E1 Camino Real
* Westerly and northerly on El Camino Real to Sixth Street
* Westerly on Sixth Street to destination at 405 West Sixth Street
The Thompsons propose to move. the structure as one piece which has a
minimum structure width of forty (40) feet plus a roof overhang of three
(3) feet and a height of twenty-eight (28) feet.
The proposed route utilizes both sides of First Street to minimize
conflict with trees, street lights, signs, etc. and traverses to each
side through the median openings except at the E1 Camino Real inter-
section. Just westerly of El Camino Real, the structure will be pulled
over the median island so as to clear the overhead traffic signal.
As the structure enters the E1 Camino Real/Main Street intersection, two
traffic signal standards will have to be temporarily relocated and
replaced. The structure will traverse down the center of both E1 Camino
Real (southbound) and Main Street (eastbound).
Both sides of Newport Avenue will be utilized with the structure
opposing traffic between Main Street and Andrews Street, from Sixth
Street/Walnut Street to approximately 300 feet south of the intersection
and from the alley southerly of Bonita Street to El Camino Real.

The intersection of Sixth Street and E1 Camino Real will require the
temporary relocation and replacement of two traffic signal standards.
Sixth Street is currently constructed forty feet wide between curbs, the
same width as the structure not inclusive of roof overhang. The street
has several overhead utilities crossing the street. The Thompsons have
provided for each respective utility company to clear their facilities.
A recent action by the Tustin Community Redevelopment Agency has
budgeted funds to underground a portion of the Pacific Bell facilities
at the "B" Street/Sixth Street intersection.
The major concern along Sixth Street is the removal, and/or major
trimming, of trees to provide the required clear area. The following is
a list of trees that will require complete removal, or possible removal
as indicated, on both First Street and Sixth Street:
Remove one ficus tree on First Street at the northeasterly corner
of Mountain View Avenue
Remove one ficus tree on First Street at the northeasterly corner
of "A" Street
Remove three ficus trees on north side of First Street in front of
of Villa Viento Apartments
Remove one ficus tree on north side of First Street in front of
Mullin Lumber Co.
Remove one avocado tree on southerly side of Sixth Street at the
southwesterly corner of "B" Street
Possible removal of one avocado tree on northerly side of Sixth
Street at the northwesterly corner of "C" Street.
Possible removal of one avocado tree on the northerly side of Sixth
Street at the northeasterly corner of "B" Street.
In addition to the above-mentioned removals, several ficus trees, seven
olive trees, six avocado trees, one palm, one camphor and one pine tree
will require trimming. Some of the trimming on these trees may be
adverse and could require the removal of same if the remaining growth is
unbalanced.
At the March 29, 1990 City Council meeting, Mr. Charles Anderson, 255
West Sixth Street, spoke against the removal and/or trimming of trees
along Sixth Street to accommodate the structure relocation in one piece.
In particular, he spoke against the removal and/or trimming of all the
trees located within the Sixth Street parkway in front of his residence.
On March 23, 1990, Mr. Anderson came into the City to again voice his
opposition to the tree removals/trimming. He also indicated that he had
not yet been contacted by the Thompsons regarding the potential
removals.

DISCUSSION:
For the City Council's information, I have attached copies of the
following:

The Thompson's target date for the structure relocation is the night of
April 3, 1990 and morning of April 4, 1990 (12:15 A.M. to 3:15 A.M.).
The tree removals and trimming will take staff a minimum of 2-1/2 days
to complete. Certain issues need to be resolvedrp for to Friday, March
30, 1990 to allow adequate time for the work to be completed.
Staff is requesting direction/clarification on the following:
1. Who would be responsible for the cost of the tree removal/ trimming
to facilitate the moving of the structure in one piece?
2. Should the City remove healthy trees or adversely trim trees within
the public parkways over the objection of the property owner?
Past practice/policy has not allowed removal unless the tree is
diseased or is a public hazard.
3. Should the City trim trees on private property which overhang the
public right-of-way?
Current policy allows trimming of up to a height of 7 feet over
sidewalks and 15 feet over travelways of streets to eliminate
hazardous conditions.
The removal/trimming of the trees along Sixth Street could adversely
impact some of the involved residences such as Mr. Anderson's and the
senior citizen tenants at the northwesterly corner of "C" and Sixth
streets. The Thompsons have submitted a petition to residents/property
owners along Sixth Street to obtain their consent or dissent on the
matter. A map showing the addresses of residents/property owners that
have consented is attached for your information along with a copy of the
petition which was submitted on March 26, 1990.

This letter is in response to Jerry Crabill, consulting
Traffic Engineer, correspondence with Dan Fox, Senior -
Planner. (Please note that as of today, March 22nd we
are in receipt of the correspondence dated March 19t.h.)
We are extremely interested in responding to all
comments from your department as quickly and efficiently
as possible. On any future correspondence please feel

The following are our comments XS noted in Jerry
Crabill's letter:
I. TRAFFIC CONTROL
With this letter is attached a typical traffic control
plan- for when t -he house is on the opposite side of the
street. Flag men will be utilized in a manner similar to
a construction project restricting traffic flow. Each of
the two flag men, one ahead and one behind the house
movement, will be equipped with a vehicle with flashing
lights and proper attire for directing traffic. Flares
wi 1 1 be used for obstructions over, a. f ive or teyi minute..
period. Attached is a detail of how the control will be
used. There will be additional vehicles used in
assisting the movement of the house.
II. POTENTIAL DAMAGE TO MEDIANS IN THE ROADWAY
Although we are not sure as to what precautions the .pity
wi 1 1 be using in establishing cautionary procedures, we
will be videotaping the route before and after the move.
Special emphasis wi 1 1 be made on med i. -an i s 1 ands :-unci the

information with City Staff if requested.

recent correspondence scheduled with the appropriate
utilities. If the city has further concern with this

Dear Mr. and Mrs. Thompson:
This letter will respond to your 3/22/90 letter and recap any
remaining concerns and required procedures regarding. the proposed
structure -relocation.
In.our final review of the moving route, it has been noted that
there may be two potential alignments with regard to the First
Street segment of the route. The first alignment would be the one
submitted on your drawing which accompanied your 3/22/90 letter.
The second alignment would be the one that your moving contractor
(Bell House Movers, Inc.) discussed with City staff member Pablo
Rodriguez. Please be advised that the trees described for removal
and/or trimming along the First Street segment are based upon the
alignment designated by the moving contractor. If this alignment
is changed, then a re-evaluation of the work to be performed along
First Street will be required. Please advise as to exactly which
route will be utilized along First Street.
Traffic control as outlined in your 3/22/90 letter will be
acceptable with the Public Works Department. This traffic control
plan has been routed to the Police Department for their comment.
I would suggest that you contact Sgt. Brent Zicarelli directly for
their comments.
City staff will inspect the street medians, signs, trees, shrubs,
etc. within the public right-of-way prior to the proposed structure
move and photograph any existing damaged areas. After completion of
the move, these areas will be re -inspected to determine what
areas,if any, have been damaged,
The coordination and cost of clearance for all overhead public
utilities will be your responsibility as indicated in your 3/22/90
letter. The temporary relocation of City traffic signal facilities
by Traffic Signal Maintenance, Inc. is acceptable. When they apply
_ for their public works permit, they will need to submit a
certificate of insurance on the City's form. A blank certificate is
attached for their use. This form will require review and approval

by the City Attorney's office and it should be submitted a minimum
of three (3) working days prior to the date of permit issuance. All
traffic signal relocation work cost will be borne by the requesting
party and will require the presence of a City Public Works inspector
when the work is performed.
All tree removals will require final approval by the Tustin City
Council. Adverse trimming of trees will also be presented to the
City Council for their review. Based upon the First Street
alignment delineated by the moving contractor, the following is a
recap of trees requiring removal and/or possible removal due to
heavy trimming:

Remove one ficus tree on First Street at the northeasterly corner
of "A" Street
Remove three ficus trees on north side of First Street in front of

In addition to the above-mentioned removals, several ficus trees,

It is my understanding that your will be contacting all the property
owners along Sixth Street who will be impacted by the removals and/
or trimming to obtain their consent for same.
The moving contractor must also provide a certificate of insurance
on the City's form. An additional blank certificate is attached for
their use. As previously indicated, this completed insurance
certificate will require review and approval by the City Attorney's
office and should be submitted with sufficient lead time as
previously indicated.

All streets along the proposed alignment will be required to have
on -street parking removed during the period of the structure move.
These signs should be posted a minimum of 48 hours prior to the
parking prohibition and should contain the following minimum
information:-

The posting and removal of these signs will be your responsibility.
A vehicle may not be towed if the signs have not been properly
posted.
Following is a cost estimate for the various functions the City
Public Works staff would be performing as a part of the structure
relocation:
1. Trim, remove and replace trees ..................... $5,000.00
(This cost includes tree replacements of 7 trees
@ $95.00 = $665.00)
2. Removal and replacement of street signs 426.00
3. Two maintenance workers on-site during move ........ 478.00
(2 x 8 hrs x $29.92* _ $478
4. One Public Works Inspector on-site during traffic ... 299.00

* Overtime plus benefits
Total estimated staff cost $6,203.00
In addition to the above costs, staff will be requesting that a
surety or cash bond be posted with respect to public improvements
that may be impacted by the structure move in the amount of $15,500.
This bond would be for impacts to the City traffic signals at two
intersections and the raised median islands at three'crossing
locations. Also, the over -limit movement permit fee which gets
issued to the contractor is $25:00.
The Field Services Division has indicated they will need a minimum
of 2-1/2 days to trim and remove trees to provide the required clear
area as outlined by your contractor. In order to expedite this
matter, I will be forwarding a copy of this letter to the City
Council as a part of the staff report no later than 3/27/90 to
obtain closure on the final authorization of tree removal/trimming.

It is staff's opinion that all of the tree removals and a majority
of the required trimming and the majority of the traffic signal
relocation work could be eliminated by moving the structure in two
sections. Additionally, the structure could be transported in a
manner with less impact to opposing traffic resulting in.less
liability exposure.

The purpose of this memorandum is to advise you of estimated costs. associated with Field Services'
support for tree removals/replacement and clearing the roadway of small street signs.
Two major issues need to be resolved by the City and I seek your direction.
1 . Should we proceed, at City expense, to trim, remove/replace trees?
I am aware that Mr. Jeff Thomson has suggested that he is willing to pay for replacement stock.
2. Are we to remove healthy trees from the parkway, over the objection of the property owner?
The estimated costs associated with the above are as follows:
Trim, Remove and Replace Trees in Conflict: $5,000-00
Remove and Replace Street Signs During the Move: 426.00
TOTAL $5,426.00
NOTES: 1 . Estimated Cost for Labor is Based on Premium Time.
2. Effort would require approximate 73 man hours.
3. The estimated cost of replacement stock is $665.00 for 7 - 24 inch box trees.
4. Field Service would need a total of 2 and 1/2 days notice to trim and remove trees in
conflict. Stump grinding and replacement could be done after the move is completed.
I recognize that our efforts represent only a small portion of the total concerns the City has in
supporting this move.
