SUBJECT: RECOVERY OF CITY INCURRED COSTS OF A NOTICE TO CLEAN
PREMISES AT 15651 "B" STREET
RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 90-42
approving a special assessment of one hundred ninety-four dollars
and forty-three cents ($194.43).
BACKGROUND/DISCUSSION
The subject property is a vacant lot and has had a history of code
enforcement actions taken regarding weed abatement and abandoned
vehicle violations. On October 10, 1989, staff sent a Notice and
Order per standard code enforcement procedures to notify the
property owner of a violation of the Tustin City Code Section 4411
et seq. Upon expiration of the Notice, staff reinspected the
property on November 30, 1989, and found that the property owner
had begun the necessary clean-up work to clear the lot of debris
and overgrown weeds. Staff, at that time, noted the file for
scheduling a reinspection for a later date. Staff then followed
up with a letter dated December 5, 1989, acknowledging the
inspection and the findings that work had been started but was
still incomplete.
On December 21, 1989, staff again reinspected the subject property
and found that the work was still not completed. Staff also noted
that a "makeshift" temporary fence had been installed without
permits. Due to the incomplete status of the clean-up effort,
staff gave final notice to the property owner by utilizing Tustin
City Code Section 4413, which authorizes staff to post a Notice to
Clean Premises within ten days. The posting and noticing was
carried out on February 2, 1990.
On February 22, 1990, staff once again inspected the subject
property and found that it remained in its incomplete clean-up work
status. Since staff had not received any form of contact by the
property owner indicating that the necessary work would be
completed, City staff had to perform the additional work to clear
the property. The work order was carried out on March 1, 1990 and
the following expenses were incurred by the City:

Staff will continue to monitor this subject property for potential
weed abatement in the future. Staff will also continue to keep
property owners advised of their responsibilities for property
maintenance.

RESOLUTION NO. 90-42
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, ASSESSING THE PROPERTY
LOCATED AT 15651 "B" STREET FOR THE COST
INCURRED BY THE CITY FOR THE NOTICE TO CLEAN
PREMISES.
WHEREAS, the City has made every effort to secure
the cooperation of the property owner in abating the
nuisance at 15651 "B" Street; and
WHEREAS, upon the failure of the property owner to
cause the abatement, and City staff has abated the
nuisance at a cost to the City of $194.43.
NOW, THEREFORE, BE IT RESOLVED that the Finance
Director for the City of Tustin is directed to place a
special assessment on Assessor's Parcel No. 402-333-06
in the amount of $194.43 to recover the cost incurred by
the City of Tustin in weed abatement for the property
located at 15651 "B" Street.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, California held on the
2nd day of April, 1990.
