BACKGROUND: Caltrans District Agreement No. 12-039 is a cooperative agreement between the City of Tustin and Caltrans. The agreement covers the modification of the City traffic signal system to mitigate the congestion that is anticipated to result from the widening of I-5 from SR -405 to SR -55. Amendment A-2 to District Agreement No. 12-039 extends the term of the agreement to coincide with the revised project schedule. Bob Ledendecker Director of Public Works/City Engineer BL:mv 12 -ORA -5 21.3/30.46 12355 - 065481 I-5 Widening between Route 405 to Route 55 District Agreement No. 12-039 A-1 AMENDMENT TO AGREEMENT THIS AMENDMENT TO AGREEMENT, ENTERED INTO ON jr 19 , is between the STATE OF CALIFORNIA, acting by and through its Department of Transportation, referred to herein as STATE, and CITY OF TUSTIN a body politic and a municipal corporation of the State of California, referred to herein as CITY 1 District Agreement No. 12-039 A-1 RECITALS 1. The parties hereto entered into an AGREEMENT (Document No. 6918) on September 5, 1989, said AGREEMENT defining the terms and conditions of a cooperative project to modify the City signal system for the handling of traffic during the I-5 widening of the above referenced project, referred to herein as the PROJECT. 2. It has been determined that the PROJECT will not be constructed prior to the termination date of said AGREEMENT. IT IS THEREFORE MUTUALLY AGREED 1. That Section I, Article 1, of the original AGREEMENT is amended to read "To fund one hundred (100) percent of construction cost of PROJECT provided these costs do not exceed the total amount shown in Attachment A and are completed prior to September 1, 1990. After bid opening for PROJECT, this Cooperative Agreement will be revised to reflect the actual bid price of the successful bidder, which thereafter will be the maximum amount of STATE'S 2 District Agreement No. 12-039 A-1 participation. In no event will the amount of STATE'S participation in PROJECT exceed $209,040". 2. That Section III, Article 8, or the original AGREEMENT is amended to read "The STATE will only participate in PROJECT work that will be completed prior to September 1, 1990". 3. That Section III, Article 9, of the original AGREEMENT is amended to read "Except as otherwise provided in Article 7 above, this Agreement shall terminate upon completion and acceptance of the construction contract for PROJECT by STATE or on ownership and maintenance clauses shall remain in effect until terminated, in writing, by mutual agreement". 4. The other terms and conditions of said AGREEMENT (Document No. 6918) shall remain in full force and effect. 3 District Agreement No. 12-039 A-1 5.
