SUBJECT: REVISED RESOLUTION NO. 90-44 FOR ADOPTION BY THE CITY
COUNCIL
Attached is a revised copy of Resolution No. 90-44 for adoption by
the City Council to record a special assessment for the property
located at 200 E1 Camino Real.
The revised resolution reflects the previously approved assessment
of $4,036.90, heard by Council on September 5, 1990, as well as the
currently requested assessment amount of $153.57 totaling to
$4,190.47.
It is recommended that the City Council, after holding the public
hearing regarding the City incurred costs of $153.57, adopt
Resolution No. 90-44 as revised.

SUBJECT: RECOVERY OF CITY INCURRED COSTS OF THE ABATEMENT OF A
PUBLIC NUISANCE LOCATED AT 200 EL CAMINO REAL
RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 90-44
approving a special assessment of one hundred fifty three dollars
and fifty-seven cents ($153.57).
BACKGROUND/DISCUSSION
After a major fire damaged the structure at 200 El Camino Real on
July 30, 1990, City staff served immediate notice to the tenant and
property owners. The notice required that the property be secured
immediately as there was an immediate safety endangerment to the
general public. The property owners complied with the notice by
installing temporary fencing around the perimeter of the property.
The notice also stated that the property must be cleared of all
debris and to perform the necessary demolition to the remaining
structure.
Since that time, City staff had to perform the remaining clean up
work at an expense to the City of four thousand thirty six dollars
and ninety cents ($4,036.90) as the property owner failed to
complete the required clean up work. The City Council thereupon
approved a special assessment as a lien on the property for those
costs on September 5, 1990.
On November 7, 1990, City staff was informed that the fence
surrounding the property was unsecured. Due to the incomplete
status of the demolition of the remaining structure, an immediate
threat to adjacent properties existed. On November 8, 1990, City
staff had to perform the necessary work that secured the property.
The following is a summary of those City incurred expenses due to
those actions:

CONCLUSION
As of today's date, staff can report that the required demolition
has been completed on the site and more permanent fencing has been
installed to keep the property secure. Staff will continue to
monitor the subject property as part of routine code enforcement
inspections in order to assure future compliance with City Codes.

RESOLUTION NO. 90-44
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, ASSESSING THE PROPERTY
LOCATED AT 200 EL CAMINO REAL FOR THE COST
INCURRED BY THE CITY FOR THE ABATEMENT OF A
PUBLIC NUISANCE.
WHEREAS, the City has made every effort to secure
the cooperation of the property owner in abating the
nuisance on said property; and
WHEREAS, upon the failure of the property owner to
cause the abatement, and City staff has abated the
nuisance at an additional cost to the City of $153.57.
NOW, THEREFORE, BE IT RESOLVED that the Finance
Director for the City of Tustin is directed to place a
special assessment on Assessor's Parcel No. 401-572-01
in the amount of $153.57 to recover the cost incurred by
the City of Tustin in the abatement of a public nuisance
for the property located at 200 El Camino Real.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, California held on the
16th day of April, 1990.
