SUBJECT: CANVASS OF APRIL 10, 1990 GENERAL MUNICIPAL ELECTION
RECOMMENDATION:
Adopt Resolution No. 90-47 reciting the, fact of the General
Municipal Election held on April 10, 1990, declaring the result
and such other matters as provided by law.
BACKGROUND:
The General Municipal Election for the City of Tustin was held
on Tuesday, April 10, 1990, to elect two (2) Members of the
City Council for full terms of four years; and elect one (1)
Member of the City Council for the term of office in which a
vacancy was created by the resignation of Ronald B. Hoesterey,
which ends in April, 1992.
The returns of the election have been canvassed and certified
as follows: For the full terms of four years, Charles E.
Puckett received the highest number of votes (2,850) and Leslie
Anne Pontious received the second highest number of votes
(2,664); and for the short term of two years, Jim Potts
received the highest number of votes (2,125).

RESOLUTION NO. 90-47
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN CALIFORNIA, RECITING THE
FACT OF THE GENERAL MUNICIPAL ELECTION
HELD ON APRIL 10, 1990, DECLARING THE
RESULT AND SUCH OTHER MAT'T'ERS AS PROVIDED
BY LAW
WHEREAS, a General Municipal Election was held and conducted
in the City of Tustin, California, on Tuesday, April 10, 1990,
as required by law; and
WHEREAS, notice of the election was given in time, form and
manner as provided by law; that voting,precincts were properly
established; that election officers were appointed and that in
all respects the election was held and conducted and the votes
were cast, received and canvassed and the returns made and
declared in time, form and manner as required by the provisions
of the Elections Code of the State of California for the holding
of elections in general law cities; and
WHEREAS, pursuant to Resolution No. 90-28, adopted April 2,
1990, the City Clerk canvassed the returns of the election and
has certified the results to this City Council, the results are
received, attached and made a part hereof as "Exhibit A."
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. That the whole number of ballots cast in the
City except absent voter ballots was 3,891.
That the whole number of absent voter ballots cast in the
City was 579, making a total of 4,470 ballots cast in the City.
SECTION 2. That the names of persons voted for at the
election for Member of the City Council are as follows: Member
of the City Council, Long Term - Leslie Anne Pontious, Dennis E.
Pedersen, Charles E. "Chuck" Puckett, Carole Bryant and John
Kelly; Member of the City Council, Short Term - Jim Potts, John
Norman Butler and Berklee A. Maughan.
SECTION 3. That the number of votes given at each
precinct and the number of votes given in the City to each of the
persons above named for the respective offices for which the
persons were candidates were as listed in "Exhibit All attached.

5 SECTION 4. The City Council does declare and determine
that: Charles E. Puckett and Leslie Anne Pontious were elected
6 as Members of the City Council for the full terms of four years
each; and Jim Potts was elected as Member of the City Council for
7 the term of office in which a vacancy was created by the
resignation of Ronald B. Hoesterey, which ends in April, 1992.
8 SECTION 5. The City Clerk shall enter on the records of
9 the City Council of the City, a statement of the result of the
election, showing: (1) The whole number of ballots cast in the
10 City; ( 2 ) The names of the persons voted for; ( 3 ) For what office
each person was voted for; (4) The number of votes given at each
11 precinct to each person; (5) The total number of votes given to
each person.
12 SECTION 6. That the City Clerk shall immediately make and
13 deliver to each of the persons so elected a Certificate of
Election signed by the City Clerk and authenticated; the the City
14 Clerk shall also administer to each person elected the Oath of
Office prescribed in the Constitution of the State of California
15 and shall have them subscribe to it and file it in the office of
the City Clerk. Each and all of the persons so elected shall
16 then be inducted into the respective office to which they have
been elected.
17 SECTION 7. That the City Clerk shall certify to the
18 passage and adoption of this resolution and enter it into the
book of original resolutions.
19 PASSED AND ADOPTED at a Special Meeting of the City Council
20 of the City of Tustin on the 17th day of April, 1990.
