HomeMy WebLinkAboutCC 8 ASSESS DIST 86-2 05-21-90DATE: MAY 11, 1990 TO: WILLIAM HUSTON, CITY MANAGER CONSENT CALENDAR NO. 8 5/21/90 Inter - Com FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: ACCEPTANCE OF ASSESSMENT DISTRICT NO. 86-2 PUBLIC IMPROVEMENTS FOR THE LOWER PETERS CANYON RETARDING BASIN FACILITY (#1132) RECOMMENDATION: That the Tustin City Council adopt the attached resolution accepting the public improvements within the Lower Peters Canyon Retarding Basin Facility and authorize the recordation of the Notice of Completion for said improvements. Assuming no additional claims or stop payment notices are filed, it is further recommended that 30 days after the date of recordation of the notice of completion, the Council authorize payment of the final retention monies in the amount of $550,587.61. This amount, together with previous payments totaling $5,380,103.97, represents 100% of the final contract amount. ACKGROUND: This project consisted of the construction of a flood control retarding basin within the East Tustin area of development that will provide flood protection for the 100 -year storm. This facility is located at the southerly end of the proposed regional park facility and just northerly of Peters Canyon Road. All work has been completed to the satisfaction of the Tustin Public Works/Engineering Division, Orange County Flood Control District and State of California Division of Dam Safety. Once the Notice of Completion has been filed, this facility will be turned over to the County of Orange for maintenance and operation per prior agreement. The final construction contract amount for this project was $5,930,691.58. This project had an original contract amount of $5,111,460.00 which results in a 16% cost overrun. This extra work consisted primarily of additional earthwork to provide a stable foundation for the earth -filled dam, field changes as required by the State Division of Dam Safety, and the delay of work to recover and document archaeological findings within the project area. This project was totally funded by Assessment District No. 86-2 monies. X11 Bob Ledendecker Director of Public Works/City Engineer 1 2 3 4 5 6 s X 10 11 12 13 14 15 16I17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 90-58 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR ASSESSMENT DISTRICT 86-2 IMPROVEMENTS ON THE LOWER PETERS CANYON RETARDING BASIN FACILITY. WHEREAS, Sukut Construction, Inc., having a contract with the City of Tustin to construct the hereinafter described public work and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements herein- after mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the notice of completion and acceptance of said public work and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement be, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: Assessment District No. 86-2 Improvements on the Lower Peters Canyon Retarding Basin Facility in the City of Tustin AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin be and is hereby resolved to execute and file a notice of completion and acceptance of said public work and improvement described herein as required by law.
