PUBLIC 1-A PREZONING (PZ-67-103) OF THE PROPERTY BOUNDED HEARINGS BY RED HILL AVENUE, WALNUT AVENUE, NAVY WAY, AND THE A.T.& S.F. SPUR TRACK TO "P-C" PLANNED COMMUNITY AND APPROVAL OF DEVELOPMENT PLAN FOR SAID PROPERTY. 1-B AMENDMENT OF THE TUSTIN AREA GENERAL PLAN TO SHOW MEDIUM HIGH DENSITY RESIDENTIAL LAND USE (6.5 DWELLING UNITS PER ACRE) FOR THE AREA BOUNDED BY RED HILL AVENUE, WALNUT AVENUE, NAVY WAY, AND THE A.T.& S.F. SPUR TRACK Hearing opened at 7:36 P.M. Planning Commission recommendations, case histoil', maps, correspondence and staff report presented by Mr. Supinger. Mr. Richard Reese of the irvine Co. explained the plans for the development of single family homes and an eight acre neighborhood park. In explaining the exhibit showing density of the development, Mr. Reese noted that the higher density shown in Area 8 is adjacent to the Railroad and Flood Control. Mr. Reese stated that adequate school facilities exist or will be developed and that presuming the annexation will be completed in April, a tentative map will be filed at ~he earliest possible date with occupancy available in late summer. Col. Bright, Commanding Officer, Marine Corps Air Facility, objected to residential housing on the subject property and referred to the correspondence from the USMC and the Secretary of the Navy, reading portions of the latter. There being no further objections or comments, the hearing was declared closed at 7:50 P.M. Council Minutes 3/6/67 Pg. 2 Mr. Supinger informed the Council that under the present County zoning, this property could be a residential development. Col. Bright stated that the Marine Corps objected to any residential development in this area. In answer to questioning by Councilman Coco regarding correspondence from the Department of the Navy stating that a noise level of 105 PN db might be expected, Col. Bright said he is unfamiliar with this term,' but assumed it referred to the amount of decibel units of noise. Mr. Reese stated that the Irvine Co. was also concerned with the nuisance in terms of hazard. The noise rating is 100 decibels next to freeways, but that 100 or 105 decibels only seems excessive next to agricultural areas. Councilman Coco questioned the ra~e of accidents in the direc~ approach and take-off pattern and that within a five mile radius. Col. Dr.!ght explained the flight patterns in the area and presented a chart showing the accident ratio directly in a flight pattern and that within a five mile radius. In answer to questioning by Councilman Coco, Col. Bright stated that although the Air Facility is primarii~-a helicopter base, some helicopters are partially fixed-wing craft and the future Kay show more of a fixed-wing flight. Councilman Klin~elhofer questioned how long Walnut ~T~e~ this area. Col. Bright answered that the School had been there over a year, but as it was windowless and air conditioned, they were not bothered by the noise factor. Councilman Miller asked Mr. Supinger if it is true that in granting this zone change, the City will not be granting anything that they don't have under the County zoning. ~r. Supinger said the present zoning would permit about four units per acre. The proposed zoning would permit six per acre and that after the zoning is final, they need only approval of the subdivision map. Councilman Klingelhofer said he is not as concerned about noise factor as the hazard~ but is not thoroughly convinced that we are imposing any great hazard. There is now a school which is a great hazard and he did not hear of opposition when the school site was picked. Col. Bright said the school application was prior to his taking over command. Mr. Reese said the school site was approved by the State Department Of School Planning and he felt sure they would have analyzed any hazard. Nuisance is a relative thing. Council Minutes 3/6/67 Pg. 3 Councilman Miller noted that according to density information based on tentative layout plans, the difference between County and City development would be only thirteen lots. Moved by Klingelhofer~ seconded by Mac~, that Ordinance No. 342, approving PZ 67-103 and amending the Tustin Area General Plan, have first reading by title only. Motion carried unanimously. 2. RED HILL-WALNUT ANNEXATION Hearing opened at 5:26 P.M. There being no comments or objections, the hearing was closed at 8:27 P.M. Moved by Miller, seconded by Coco, that Ordinance No. 343, approving the Red Hill-Walnut Annexation, have first reading by title only. Carried unanimously. Councilman Klingelhofer stated that it would be of interest to know ifthe representative from the Irvine Co. could let the Council know in public what they feel the City offers and their reasons for requesting annexation. Mr. Reese stated that they had conducted a study and analyzed benefits to future residents. They took the full range of community services into consideration and found that residents enjoy a higher level of services at a tax rate equal to or lcwcr than the County. The tax rate may be higher in the City, but certain areas are dropped off and services provided more than pay for the difference. 3. ORDINANCE NO. 340 TO CONSIDER THE ADOPTION OF ORDINANCE NO. 340 - "AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE ZONING ORDINANCE, ORDINANCE NO. 157, AS AMENDED, TO PERMIT A CARETAKER'S APARTMENT INCIDENTAL TO A SMALL ANIMAL HOSPITAL. Hearing opened at8:32 P.M. Planning Commission recommendations and staff report presented by Mr. Supinger. There being no comments or objections, the hearing was declared closed at 8:33 P.M. Councilman Miller questioned whether there should be a stipulation as to size of apartment allowed. Mr. Supinger stated that this could be incorporated into the Ordinance, but as practical economics would rule, he did not see the necessity. Carried unanimously. OLD 1. ORDINANCE NO. 339 BUSINESS AN ORDINANCE OF THE CITY OF TUSTIN,, CALIFORNIA, AMENDING THE ZONING ORDINANCE, ORDINANCE NO. 157, AS AMENDED, PROVIDING FOR THE AMENDMENT OF THE MINIMUM BUILDING SITE AREA, MINIMUM LOT WIDTH REQUIRED AT PROPERTY LINE AND MINIMUM OFF-STREET PARKING REQUIREMENTS OF SERVICE STATIONS. Moved by Miller, seconded by Klingelhofer, that Ordinance No. 339 have second reading by title only. Carried unanimously. Moved by Klingelhofer, seconded by Coco, that Ordinance No. 339, providing for the amendment of the minimum building site area, minimum lot width required at property line and minimum off-street parking requirements of service stations, be passed and adopted. Moved by Coco, seconded by Klingelhofer, that ~ion No. 866 be read by title only. Carried unanimously. RESOLUTION NO. 869 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE IMPROVEMENT OF MCFADDEN STREET BETWEEN THE A.T.& S.F. RAILROAD AND WALNUT AVENUE, AND AUTHORIZING AND DIRECTING THE CITY CLERK TO ADVERTISE FOR BIDS. Moved by Klingelhofer, seconded by Coco, that Resolution No. 869 be read by title only. RESOLUTION NO. 870 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE IMPROVEMENT OF YORBA STREET FROM 1268' NORTH OF FOURTH STREET TO 3177' NORTH OF FOURTH STREET, AND AUTHORIZING AND DIRECTING THE CITY CLERK TOADVERTISE FCR BIDS. Moved by Klingelhofer, seconded by Miller, that Resolution No. 870 be read by title only. Carried unanimously. Moved by Coco, seconded by Klingelhofer, that Resolution No. 870, approving plans and specifications for improvement of Yorba Street from 1268' North of Fourth Street to 3177' North of Fourth Street, and authorizing and directing the City Clerk to advertise for bids, be passed and adopted. Council Minutes 3/6/67 Pg. 6 Councilman Miller rechecked the plans and stated he did not want to see the Deodar trees in this area removed. Mr. Gill assured the Council that the trees would remain. 6. ORDINANCE NO. 341 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING RED HILL AVENUE IN THE CITY OF TUSTIN AS A COUNTY HIGHWAY. Moved by Miller, seconded by Klingelhofer, that Ordinance NoT 341 have first reading by title 0nly. Carried unanimously. Moved by Miller, seconded by Klingelhofer, that Ordinance No. 341 have s~cond teadine by title only. Carried unanimously. Councilman Coco stated that he realized it is not the fault of the City staff, but wishes that these Ordinances could be presented in time so that the urgency passage is not required. Moved by Miller, seconded by Klingelhofer, that O~'dinance N0. 341, designating Red Hill Avenue in the City of Tustin as a County Highway, be passed and adopted as an emergency, urgency measure. Carried by roll call. Ayes: Mack, Klingelhofer, Miller. Noes: None. Absent: Ring. Abstained: COco. 7. RESIGNATION OF DON HEFNER AS A MEMBER OF THE PLANNING COMMISSION. In lieu of the upcoming Annexation Election, the Council asked if action on Mr. Hefner's resignation could be deferred. Mr. Rourke ruled that in conformance to Resolution No. 678, Mr. Hefner could continue to serve at the pleasure of the Council. Moved by Coco, seconded by Miller, that the Council defer action on the resignation of Don Hefner until the next regular Council meeting. Carried. 8. COMPENSATION SURVEY & ANALYSIS AGREEMENT - GRIFFENHAGEN-KROEGER, INC. ~oved by Miller, seconded bX Coco, that the Mayor and City Clerk be authorized to execute an agreement with Griffenhagen-Kroeger, Inc. for a compensation survey and analysis. On questioning by Councilman Coco, Mr. Gill explained that this agreement would cover seven designated positions for detailed job analysis as well as a complete compensation survey for all positions. Above motion carried. 9. APPROVAL OF DEMANDS Moved by Miller, seconded by Coco, that demands in the amount of $28,679.86 be approved and paid. Carried. Carried. 3. Orange county water District - recommending R. A. Daily to serve as Industrial Representative on Santa Ana River Basin Reg. Water Quality Control Board. 4. City of Santa Ana - Resolution 67-17 re: provisions of Collier-Unruh Act. 5. City of Fountain Valley - Resolution 4015 endorsing Flood Control Bond Issue. 6. So. California Regional Association of County Supervisor~ - Use of Highway construction funds. 7. League of california cities - Legislative Bulletin. Councilman Klingelhofer said that as a responsible City Counc~'l we should let our representatives know how we feel about certain proposed bills.
