RECOMMENDATION - It is recommended that the Planning Commission
adopt Resolution No. 2770, as submitted or revised, forwarding

RECOMMENDATION ,
It is recommended that the Planning Commission adopt Resolution No.
2744 approving modifications to the previously approved recreation
building tower element, retaining walls for unit entries and lower
level windows, subject to conditions contained in Exhibit A. as
submitted or revised.

REQUEST: TO INSTALL A 30 FOOT TALL HIGH FREQUENCY RADIO
RECEPTION TOWER WITH THREE ATTACHED MICROWAVE DISHES
AT 137 SOUTH PROSPECT.
RECOMMENDATION - It is recommended that the Planning Commission
either: 1. Continue this matter until June 25, 1990 to permit
renoticing of the project; or 2. Certify the Final Negative
Declaration for the project as adequate by adoption of Resolution
No. 2772; and approve Conditional Use Permit 90-10 by adoption of
Resolution No. 2773, as submitted or revised.

Commission meeting. Motion carried 4-0.

STAFF CONCERNS
6. Report on Actions taken at May 7, 1990 City Council Meeting.

Development
COMMISSION CONCERNS
Commissioner Rasparian
-Asked how some cities, such as Villa Park, meet low income
housing requirements without including mobile home parks as
part of the housing element. The Director advised that it is
a function of the zoning requirements. Some cities elect not
to zone for mobile home parks. The Commissioner asked how
Villa Park addressed the State low cost housing requirements.
The Director replied that she did not know how Villa Park
addressed the issue, but that each City had an obligation to
adopt a Housing Element by July 1989 and as of this year Villa
Park was one of the Cities that has not complied, but that the
City of Tustin had.

-Asked why the Noticing Memorandum specified The Tustin News

exclusively for publishing the Public Notices. staff replied
that the State law requires publication in a newspaper of
general circulation which requires circulation for a minimum
of one year.
-Asked when the vacant Planning Commission chair would be
filled. The Director advised that it is being addressed at
the next City Council meeting on May 21, 1990 and that the
Commission will be provided with direction after that meeting.
Commissioner Shaheen
-Suggested that the bus stop on First Street at Larwin Square
be moved around the corner on Centennial Way, that people
leaving Larwin Square cannot see past the buses therefore
causing a dangerous situation. Staff replied that the
information will be referred to the Public Works Department
for a report.
-Asked if there was an Ordinance regarding inoperative
vehicles parked on grass in front yard of private property.
The Director advised that the Nuisance Ordinance can be used
for inoperative vehicles.
Commissioner LeJeune
-Asked about the status of the Health Care facility at Newport
and Sycamore and voiced concerned about the poor physical
state of property. Staff replied that the Conditional Use
Permit had expired on the site and that Design Review was due
to expire in three months, but staff would contact the owner
to address current property conditions.
-Inquired about the business tenants at Tustin Plaza painting
their parking stalls for 15 minute limits. The Director
replied that the small b*sinesses directly adjacent to the
restaurant have been experiencing economic problems due to the
negative impact of the restaurant to the small business
tenants.
-Asked if the Public Hearing Notices could be put on apartment
complex bulletin boards for tenants near affected property.
The Director identified legal posting requirements and that
the city's procedures are in excess of the minimum legal
requirements.

ADJOURNMENT
At 8:00 p.m. Chairman LeJeune moved, Kasparian seconded to adjourn
to the next regularly scheduled Planning Commission meeting on May
29, 1990 at 7:00 p.m. in the City Council Chambers, 300 Centennial
Way, Tustin. Motion carried 4-0.
