This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk's office for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the books located at the Police Department, Tustin Library and, on the evening of the meeting, at the rear of the Council Chambers. Listening devices for the hearing impaired are available upon request from the City Clerk. TUSTIN OLDER AMERICANS MONTH V. PUBLIC HEARING 1. RECOVERY OF CITY INCURRED COST OF A NOTICE TO CLEAN PREMISES ON LOT 15, BLOCK 12 IRVINE SUBDIVISION Weed abatement action on a vacant lot adjacent to the flood control channel on the westerly side of Red Hill Avenue between Olwyn Drive and First Street. Recommendation: Adopt the following Resolution No. 90-49 approving a special assessment of four hundred thirteen dollars and thirteen cents ($413.13) as recommended by the Community Development Department: RESOLUTION NO. 90-49 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ASSESSING THE PROPERTY IDENTIFIED AS LOT 15 IN BLOCK 12 IRVINE SUBDIVISION FOR THE COST INCURRED BY THE CITY FOR THE NOTICE TO CLEAN PREMISES VI. PUBLIC INPUT (At this time members of the public may address the City Council regarding any items not on the agenda within the subject matter jurisdiction of the City Council provided that NO action may be taken on off -agenda items unless authorized by law.) There will be no separate discussion of these items prior to the time of the voting on the motion unless members of the Council, staff or public request specific items be discussed and/or removed from the Consent Calendar for separate action. 1. APPROVAL OF MINUTES - APRIL 17, 1990, ADJOURNED REGULAR 2. APPROVAL OF DEMANDS IN THE AMOUNT OF $1,656,656.80 RATIFICATION OF PAYROLL IN THE AMOUNT OF $249,944.07 3. ASSET FORFEITURE APPROPRIATIONS (This item has been moved to New Business No. 2). 4. REJECTION OF CLAIM NO. 90-10 - CLAIMANT -SHELLY BROWN; DATE OF LOSS -1/21/90; DATE FILED WITH CITY -4/3/90 Reject subject claim for property damages in the amount of $263.14 as recommended by the City Attorney. 5. AUTHORIZATION TO ADVERTISE FOR BIDS FOR REPLACEMENT OF PLAY EQUIPMENT AT PINETREE PARK Approve specifications for the replacement of play equipment at Pinetree Park and direct the City Clerk to advertise for bids; and authorize a supplemental budget appropriation in the amount of $30,000 in the 1989-90 Capital Improvement Budget for replacement of play equipment at Pinetree Park as recommended by the Parks and Recreation Commission and the Community Services Department. 6. AUTHORIZATION TO SOLICIT PROPOSALS FOR CONSULTANT SERVICES TO PREPARE PLANS AND SPECIFICATIONS FOR SCADA SYSTEM Authorize staff to solicit requests for proposal for consultant services to prepare plans/specifications for a Supervisory Control and Data Acquisition (SCADA) system as recommended by the Public Works Department/Engineering Division. 7. RESOLUTION NO. 90-51 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING JENNIFER RAUE AS THE DISADVANTAGED BUSINESS ENTERPRISE LIAISON OFFICER FOR THE CITY OF TUSTIN Adopt Resolution No. 90-51 designating. Jennifer Raue as the Disadvantaged Business Enterprise Liaison Officer for the City of Tustin as recommended by the Public Works Department/Engineering Division. 8. REQUEST FOR TREE REMOVALS Approve requests for tree removals at the following locations: 2351 Coco Palm Drive, 14391 Acacia Drive, 13682 Carroll Way, 14491 Heights Drive, 17651 Limetree Way and 14492 Cloverbrook Drive; and deny request for tree removal at the following location: 14572 Raintree as recommended by the Public Works Department/Field Services Division. ORDINANCE NO. 1046 - NEWSRACKS REGULATION ORDINANCE NO. 1046 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE TUSTIN CITY CODE REGARDING THE REGULATION OF NEWSRACKS Recommendation: M.O. - Ordinance No. 1046 have first reading by title only. M.O. - Ordinance No. 1046 be introduced. IX. ORDINANCES FOR ADOPTION 1. ORDINANCE NO. 1037 - ESTABLISHMENT OF TRANSPORTATION IMPROVEMENT PROGRAM AREAS AND DEVELOPMENT FEES The following Ordinance No. 1037 had first reading by title only and introduction at the November 20, 1989 City Council meeting: ORDINANCE NO. 1037 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE TUSTIN CITY CODE BY ADDING SECTION 8101 k. TO ESTABLISH A TRANSPORTATION SYSTEM IMPROVEMENT DEVELOPMENT FEE Recommendation by the Community Development Department: 1. Ordinance No. 1037 have second reading by title only and be passed and adopted (Roll call vote); and 2. Adopt the following Resolution No. 89-165: RESOLUTION NO. 89-165 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING TRANSPORTATION SYSTEM IMPROVEMENT PROGRAM AREAS AND SETTING INTERIM DEVELOPMENT FEES THEREFORE X. OLD BUSINESS 1. AIRPORT STATUS REPORT - JOHN WAYNE AIRPORT (JWA), COALITION FOR A RESPONSIBLE AIRPORT SOLUTION (CRAS) AND AIRPORT SITE COALITION (ASC) Update on John Wayne Airport (JWA), Coalition for a Responsible Airport Solution (CRAS) and Airport Site Coalition (ASC). Recommendation: Receive and file subject report as recommended by the Community Development Department. 2. INTERIM FEE INCREASE PURSUANT TO MAJOR THOROUGHFARE AND BRIDGE FEE PROGRAM FOR THE FOOTHILL/EASTERN TRANSPORTATION CORRIDOR Report to consider an increase in the collection of fees (the "Development Fees") pursuant to the Major Thoroughfare and Bridge Fee Program for the Foothill/Eastern Transportation Corridor. OVERCROWDING W THE SOUTHWEST PORTION i THE CITY On March 19, 1990, the City Council directed staff to investigate alleged abuse of multi -families residing in single residences in the southwest portion of the City. Recommendation: Receive and file subject report as recommended by the Community Development Department. 4. CITY OF TUSTIN AUDIT COMMITTEE'S RECOMMENDATION FOR SELECTION OF EXTERNAL AUDITORS FOR THE FIVE YEAR PERIOD BEGINNING JUNE 30, 1990 At a regular meeting of the City Council in January, the Request for Proposal for professional auditing services was approved by the City Council. Recommendation: Authorize the Finance Director to sign an agreement appointing the firm of Diehl, Evans and Company as the external auditors for the City for a five year period beginning June 30, 1990. NEW BUSINESS 1. MAYORAL APPOINTMENTS Mayor Edgar has requested this matter be agendized to complete his mayoral appointments of City Council representatives to various Orange County committees. Recommendation: Pleasure of the City Council. 2. ASSET FORFEITURE APPROPRIATIONS On June 2, 1986, Resolution No. 86-69 was adopted which authorized the expenditure of monies garnered through the Asset Forfeiture Funds Program. This money was to be used to assist with narcotics investigations. Recommendation: Appropriate $182,790.00 from the existing Narcotic Asset Forfeiture Trust Fund to purchase specified narcotic enforcement related items as recommended by the Police Department. 3. CITIZEN CONCERN - 13895 BROWNING AVENUE (HUBER PARCEL) At the April 17, 1990 City Council meeting, Mr. Huber raised a concern about the City's reaction to the recent driveway construction at his property located at 13895 Browning Avenue. The private driveway in question was constructed within the public right-of-way without a permit and is a potential hazard to motorists. Recommendation: XII. REPORTS Pleasure of the City Council. 1. PLANNING COMMISSION ACTION AGENDA - APRIL 30, 1990 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. CLOSED SESSION The City Council will recess to Closed Session: (1) To confer with the City Attorney regarding pending litigation pursuant to Government Code Section 54956.9(b)(2), based on an existing set of specific facts and circumstances, the City Council is deciding whether the threat of litigation is likely or would be likely if discussed in an open and public meeting; (2) Pursuant to Government Code Section 54956.9(a) to confer with the City Attorney regarding pending litigation which has been initiated formally and to which the City is a party. The title of the litigation is Page vs City of Tustin; (3) Pursuant to Government Code Section 54956.9(a) to confer with the City Attorney regarding pending litigation which has been initiated formally and to which the City is a party. The title of the litigation is Fontaine vs City of Tustin; (4) Pursuant to Government Code Section 54956.8 to give instructions to the'City's negotiator regarding negotiations with Martin J. Perfit concerning the purchase/sale/exchange/lease of the vacant property located at the easterly side of Prospect Avenue and northerly of Main Street. XVI.
