SUBJECT: AUTHORIZATION TO SOLICIT PROPOSALS FOR CONSULTANT SERVICES TO
PREPARE PLANS AND SPECIFICATIONS FOR SCADA SYSTEM
RECOMMENDATION:
That the Tustin City Council authorize staff to solicit requests for
proposal for consultant services to prepare plans/specifications for a
Supervisory Control and Data Acquisition (SCADA) system.
BACKGROUND:
The City Council has budgeted funds for design and installation of a
Supervisory Control and Data Acquisition (SCADA) system to monitor the
City Water Service wells, reservoirs, booster stations, pressure
monitoring stations, treatment plants and other remote facilities.
The system would be designed as a phased installation with the first
phase consisting of a control computer and accessories and the
installation of remote telemetry units at selected critical units. The
addition of the remaining facilities and enhanced control features would
be included in subsequent phases as funding permits.
DISCUSSION:
Attached is the draft request for proposals which outlines the desired
scope of work on page 2, a list of existing and future facilities to be
monitored and controlled on Attachment "A", and the SCADA system
facility function information on Attachment "B".
It is anticipated that a consultant's agreement will be presented to the
City Council for approval/execution on June 18, 1990 and the selected
consultant will be issued a notice to proceed by June 251, 1990. A
completion time for plan/specification preparation has been set for
sixty (60) calendar days.
The SCADA system when completed will provide the City with a fully
automated monitoring and control system for its facilities located at
remote locations.

SUBJECT: REQUEST FOR PROPOSAL - PREPARATION OF PLANS AND
SPECIFICATIONS FOR SCADA SYSTEM
Gentlemen:
BACKGROUND
The City of Tustin Water Service Division (City) is in need of
a personal or micro computer based SCADA system to oversee the
operation of the City's water facilities. The City desires to
employ a consulting firm, with considerable experience in
telemetry and instrumentation, to prepare plans and
specifications for final bid documents and installation of the
system. This letter represents a Request for Proposal for
consultant services for the following Scope of Work. The City
expects the final bid package completed within sixty (60)
working days after notice to proceed.
The City wishes to utilize one of the existing SCADA systems
currently marketed for the water industry. The City has
identified the facilities and functions it would like to
monitor and control (see Attachments 'A' & 'B'). The initial
phase is to consist of the control computer and accessories and
the installation of remote telemetry units at critical
facilities. The addition of other facilities and enhanced
control features will be budgeted for installation in
subsequent years. The system is to be designed for this
modular type of construction.
Selection of a firm to provide this service will be based on
demonstrated competence, professional qualifications necessary
for the satisfactory performance of the services required, and
familiarity and prior experience with providing this type of
service, including the consulting firms to be used to provide
the necessary services. Upon our selection of the most highly
qualified firm to provide the required services we will

negotiate the price for the work to be done. If we can reach a
price we deem fair and reasonable, the contract will be awarded
and a Professional Services Agreement will be executed (see
attached sample agreement). If we are not able to negotiate a
price we deem to be fair and reasonable to the City of Tustin,
we will proceed to the next most highly qualified firm to
provide the requested service and will seek to reach a
negotiated price with that company, and so on.
SCOPE OF WORK
The consultant is to submit his proposal based on providing the
following services to the City for the subject project:
1. Review of the City's facilities and the functions the City
wishes to monitor and control, and make recommendations.
2. Prepare plans and specifications for bid package.
3. Select equipment and software, and recommend changes in
features required.
4. Prepare tentative construction schedule and cost estimate.
5. Assist in the analysis of submitted bids.
6. Review shop drawings and equipment submittals.
7. Inspect various phases of system installation and start-up,
and assist in training City staff.
INFORMATION TO BE INCLUDED IN PROPOSAL
Your proposal for this work should include the following
information:
1. Your firm's qualifications for performing this work,
including your related experience in the telemetry of water
systems. Provide a brief list of similar types of projects
(submit as Exhibit A) which your firm has previously
performed, including scope, cost and agency for whom
completed, including contact person and phone number.
2. Identification, titles and qualifications of individuals
who will supervise and perform the necessary services as
discussed in the Scope of Work (submit as Exhibit B).

cost of the project based upon the workhours, hourly rates,
and other associated costs. The proposed cost to complete
each task shall include the costs of all administration and
overhead, project site visits, and attendance at meetings.
6. Schedule of hourly rates (submit in same SEALED ENVELOPE as
Item 5) for your firm's employee titles or various
classifications.
7. Any other information you feel is pertinent to this
project.
If you desire to submit a proposal to perform this work, it is
requested that it be submitted to the City of Tustin Water
Service, 235 E. Main Street, Tustin, CA 62680, no later than
10:00 A.M., Wednesday, May 30, 1990. Please note that three
(3) copies of your proposal are required to be submitted.

PROFESSIONAL SERVICES AGREEMENT
THIS AGREEMENT, made and entered into this day of
, 1988) by and between CITY OF TUSTIN, a municipal
corporation (hereinafter referred to as "City"); and BSI CONSULTANTS,
INC., 1415 E. 17th Street, Santa Ana, CA 92701 (hereinafter referred to
as "Consultant").
WITNESSETH:
WHEREAS, City desires to employ Consultant to furnish the necessary
engineering services for preparation of a Pavement Management System,
referred to as "Project"; and
WHEREAS, Consultant is qualified to provide the necessary services
in connection with said Project and has agreed to provide the necessary
consulting services; and
WHEREAS, Consultant has submitted to City a proposal dated May 25,
1988, a copy of which is attached hereto marked Exhibit "A" and is by
this reference incorporated herein as though set forth in full herein
("the Proposal").
NOW, THEREFORE, City agrees to employ and does hereby employ
Consultant to provide for the professional services for the Project, and
City and Consultant for the consideration hereinafter set forth agree as
follows:
SECTION 1: Scope of Consultant's Services. Consultant agrees to
furnish to the City consulting services for the Project. These services
shall include all those outlined in Consultant's proposal (Exhibit "A").
Section 2. Time for Completion. It is hereby understood and
mutually agreed that the time for completion of the work to be performed
by Consultant is an essential condition of this Agreement. Consultant
agrees that it shall prosecute regularly and diligently the work of this
agreement accordingly to reasonable schedules established by City.
Consultant shall not be accountable for delays in the progress of its
work caused by any condition beyond his control and without the fault or
negligence of Consultant. Any delays shall not entitle Consultant to any
additional compensation under any circumstances, regardless of the party
responsible for the delay.
Section 3: Compensation. The compensation to be paid under this
Agreement shall be at the hourly rates set forth in Exhibit "A" with a
total cost not to exceed $31,500. Monthly payments for work completed
will be paid as the work progresses.
Section 4. Statement of Costs. Pursuant to the provisions of
California Government Code Section 7550, the total amount expended by
City relating to the preparation of the report and documents prescribed
herein shall be set forth within the final edition thereof, in a separate
section, in a statement substantially as follows: "Pursuant to
California Government Code Section 7550, the City of Tustin expended the
total amount of $ for the preparation of this report and/or
documents".
Section 5: Miscellaneous Provisions.
A. City and Consultant further agree to the following conditions:
(1) City, by notifying consultant in writing, shall have the
right to terminate any or all of the services and work covered by this
Agreement at any time.
- (2) Consultant agrees that it shall proceed immediately and
diligently to perform the services provided for in this Agreement upon
receipt of notice from City to proceed therewith.
(3) The terms and provisions of this Agreement shall extend to
and be binding upon and inure to the benefit of heirs, executors,
administrators, successors and assigns of the respective parties thereto.
(4) Consultant shall perform the services hereunder as an
independent contractor and under no circumstances or conditions shall
Consultant and any of its agents, servants and employees, be considered
as an employee or agent of the City.
(5) Consultant shall perform all services required under this
Agreement in a careful, diligent, professional manner, and shall be
responsible for all errors and omissions for services performed by
Consultant under the terms of this Agreement. Consultant, as a material
part of the consideration of this Agreement, hereby waives, on its behalf
and on behalf of all others claiming through Consultant, all claims and
demands against City, its agents, employees, successors and assigns, for
all loss, damage, injury, sickness, death, or other claim made by other
persons and from all costs, expenses and charges arising therefrom.
Consultant shall maintain in full force and effect during the term of
this Agreement, its existing policies of insurance for which certificates -
of insurance have heretofore been delivered to City.
(6) Consultant shall carry and pay for such compensation
insurance and is necessary to fully protect Consultant and its employees
under California Worker's Compensation Insurance and Safety laws, to
relieve City from all responsibility under said laws in connection with
the performance of this Agreement, and upon the execution of this
Agreement, to file with City a certificate certifying to said protection.
- (7) Consultant certifies that there shall be no discrimination
against any employee who is employed in the work covered by this
Agreement, or against any application for such employment, because of
race, religion, color, sex, or national origin including, but not limited
to, the following:
a. Employment, upgrading, demotion or transfer,
recruitment, or recruitment advertising,
lay-off or termination, rates of pay or other
forms of compensation, and selection for
training, including apprenticeship.
(8) Consultant shall provide City monthly with a detailed
itemization of all work performed, and the fees accrued thereon, in
complete and sufficient detail, to fully apprise City thereof.
IN WITNESS WHEREOF, this Agreement was executed by the parties on
the day and year first above written.
