SUBJECT: CITIZEN CONCERN - 13895 BROWNING AVENUE (HUBER PARCEL)
RECOMMENDATION:
Pleasure of the City Council.
BACKGROUND:
At the April 17, 1990 City Council meeting, Mr. Huber raised a concern
about the City's reaction to the recent driveway construction at his
property located at 13895 Browning Avenue. The private driveway in
question was constructed within the public street right-of-way without a
permit and is a potential hazard to motorists.
DISCUSSION:
Subject portion of Browning Avenue was included in Annexation No. 135
which became a part of the City of Tustin on October 2, 1985. Following
the annexation, some HCDA monies were transferred from Orange County to
the City of Tustin to fund storm drain and street improvements on
interior streets in the neighborhood (Sierra Vista Drive, Karen Way and
Jan Marie Place). No monies were available for the improvement of
Browning Avenue, an arterial highway. Improvements on the interior
streets were completed by City contract in 1987.
Browning Avenue from 165' SIO Jan Marie Place to E1 Camino Real is not
built to secondary highway standards, and approximately 150' of the
highway, including subject property frontage, has no curb and gutter at
all. In order to widen Browning Avenue to ultimate secondary highway
standards, it would be necessary to acquire an additional seven feet of
right-of-way from five parcels between Jan Marie Place and El Camino
Real. Ultimate improvements can be built without impacting any existing
structures. The cost to construct ultimate street improvements is
estimated to be $116,000. Ultimate improvements along this segment of
Browning Avenue would place the sidewalk and curb/gutter at a very close
distance to the three adjacent residential structures southerly of the
Huber parcel. Additionally, driveway access to the parcel on the
northerly side of Sierra Vista would be adversely impacted.
An additional alternative would be to complete the curb and gutter,
driveway and street pavement improvements at the interim location of 18
feet westerly of street centerline within the existing street right-of-
way. These interim improvements would not include sidewalks, but would
provide adequate street drainage and remove the potential hazard created
by the un -permitted driveway at 13895 Browning Avenue. It is estimated
that these interim improvements would cost $16,000.00.
