HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT FINAL TRACT MAPS 13701 AND 13990 RECOMMENDATION CONSENT CALENDAR NO. 6 6/4/90 Inter - Com It is recommended that the City Council approve Final Tract Maps 13701 and 13990 by adoption of Resolution No. 90-59. BACKGROUND On May 15, 1989, the City Council adopted Resolution No. 89-62 approving Vesting Tentative Tract Map 13701, a request to subdivide 34.5 acres into 161 numbered lots and 25 lettered lots to accommodate 161 single family dwellings. This approval included numerous conditions to be met prior to approval of the final map, which the applicant has complied with. Following the tentative map approval, the applicant separated the project into two final tract maps that, together, conform with the approved tentative map, as permitted by the Subdivision Map Act. The final maps are now ready for recordation with the Orange County Recorder's Office. Prior to recordation, the final maps must be reviewed and approved by the Planning Commission and City Council. On May 29, 1990 the Planning Commission adopted Resolution No. 2777 forwarding this item to the City Council recommending approval of Final Tract Maps 13701 and 13990 (Attachment A). The subject site is bounded by Tustin Ranch Road to the east, Irvine Boulevard to the south, La Colina Drive to the north and existing residential development (Tracts 3119, 2939 and 2742) and Tustin Memorial School to the west. Planned and anticipated development in the vicinity includes a 97 unit detached single family development to the north, and condominium developments totalling 329 units to the east. CONCLUSION The Resolution approving the Tentative Tract Map for this project included numerous conditions which were required to be satisfied prior to recordation. All required revisions and conditions have been met. City Council Report FTMs 13701 and 13990 June 4, 1990 Page 2 Staff has determined that the Final Maps are in conformance with the Tentative Map approval, requirements of the East Tustin Specific Plan, Development Agreement, the City's Subdivision Code, the East Tustin EIR and the State Subdivision Map Act. Based upon this conformance, it is recommended that the Planning Commission adopt Resolution No. 90-59 approving Final Tract Maps 13701 and 13990. The City Council finds and determines as follows: A. That Final Tract Map No.s 13701 and 13990 have been submitted by Akins Development. B. That a Public Hearing was held by the Planning Commission on April 24, 1989. At this hearing the Planning Commission recommended approval of Vesting Tentative Tract Map 13701 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 13701 on May 15, 1989. C. That following tentative map approval, the applicant filed Final Tract Maps 13701 and 13990 that together conform with the approved tentative tract map, as permitted by the Subdivision Map Act. D. That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement and Subdivision Map Act as it pertains to the development of residential units. E. The 1.64 acres of parkland required for this development was previously dedicated with recordation of Tract 12870. F. That the site is physically suitable for the type of development proposed. H. That the site is physically suitable for the proposed density of development. I. That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public -at - large, for access through or use of the property within the proposed subdivision. K. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. L. That the Final Maps are in substantial conformance with the Tentative Map. II. The City Council hereby approves Final Tract Map No. s 13701 and 13990 subject to final approval of the City Engineer and also authorizes the City Manager and/or City Engineer to execute any subdivision bonds or agreements for the subject parcel. The Planning Commission finds and determines as follows: A. That Final Tract Map No.s 13701 and 13990 have been submitted by Akins Development. B. That a Public Hearing was held by the Planning Commission on April 24, 1989. At this hearing the Planning Commission recommended approval of Vesting Tentative Tract Map 13701 to the City Council. Subsequently, the City Council approved Vesting Tentative Tract Map 13701 on May 15, 1989. C. That following tentative map approval, the applicant filed Final Tract Maps 13701 and 13990 that, together, conform with the approved tentative tract map, as permitted by the Subdivision Map Act. D. That the proposed subdivision is in conformance with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement and Subdivision Map Act as it pertains to the development of residential units. E. The 1.64 acres of parkland required for this development was previously dedicated with recordation of Tract 12870. F. That the City has reviewed the status of the School Facilities Agreement between the Irvine Company and the Tustin Unified School District, the East Tustin Specific Plan, EIR 85-2, the impacts of Vesting Tentative Tract 13701 on School District facilities, and reviewed changes in State law, and finds and determines that the impacts on School District facilities by approval of this map are adequately addressed. 1 2 3 4 5 6 7 8 9 10 11 12 13 14' 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Resolution No. 2777 Page 2 G. That the site is physically suitable for the type of development proposed. H. That the site is physically suitable for the proposed density of development. I. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat. J . That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public -at - large, for access through or use of the property within the proposed subdivision. K. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems. L. That the Final Maps are in substantial conformance with the Tentative Map. II. The Planning Commission hereby recommends to the City Council approval of Final Tract Map No.s 13701 and 13990 subject to final approval of the City Engineer.
