SUBJECT: RECOVERY OF CITY INCURRED COSTS OF A NOTICE TO CLEAN
PREMISES AT 13142 SILVER BIRCH DRIVE
RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 90-67
approving a special assessment of one hundred ten dollars and
seventy-three cents ($110.73).
BACRGROUNDIDISCUSSION
The subject property contains a single family residence occupied
by a tenant. In 1989 the Field Maintenance Division of the City
of Tustin reported to the Community Development Department staff
that vegetation existed at the rear of the subject property that
was encroaching into and onto the public right-of-way impeding
pedestrian travel on Red Hill Avenue. They requested that staff
notify the property owner of a violation and request abatement of
the condition. Staff sent an informal request to the property
owner reflecting this information on October 13, 1989.
By December, 1989, staff observed that there had been no actions
taken by the property owner to abate the overgrown vegetation
condition. Staff received contact from the tenant at this time and
they reported that they were working with the property owner to
correct the condition. Staff continued to monitor the subject
property. However, staff noted that there was continued inaction
by either the property owner or the tenant.
Due to the incomplete status of the clean-up work, staff gave final
notice to the property owner by utilizing Tustin City Code Section
4413 which authorizes staff to post a Notice to Clean Premises
within ten (10) days. This posting and noticing was carried out
on April 6, 1990.
On April 27, 1990, staff reinspected the subject property and still
found that the overgrown vegetation condition existed. Therefore,
City staff had to perform the additional work to clear the subject

property. The work order was carried out on May 1, 1990 and the
following expenses were incurred by the City:
Materials (truck) $ 25.00
Disposal $ 5.00
Labor 80.73
Total City Incurred Expenses $110.73
CONCLUSION
Staff will continue to monitor this subject property for potential
violations in the future and continue to keep the property owner
advised of their responsibilities for property maintenance.

RESOLUTION NO. 90-67
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, ASSESSING THE PROPERTY
LOCATED AT 13142 SILVER BIRCH DRIVE FOR THE
COST INCURRED BY THE CITY FOR THE NOTICE TO
CLEAN PREMISES.
WHEREAS, the City has made every effort to secure
the cooperation of the property owner in abating the
nuisance at 13142 Silver Birch Drive; and
WHEREAS, upon the failure of the property owner to
cause the abatement, and City staff has abated the
nuisance -at a cost to the City of $110.73.
NOW, THEREFORE, BE IT RESOLVED that the City
Engineer for the City of Tustin is directed to place a
special assessment on Assessor's Parcel No. 103-531-35
in the amount of $110.73 to recover the cost incurred by
the City of Tustin in weed abatement for the property
located at 13142 Silver Birch Drive.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Tustin, California held on the
18th day of June, 1990.
