APPROVAL Moved by Coco, seconded by Miller, that 'minutes of OF MINUTES September 6, 1966,. meeting be approved as corrected. Carried. V. PUBLIC 1. PZ No. 66-102 - SEVENTEENTH AND HOLT ANNEXATION HEARINCS ' To consider PZ 66-102, prezoning approximately 485 acres known as the Seventeenth And Holt Annexation Area. Zoning to become effective only in the event said area is annexed to the City. ' Hearing opened at. 7:36 P.M. Planning Director Supinger presented staff report, background information and map showing proposed prezoning with Planning Commission recommendation for approval of zoning as shown on submitted map. There being no comments or objections, the hearing was declared closed at 7:42 P.M. Moved by Klingelhofer, seconded b= Ring that the Council approve prezoning of Seventeenth and Hott Annexation Area and the City Attorney be directed to draft the appropriate documents for this action. Motion carried by Roll Call. Ayes: Mack, Klingelhofer, Coco, Miller, Ring. Noes= None. Absent: None. 2. ORDINANCE NO. 323 - Continued from 9/6/66 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA AMENDING THE ZONING ORDINANCE, ORDINANCE NO. 157, AS AMENDED, OF THE CITY OF TUSTIN, REGULATING VEHICLES ON PRIVATE PROPERTY. Hearing opened at 7:43 P.M. 2 Correspondence from Mr. Henry Badger was read. Council Minutes 9/19/66 Pg. 2 Mr. David Cothren of Utt Drive questioned parking of trailers, campers, etc. where there is no access to rear yards. Mr. Cothren felt that this Ordinance could lead to a far out situation infringing on a persongs rights. The present cost to park a in a parking lot is $5.00 per month, but if the Ordinance is passed, there is no limit to what you might have to pay if there were even enough spaces available. Fir. Cothren said his objection to this Ordinance is in what it might lead to. There being no further comments or objections, the hearing was declared closed at 7:52 P.M. Councilman Miller stated that this Ordinance has some weak and bad poin'ts and believes the Ordinance as suggested by the Planning Commission is too restrictive of small things rather than the large things to which neighbors object. He does not feel that a 13' long 4' high boat is objectionable, but the Ordinance would prohibit this and also prohibit a person with a pick-up if it carries advertising. Mr. Miller said he felt more study should be given this Ordinance and offered ]~ to chair a committee to study the problem and present a more acceptable solution. Councilman Ring agreed that a committee should be formed and felt the Council should solicit help from the public as this usually leads to a more acceptable solution and educates the public on a situation. Mov_ed by Klingelhofer, seconded by Ring, that Councilman Miller designate and head a committee to stud~ this situatio~ and report back to the Council. Carried. It was suggested that one Planning Commissioner should be a member of this committee. Mr. D. Cothren and Mr. H. Badger were asked to serve on this committee. OLD 1. ORDINANCE NO. 320 BUSINESS AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTION 15-7 OF THE TUSTIN CITY CODE PROHIBITING HEAVY ACTIVITIES ADJACENT TO RESIDENTIAL ZONES, Mayor Mack announced that notice had been given by property owner to Lang & Green Trucking firm to vacate by October 13, 1966. Councilman Coco complimented the City Administrator and staff on the comprehensive study and technical, detailed report. Mr. Coco spoke on Section 15-7 of the ex~sti:,.~ Code ~hich covers d~ ~urbing of L ~ace any'i~Iotor, engl..~ l~ dev ce~ Council Minutes 9/19/66 pg. 3 of this Section of the Code and therefore hesitates to see the City adopt any Ordinance until we see that all recourse has been taken advantage of. Only the filing of a complaint with the Police Department at the time of disturbance is necessary. The offender can be taken to court and, until enforcement of the existing Ordinance is tried in court, he reconunends the City does not take the stand of putting a new Ordinance on the books. Councilman Ring concurred with Mr. Coco, stating that legal vehicles on the books should at least be tried and we should exhaust existing legislation. Mr. Ring thanked Mr. Corington, United California Bank and Mrs. Finley for action conceding to neighbors. Moved by Klingelhofer, seconded by Ring, that Council move to next order of business. Carriea. Councilman Coco requested that a letter be sent to the representative for the citizens group explaining the full legal process for filing complaints. 2. RESOLUTION NO. 840 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, PROVIDING FOR AND ADOPTING THE COUNCIL POLICY MANUAL. Moved by Ring, seconded by Klingelhafer, that Resolution No. 840 be read by title on1y. Carried , unanimously. Moved by Ring, seconded by Coco, that Resolution No. 840, providing for and adopting the Council Policy Manual' be passed and adopted. ORDINANCE NO. 324 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING THE UNIFORM TRAFFIC ORDINANCE NO. 141, REGULATING PARKING OF VEHICLES IN RESIDENTIAL ZONES. Mr. gill advised the Council that a meeting with the CitX Attorney, Police Chief, and Public Works Director to revise present Ordinance No. 141 has been scheduled and recommendations for revisions may include these parking regulations. Moved by Coco, seconded by Ring, that Ordinance NO. 324 be deferred to next meeting. Carried. VII. NEW 1. FINAL MAP TRACT NO. 6273 BUSINESS . APPROVAL OF FINAL MAP OF TRACT NO. 6273 AND AUTHORIZATION FOR MAYOR AND CLERK TO EXECUTE NECESSARY DOCUMENTS. Council Minutes 9/19/66 pg. 4 Moved by Miller, seconded by Coco, that the final map of Tract No. 6273 be approveu' and the Mayor and Clerk be authorized to execute tile necessary documents. Carried · 2. TRACT NO. 5150 - Red Mill Estates ACCEPTANCE OF IMPROVEMENTS IN TRACT NO. 5150 AND EXONERATION OF BONDS. Moved by Coco and seconded by Ring, that the in Tract No. 5150 be accepted and the bonds exonerated · Carried. 3. ORDINANCE NO. 325 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, DESIGNATING FOURTH STREET IN THE CITY OF TUSTIN AS A COUNTY HIGHWAY. Moved by Klingelhofer, seconded bsF Ring, that OrdinanCe No. 325 have first reading by title only. Carried unanimously- Moved by Miller, seconded by Klingelhofer, that Ordinance No. 325 have second reading by title onlJ[. Carried unanimously- Mr. Gill explained taht this is normal procedure and a requirement of the Streets and Highways Code and that the street will revert to the City at the completion of construction. None. Absent: None. 4. Approval of Demands Moved by Miller, Seconded by Klingelhofer, that demands in the amount of $21,907.58 be approved an'a'~I.d.. Carried~ and paid. Carried. VIII. REPORTS 1. Tiller Day Banner Request & OTHER BUSINESS Moved by Klingelhofer, seconded by Ring, that request of Tustin Tiller Day Committee to install a Tiller Day Banner at Main and "D" Streets be approved subject to the approval of the Police and Public Works Departments. Carried. 2. Council Meeting Place. Mayor Mack commented on the difficulty of hearing in the Youth Center building and appointed himself, Mr. Gill and Mr. Rourke to a committee to investigate the possibility of obtaining a temporary meeting place with better Council Minutes 9/19/66 Pg. 5 3. Councilman Ring commented on the Newsletter and congratulated the Police Department on their prowess shown in the shooting matches. IX. CORRESPONDENCE: The following correspondence received.
