HomeMy WebLinkAboutCC 11 QUITCLAIM LOT 7 07-02-90DATE: TO: FROM: JUNE 27, 1990 WILLIAM HUSTON, CITY MANAGER CONSENT CALENDAR NO. 11 7/2/90 Inter - Com PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: QUITCLAIM DEED FOR LOT 7, TRACT NO. 12763 RECOMMENDATION: That the Tustin City Council approve the quitclaim deed relinquishing the City's title to Lot 7 of Tract No. 12763 and authorize the Mayor to execute said deed. BACKGROUND: As a part of the East Tustin development, the Irvine Company subdivided Tract No. 12763 which included an area bounded by Bryan Avenue on, the south, Jamboree Road on the east, Irvine Boulevard on the north, and Browning Avenue and an existing residential development on the west. Lot .7 was subdivided as 16.046 -acre park site and dedicated to the City of Tustin in fee. Lot 8 immediately adjacent to and easterly of Lot 7 was subdivided and designated as a future 33.970 -acre school site. The initial plan was to have a joint use park school facility between both lots, but final agreement could not be reached between the school district, Irvine Company, and City for the joint use facility. The school district required a full 40 -acre site exclusive of any joint use and the City required a minimum of a 16 -acre park which could include a joint use with the school district. Parcel Map No. 88-315 covers the areas of Lot 7 and Lot 8 and re -subdivides these lots into two parcels as follows: * One 10 -acre residential development as Parcel 1 * One 40.1 -acre future school site as Parcel 2 Parcel Map No. 88-316 covers the areas of Lots 15, 16 and 17 of Tract No. 12870 and re -subdivides these lots into two parcels as follows: * One 10 -acre future school site as Parcel No. 1 * One 20.78 -acre site as a future dedication for a park site as Parcel 2 Lots 15, 16 and 17 of Tract No. 12870 were originally subdivided as follows: * Lot 15 as a 10.014 -acre future school site * Lot 16 as a future 4.0 -acre park site * Lot 17 as a future 16 -acre residential site QUITCLAIM DEED FOR LOT 7, TRACT 12763 JUNE 27, 1990 PAGE 2 DISCUSSION: As a result of the unresolved joint use effort between the park site and the school site on Lot 7 and Lot 8 of Tract No. 12763, the Irvine Company proposed a relocation of the Lot 7 park site in Tract No. 12763, southerly of Irvine Boulevard to a location northerly of Irvine Boulevard within the areas of Lots 15, 16 and 17 of Tract No. 12870. The new location northerly of Irvine Boulevard will result in a 20.78 -acre park site which is in lieu of the previous two sites of 4.0 acres and 16.046 acres. The two parcel maps nos. 88-315 and 88-316 accomplish these re -subdivisions. Prior to the recordation of Parcel Map No. 88-315, a quitclaim deed needs to be executed by the City relinquishing its fee title to Lot 7 of Tract No. 12763. Staff has requested, as a safeguard to retaining a 16 -acre park site, that a deed be prepared and executed by the Irvine Company which transfers title to the new 20.78 -acre site within Tract No. 12870 prior to the execution of the subject quitclaim Seed by the City. The Community Development Department has indicated that they are in possession of a deed executed by the Irvine Company which dedicates the 20.78 -acre site (Parcel 2 of Parcel Map No. 88-316) to the City for park purposes. This deed will be recorded after the recordation but concurrently with Parcel Map No. 88-316.
