CALL TO ORDER The meeting was called to order by Chairperson Edgar at 8:40 p.m. in the City Council Chambers, 300 Centennial Way, Tustin, California. 2. ROLL CALL Members Present: Richard B. Edgar, Chairperson Charles E. Puckett, Chairperson Pro Tem Leslie Anne Pontious Jim Potts Earl J. Prescott Members Absent: None Others Present: William A. Huston, Executive Director/City Manager James G. Rourke, City Attorney Mary E. Wynn, Recording Secretary/City Clerk Christine Shingleton, Dir./Community Development W. Douglas Franks, Chief of Police Dana Kasdan, Engineering Services Manager Ronald A. Nault, Finance Director Royleen White, Dir./Community & Admin. Services Susan Jones, Recreation Superintendent Steve Rubin, Associate Planner Valerie Whiteman, Chief Deputy City Clerk Approximately 20 in the audience 3. APPROVAL OF MINUTES - JUNE 18, 1990 REGULAR MEETING It was moved by Pontious, seconded by Puckett, to approve the Minutes of June 18, 1990. Motion carried 5-0. 4. APPROVAL OF DEMANDS It was moved by Pontious, seconded by Puckett, to approve demands in the amount of $12,645.36. Motion carried 5-0. S. REQUEST FOR MODIFICATION TO DEVELOPMENT PARTICIPATION AGREEMENT (DPA) WITH RED HILL EDINGER PARTNERSHIP FOR PACIFIC COMMERCIAL CENTER AT 1426-1481 EDINGER The following members of the audience spoke in favor of amending the Development Participation Agreement: Jim Biram, 3355 Via Lido #205, Newport Beach (representing Resco Development) Mr. Wolfe, representing Harvest Fellowship International Mike Ralston, representing Harvest Fellowship International Mayor Pro Tem Puckett welcomed Harvest Fellowship to Tustin and hoped a suitable location could be found, but he was unwilling to modify the DPA and vote against the recommendations of the City Attorney and staff. Mayor Edgar said he was sympathetic to the church and the concept of churches in commercial centers; but the Agency had spent considerable Redevelopment funds to enhance the property and it would be irresponsible to modify the DPA. It was moved by Edgar, seconded by Pontious, to deny the request for a Development Participation Agreement modification. Council discussion followed regarding the legality/morality of amending the DPA; tax funds used for off-site, public improvements; and use of tax dollars to benefit religion. Councilmember Prescott questioned, as a means of compromise, if the Council would be willing to amend the agreement if a favorable opinion was received from the Sacramento Legislative Counsel. REDEVELOPMENT AGENCY MINUTES Page 2, 7-2-90 James Rourke, City Attorney, responded that it was not a matter of legality. The Agency was required to make certain findings in the matter as set forth in his memorandum (that to permit a church on the property would further the Redevelopment Plan of the South Central Redevelopment Project Area and would be consistent with the requirements and limitations of the California Community Redevelopment Law). The following member of the audience spoke in favor of amending the Development Participation Agreement: Zipora Shifberg-Mencher, 16282 Main Street #3B, Tustin Motion carried 3-2, Potts and Prescott opposed. Mayor Pro Tem Puckett urged staff to continue assisting Harvest Fellowship in locating a suitable church site within Tustin. 6. OTHER BUSINESS A. FOURTH OF JULY CELEBRATION The Council invited everyone to attend the 4th of July celebration at Tustin High School. Susan Jones, Recreation Superintendent, stated residents should avoid E1 Camino Real and utilize parking facilities at Lambert School, Red Hill Shopping Center, Saltarelli Realty and the Church on Red Hill. 7.
