DESIGN REVIEW 90-19, COLUMBUS TUSTIN PARR, PHASE II
RECOMMENDATION
It is recommended that the Redevelopment Agency take the following
actions:
1. Approve the Environmental Determination for Design Review
90-19 by adopting RDA Resolution No. 90-08.
2. Approve Design Review 90-19 by adoption of RDA Resolution
No. 90-09, as submitted or revised.
BACKGROUND AND DISCUSSION
On December 16, 1987 the City Council approved the conceptual site
plan for Phase II to the Columbus Tustin Park renovations after
recommendations were received from the Columbus Tustin Task Force.
Additionally, the project was again reviewed in connection with the
Second Amendment to the Town Center Redevelopment Plan including
Final Environmental Impact Report 88-2.
On March 29, 1990 the Parks and Recreation Commission reviewed and
approved the proposed park improvements. Pursuant to their
direction all pertinent information was submitted to the Community
Development Department for consideration by both the Planning
Commission and the City Council.
Pursuant to the standards of the Public and Institutional (P&I)
District which designates public parks as conditionally permitted
uses, a Conditional Use Permit (CUP 90-13) was reviewed and
approved by the Planning Commission (report attached) on June 11,
1990.
The Community Services Department is seeking final Design Review
approval by the Redevelopment Agency pursuant to the Town Center
Redevelopment Plan in order to construct a new parking lot, picnic
area and play area at Columbus -Tustin Park which is located at
14652 Prospect Avenue and situated on a 5.3 acre parcel of City
owned land adjacent to Prospect Avenue between Irvine Boulevard and
Beneta Way.

PROJECT DESCRIPTIONISITE PLAN
The proposal is to construct a new parking area capable of
accommodating 185 vehicles. The proposed ingress/egress points are
proposed to be located on Beneta Way and Prospect Avenue. Enriched
pavement is proposed at the entryways and on the major elbow of the
main drive. Infrastructure upgrades include installation of storm
drain improvements to the site. The proposal also includes a
picnic area and tot lot which will be located along the eastern
portion of the lot. The picnic area will be turfed and have a
variety of trees including Jacaranda, American Sweet Gum and Golden
Rain trees. The tot lot will include a jungle gym and a sand play
area. The future building site for the gymnasium (Phase 2b) is
generally located at the northeast portion of the property and will
be turfed with grass and irrigated until funding is available and
approvals granted for the project. Phase 2a of the project is
estimated to cost approximately $513,500 and is scheduled to be
completed by early 1991 with construction to commence in late
October of this year.
ENVIRONMENTAL ANALYSIS
Based upon review of Design Review 90-19, as well as Environmental
Impact Report 88-2 which was approved with the Second Amendment to
the Town Center Redevelopment projects, it has been determined that
environmental issues related to this project have been previously
addressed. Also, appropriate mitigation measures identified in EIR
88-2 are included as conditions of approval for the project. With
this information in mind, it is recommended that the City Council
make the finding that requirements of the California Environmental
Quality Act have been met and that no further environmental review
is required.
CONCLUSION
Since the proposed detailed plans are in concert with the
previously approved conceptual park plans and the development is
consistent with the Master Plan for Columbus -Tustin Park, staff
recommends that the City Council take the following actions:
1. Approve Environmental Determination for the project by
adoption of RDA Resolution No. 90-08.

THE CITY OF TUSTIN FINDING THAT FINAL
ENVIRONMENTAL IMPACT REPORT (EIR) FOR THE
SECOND AMENDMENT TO THE TOWN CENTER
REDEVELOPMENT PLAN (FINAL EIR 88-2) IS
ADEQUATE TO SERVE AS THE PROGRAM EIR FOR
DESIGN REVIEW 90-19 AND ALL FEASIBLE
MITIGATION MEASURES HAVE BEEN INCORPORATED AS
REQUIRED BY THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT.
The Redevelopment Agency of the City of Tustin does
hereby resolve as follows:
I. The Redevelopment Agency finds and determines as
follows:
A. That Design Review 90-19 and its development
plans are considered "projects" pursuant to
the terms of the California Environmental
Quality Act; and
B. That the projects are covered by a previously
certified Final Environmental Impact Report
for the Second Amendment to the Town Center
Redevelopment Plan which serves as a Program
EIR for the proposed project.
II. The Second Amendment to the Town Center
Redevelopment Plan Final Environmental Impact
Report (88-2), previously certified on December 51
1988 was considered prior to approval of this
project. The Redevelopment Agency hereby finds:
this project is within the scope of the Second
Amendment to the Town Center Redevelopment Plan
previously approved; the effects of this project,
relating to grading, drainage, circulation, public
services and utilities, were examined in the
Program EIR. All feasible mitigation measures and
alternatives developed in the Program EIR are
incorporated into this project. The Final EIR, is
therefore determined to be adequate to serve as a
Program EIR for this project and satisfies all
requirements of the California Environmental
Quality Act.

Applicable mitigation measures identified in the
Final EIR have been incorporated into this project
which mitigates any potential significant
environmental effects thereof. The mitigation
measures are identified as Conditions on Exhibit A

approving Design Review 90-19.

The Redevelopment Agency of the City of Tustin does
hereby resolve as follows:
I. The Redevelopment Agency finds and determines as
follows:
A. That a proper application, Design Review 90-
19 was filed by the Tustin Community Services
Department requesting authorization to
construct a parking lot, picnic grounds and
play area for Columbus Tustin Park.
B. Pursuant to Section 9272 of the Tustin
Municipal Code, the Redevelopment Agency finds

proposed development will not impair the
orderly and harmonious development of the
area, the present or future development
therein, or the occupancy as a whole. In
making such findings, the Redevelopment Agency
has considered at least the following items:

3. Exterior materials and colors.
4. Type and pitch of roofs.
5. Size and spacing of windows, doors and
other openings.
6. Towers, chimneys, roof structures,
flagpoles, radio and television antennae.
7. Landscaping, parking area design and
traffic circulation.
8. Location, height and standards of
exterior illumination.

CONDITIONS OF APPROVAL
RDA RESOLUTION NO. 90-09
GENERAL
(1) 1.1 The proposed project shall substantially conform with the
submitted plans for the project date stamped July 16,
1990 on file with the Community Development Department,
as herein modified, or as modified by the Director of
Community Development Department in accordance with this
Exhibit.
(1) 1.2 Unless otherwise specified, all conditions contained in
this Exhibit shall be complied with prior to the issuance
of any permits for the project, subject to review and
approval by the Community Development Department.
(1) 1.3 Design Review approval shall become null and void unless
all necessary permits are issued within 18 months of
approval of said application.
(1) 1.4 The applicant shall sign and return an Agreement to
Conditions Imposed form prior to the issuance of any
building permits and or business license.
(4) 1.5 All conditions of Planning Commission Resolution Number
2784 shall be satisfied and incorporated into this

COLUMBUS TUSTIN PARK
The Planning Commission of the City of Tustin does hereby
resolve as follows:
I. The Planning Commission finds and determines as follows:
A. That a proper application (Conditional Use Permit
90-13) has been filed by the Community Services
Department of the City of Tustin, to allow
construction of a parking lot, picnic grounds and
play area for Columbus Tustin park located at 14652
Prospect Avenue.
B. That a public hearing was duly called, noticed and
held on said application on June 11, 1990.
C. That establishment, maintenance, and operation of
the use applied for will not, under the
circumstances of this case, be detrimental to the
health, safety, morals, comfort, or general welfare
of the persons residing or working in - the
neighborhood of such proposed use, evidenced by the
following findings:
1. The use applied for is in conformance with the
Tustin General Plan as the General Plan
specifically, list parks as a land use
consistent with the Public and Institutional
District.
2. The subject property is located in the Public
and Institutional District and the use applied
for specifically listed as conditionally
permitted uses in said district.
3.' The proposed use will not negatively effect
surrounding property owhers, in that the
improvements are for the use and pleasure of
the surrounding properties.

1). Prior to the issuance of any building permits
• for combustible construction, evidence that''a
water supply for fire protection is available
shall be submitted to and approved by the Fire
Chief. Fire hydrants and access roads shall
be in place and operational to meet
requirements and fire -flow prior to commencing
combustible materials.
2) Prior to the issuance of any building permits,
all underground piping for automatic fire
extinguishing system shall be approved by the
Fire Chief. These details shall include width,
clear height, and means of emergency vehicle
over -ride.
3) All drives 28 feet or less in width shall be
posted as "No Parking/Fire Lane".
SITE CONDITIONS
(1) 3.1 Note on final plans that a six foot high chain linked
fence shall be installed around the site prior to
building construction stages. Gated entrances shall be
permitted along the perimeter of the site for
construction vehicles.
(1) 3.2 All parking areas, shall comply with the City of Tustin
Parking Guidelines.
LANDSCAPING, GROUNDS AND HARDSCAPE ELEMENTS
(7) 4.1 Submit at plan check complete detailed landscaping and
irrigation -plans for all landscaping areas consistent
with adopted City of Tustin Landscaping and Irrigation
Submittal Requirements. Provide summary table applying
indexing identification to plant materials in their
actual location. The plan and table must'list botanical'
and common names, sizes, spacing, actual location and
quantity of the plant materials proposed. Show planting
and berming details, soil preparation, staking, etc. The
irrigation plan shall show location and control of
backflow prevention devices, pipe size, sprinkler type,
spacing and coverage. Details for all equipment must be
provided. Show all property lines on the landscaping and
irrigation plan, public right-of-way areas, sidewalk
widths, parkway areas, and wall locations. The

(1) 4.4 Entryways to the project site should be focal points.
In addition to larger tree treatments these areas should
be provided with, a variety of color and treatment of
landscaping as well as an incorporation of special
decorative pavement treatment.
(1) 4.5 Indicate lighting scheme for project, note locations of
(4) all exterior lights and types of fixtures. No lights
shall be permitted which may create any glare or have a
negative impact on the residential properties. The
location and types of lighting shall be subject to the
approval of the Director of Community Development.
NOISE
(1) 5.1 All construction operations including engine warm up
shall be subject to the provisions of the City of Tustin
Noise Ordinance and shall take place only during the
hours of 7: 00 a.m. until 6: 00 p.m. , Monday through Friday
or other times that the Building Official determines will
be in substantial conformance with the Noise Ordinance
and the public health and safety will not be impaired
subject to application being made at the time the permit
for the work is awarded or during progress of the work.

BACKGROUND

Park, a 5.3 acre parcel of City owned land adjacent to Prospect
Avenue between Irvine Boulevard and Beneta Way located in the P &
I (Public and •Institutional) District. Public Parks are
conditionally permitted uses within this district and therefore
require approval of a Conditional Use Permit. The existing parking
area will be demolished to make way for the proposed new parking.
Adjacent property is owned by the Tustin Unified School District
(Columbus -Tustin Intermediate School). Surrounding uses include
Columbus Tustin intermediate school which surrounds the site to the
east and south, flood control property to the north across Beneta
Way, and residential development to the west across Prospect
Avenue.
On October 25, 1976 the Planning Commission approved Use Permit 76-
23 authorizing the Phase 1 development of Columbus Tustin park.
At that time, the development of the project was split into two
phases. Phase 1 was developed with softball fields, lighting, and
a restroom/maintenance. Phase 2 consists of parking expansion,
landscaping and development of a fine arts center.
After re-evaluation of specific development and the cost associated
with Phase 2, the Community Services Department has established the
following modified phase development:

located along the eastern portion of the lot. The picnic area will
be turfed and have a variety of trees including Jacaranda, American
Sweet Gum and Golden Rain trees. The tot lot will include a jungle
gym and a sand play area. The future building site for the
gymnasium (Phase 2b) is generally located at the northeast portion
of the property and will be turfed with grass and irrigated until
funding is available and approvals granted for the project. Phase
2a of the project is estimated to cost approximately $513,500 and
is scheduled to be completed by early, 1991 with construction to
commence in late October of this year.
ENVIRONMENTAL ANALYSIS
Based upon review of Conditional Use Permit 90-13, as well as
Environmental Impact Report 88-2 which was approved with the Second
Amendment to the Town Center Redevelopment projects, it has been
determined that environmental issues related to this project have
been previously addressed. Also, appropriate mitigation measures
identified in EIR 88-2 are included as conditions of approval for
the project. With this information in mind, it is recommended that
the Commission make the finding that requirements of the California
Environmental Quality Act have been met and that no further
environmental review is required.

CONCLUSION
The proposed improvements will provide a more useable park site
with development of the play area and parking. Additionally, the
development is consistent with the Master Plan for Columbus -Tustin
Park and will also ultimately facilitate the development of the
gymnasium, a project included in the Town Center Redevelopment
Plan. Therefore it is recommended the Planning Commission take the
following actions:
1. Approve the Environmental Determination for the project
by adoption of Resolution No. 2783.
2. Approve Conditional Use Permit 90-13 by adoption of
Resolution No. 2784, as submitted or revised.
