HomeMy WebLinkAboutPC RES 3749 RESOLUTION NO. 3749 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING USE DETERMINATION 00-005 TO ALLOW BANQUET FACILITIES AS A CONDITIONALLY PERMITTED USE IN THE COMMERCIAL AS PRIMARY USE AND HOTEL AS A SECONDARY USE DESIGNATION OF THE FIRST STREET SPECIFIC PLAN (FSSP) WITH A MINIMUM OF ONE (1) PARKING SPACE PER EVERY THREE (3] SEATS. The Planning CommisSion does hereby resolve as follows: s I. The Planning Commission finds and determines as follows: 9 A. That a proper application for Use Determination 00-005 was filed by Philip Azzara to request a use determination from the Planning Commission for ~0 establishment of a banquet facility at 721 W. First Street more specifically described as Assessor's Parcel No. 401-302-08. B. According to First Street Specific Plan (FSSP), banquet facilities are not 12 listed uses in the Commercial as Primary land use or Hotel as a Secondary land use designation and require a use determination by the Planning is Commission as stated in Section III C (6) of the FSSP. ]4 C. That a public hearing was duly called, noticed and held on said application ~5 on September 25, 2000, by the Planning Commission. ~6 D. The Commission finds that the proposed use will not impair the orderly and harmonious development of the area the present or future development ~7 therein, or the occupancy as a whole. ~s E. The Planning Commission finds that approval of the use determination to allow banquet facilities as conditionally permitted uses in the First Street ~9 Specific Plan, Commercial as Primary Use or Hotel as a Secondary Use 20 designation can be supported by the following findings: 2~ 1) The proposed use is consistent with the overall intent of the Commercial as Primary Use and Hotel as a Secondary Use 22 designation for sub area-1 of the specific plan, which is to maintain and perpetuate a mix of commercial and office uses. 23 2) The proposed use is consistent with the other listed permitted uses 24 in the planning unit, in that banquet facilities are similar to conditionally permitted uses in the First Street Specific Plan such as 25 restaurants. A banquetfacility is also typically associated with a hotel use which is the Secondary Use and is conditionally permitted within 26 the First Street Specific Plan. These types of facilities typically do not 27 generate more traffic or noise otherwise associated with other retail uses in the area. To ensure compatibility, as conditionally permitted 2s uses, proposals for the Planning Commission would review martial arts studios on a case by case basis. 3) As typically required for restaurants, banquet facilities would be required to provide one (1) parking space per (3) three seats within the facility to ensure sufficient parking. ] ~esolution No. 3749 ;eptember 25, 2000 ~age 2 4 s F. That this project is categorically exempt pursuan~ to Section 15301 (Class 1 ) of the California Environmental Quality Act. I. The Planning Commission hereby approves Use Determination 00-005 to allow ? bancluet facilities as a conditionally permitted use in the Commercial as Pdmary Use and Hotel as a Secondary Use designation of the First Street Specific Plan s with a minimum one (1) parking space for every three (3) seats.
