NAULT, DIRECTOR OF FINANCE PUBLIC HEARING N0. 5 8-6-90 Inter - Com PROPOSED 1990-91 WASTE COLLECTION ASSESSMENT REPORT AND RESOLUTION 90-88 ADOPTING THE REPORT RECOMMENDATION: Adopt Resolution No. 90-88 approving the report relative to parcels receiving solid waste collection services. DISCUSSION: Attached for your review are the supporting documents submitted by Great Western Reclamation as justification for their proposed fees for 1990-91. While the components that are used to calculate the increase in the collection fees grew only by 3.33 percent for the past year, (less than the general CPI of 5.5 percent), the County once again has increased the landfill fees $4 a ton, 29 percent, effective July 1, 1990. The combination of the two elements of our costs payable to Great Western will increase $1.17 per month for residential units and, $1.18 per month for commercial can units. This equates to an increase of 14.96 percent. Based on these increases the 1990-91 proposed rate for single family residential units is $8.99 per month; $107.88 per year per unit and, commercial can units will be $9.40 per month; $112.80 per year per unit. The 1989-90 rates for single family residential were $93.84 per year per unit and, commercial can rates were $98.64 per year per unit. The billable rates for the various commercial bin schedules will be allowed to increase by the same adjustment factors. These rates are billed directly by the contractor so the detail is not included as part of the full assessment report. Items of concern that have been accumulating over the years are delinquencies, corrections, refunds, and impounds. According to the County Auditor -Controllers office, the County -wide delinquency rate is about 3.7 percent for secured taxes and 1.6 percent for unsecured taxes. Based on the City of Tustin's collection history, I believe that we are less than half the County rate, but it does negatively impact our collection of solid waste collection fees. Page 2 Solid Waste Report August 2, 1990 We've been averaging about $10,000 per year of uncollected fees over the past four years, about 1.6 percent of the total assessed. I'm recommending an additional $0.10 per month, $1.20 per year be included in the 1990-91 assessment to mitigate the shortfall caused by delinquencies. The basic single family rate will be $109.08 per unit per year, with the additional $0.10 included and, the basic commercial can rate will be $114.00 per unit per year. The impact of the cost of trash collection has increased dramatically over the last several years. In 1986, the first year that we placed the assessments on the tax roll, the annual rate was $64.20 per residential unit. The annual cost for solid waste collection pickup was $327,000 for about 5,100 single family units and 100 commercial can units. The current cost will be $727,000, for about 6,500 residential units and 602 commercial can units, an average annual increase of 17 percent over the past four years. The annual increase in the contractual rate adjustments paid to Great Western Reclamation over this period was about 2 percent. The most significant cost increases have come from the County land fill fees. In 1986 the landfill fees were $6 per ton. As discussed previously, effective July 1, they will be $17.75 per ton, not quite tripled in four years. Nearly 19 percent of the basic property tax levy would be needed to pay for the cost of trash collection if we did not assess the property on the tax roll. Because of delays in getting cost figures from Great Western Reclamation on the recycling programs they can provide, we have not included any additional fees in the proposed rates. Once we send the report to the County, (it is due no later than August 10), we will not be able to amend it. If we begin any recycling program before next fiscal year, I recommend that any costs we incur become part of the 1991-92 rate adjustment calculation. Attached for your review are several documents that support the recommendation in this report. The first item is a letter from David Ross at Great Western Reclamation, Inc., providing the rate adjustment factors and the new collection rate schedule. We have confirmed these numbers with the Bureau of Labor Statistics and find that the calculation has been completed in accordance with our current agreement. The next item is a matrix detailing the results of a County -wide phone survey conducted by the County Integrated Waste Management Department in January of this year. The County -wide average charge for single family residential pickup is $8.39 per month. At $7.82 per month, the City of Tustin's 89-90 rate was 7 percent below the Page 3 Solid Waste Report August 2, 1990 County average. The County average for a 3 cubic yard bin is $61.05 per month. The City's rate of $52.76 is 14 percent below the average. Because all agencies are effected by the same cost factors as the City of Tustin, it is anticipated that we would be consistent with our new rates relative to other agencies. The final items are a notice from the County regarding the gate fee and other fee increases and, I've included a copy of the Public Notice that was sent to each new property owner. Two hundred and two (202) were added to the roll this year, and published in the Tustin News. To summarize the report, a 323 page computer printout, (single page sample attached), reflects a proposed single family residential solid waste collection rate of $9.09 per month, $109.08 per year. The proposed rate for commercial can service is $9.50 per month, $114.00 per year. 4 1 i Ronald A. A written report dated July, 1990 containing a 13 description of each parcel of real property receiving solid waste collection services and facilities and the amount of the charge 14 proposed to be levied upon each parcel for the collection of solid waste for the fiscal year 1990-91 was prepared and filed with the 15 City Clerk of the City of Tustin on July, 1990. 16 B. That a public hearing to hear and consider all objections or protests, if any, to the aforesaid report and 17 proposed charges was duly set for August 6, 1990 at 7:00 o'clock p.m. in the Council Chambers of the City of Tustin at 300 18 Centennial Way, Tustin, California. 19 C. Said hearing was duly noticed as required by law, by publication once each week for two successive weeks on July 26, 20 1990 and August 2, 1990 in the Tustin News, a newspaper of general circulation printed and published in the City of Tustin. 21 D. At the aforesaid time and place the duly noticed 22 hearing was held and all persons who were present were heard and all comments, objections and protests to the aforesaid report and 23 proposed charges were duly heard and considered by the City Council. 24 E. The City Council hereby elects to have the charges set forth in the aforesaid report collected on the tax roll in the same manner, by the same persons, at the same time as, and together with and not separately from its general taxes and hereby authorizes that such charges be collected on the tax roll, as all prescribed to the provisions of Health and Safety Code Section 5473 et seq. 3. The resolution shall be effective following its adoption by a two-thirds vote of the members of the City Council and shall remain in force and effect and said charges shall be collected in the manner as aforesaid for the year 1990-91 and for each subsequent year as authorized by the hereinabove referenced sections of the Health and Safety Code. 4. The City Clerk is authorized and directed to forthwith file a certified copy of this Resolution with the Auditor of the County of Orange, together with a copy of the hereinabove - described report, and a statement endorsed thereon over her signature that the said report has been finally adopted by the City Council of the City of Tustin. The following were adopted by the Board: Increase the basic rate to $17.29 per ton from $13.25 per ton. Increase the Household Hazardous Materials Program surcharge to $.46 per ton from $.25 per ton. Increase the charges for tire shredding from $35 per ton to $51.25 per ton. Continue the $3 fee for individual cars; the $5 fee for cars with trailers and trucks less than 7,000 pounds gross vehicle weight; the Hard -to -Handle surcharge of $5 per ton;.and the minimum truck fee of $5. Continue the K factor in FY 1990/91 with modifications to bring it closer to actual weights, with a change to actual weights to be considered for FY 1991/92.
