INFORMAL PUBLIC HEARING NOTICING POLICY FOR RENTAL
PROPERTIES
RECOMMENDATION
It is recommended that the City Council support the Community
Development Department's current public hearing noticing
procedures.
BACKGROUND
The City Council at a regular meeting on June 18th asked staff to
provide them with the City's current public hearing noticing policy
including any recommendations about the possible establishment of
an informal procedure for notifying renters of public hearings.
Attached for the City Council's information is the Community
Development Department's current public noticing procedures which
goes beyond the minimum requirements for state law.
Since the Community Development Department currently has no way to
verify a list of renters within a 300 foot radius of a project,
staff is recommending that any informal noticing be limited to
posting of a copy of the notice of hearing in the vicinity adjacent
to the right-of-way for rental apartments that immediately abut a
proposed development site or use.
The above identified informal procedure for renter noticing does
not, however, guarantee that renters would receive notice or that
said notice would not be removed immediately upon posting. The
procedure would not be removed immediately upon posting. The
procedure should, therefore, be considered a courtesy as time
permits and other Department priorities. Failure for a renter to

receive notice should not be the basis for not proceeding with a
discretionary action on a project.

I would like to take this opportunity to clarify the procedures for
noticing public hearings. Section 9296(b) of the Tustin City Code
requires that applications (i.e. CUPs, Variances, Zone Changes,
Code Amendments, Appeals, etc) be noticed in accordance with State
law.
Government Code 65091 requires several components for noticing a
public hearing which are as follows:
1. Notice shall be mailed at least 10 days prior to the
hearing to the property owner (or owner's duly authorized
agent) and the project applicant; and
2. Notice shall be mailed at least 10 days prior to the
hearing to owners of real property within 300 feet of the
subject property as shown on the last equalized
assessor's roll; and
3. Notice shall be mailed at least 10 days prior to the
hearing to local agencies expected to provide utility,
school, or other services that may be significantly
affected.
(When a Negative Declaration is required pursuant to CEQA, the
minimum noticing requirement shall be 21 days.)
In addition to the mailing of notices, one of the two additional
noticing requirements listed below are also required by state law:
1. Publish the notice in at least one newspaper of general
circulation at least 10 days prior to the hearing; or
2. Post at least 10 days prior to the hearing in at least
three public places, including the area directly affected
by the hearing.
(When a Negative Declaration is required pursuant to CEQA, the
minimum noticing requirement shall be 21 days.)
Government Code Section 65091 goes on to indicate that these are
the minimum noticing requirements and that other means of noticing,

in addition to the above, may be given as necessary or desirable.
It is the desire of the department to go beyond the minimum
requirements to publish and post the notice of public hearings.
The following procedure shall be established to ensure that this
desire is achieved:
1. The case planner shall review all mailing lists and
radius maps to ensure that all required parcels, the
subject property owner and the applicant are included on
the lists and radius maps. In addition, other
responsible agencies (i.e. school district, MCAS -Tustin,
utility companies) also need to be included on the
mailing list where applicable.
I 2. The case planner shall prepare a public hearing notice
- identifying the proposal and the time, date and location
of the hearing and submit for review within the
established deadlines to the Senior Planner and Assistant
Director.
3. The department clerk shall transmit all finaled public
hearing notices to the Tustin News within the established
deadlines to ensure that the minimum 10 day notice (21
days for Negative Declaration) is achieved. A copy of
the notice shall then be placed and maintained in the
project file.
4. The case planner shall forward a copy of the hearing
notice and one set of mailing labels with a completed
affidavit to the department clerk a minimum of 12 days
prior to the meeting (23 days for a Negative
Declaration).
5. The case planner shall post the property with a copy of
the hearing notice a minimum of 10 days prior to the
hearing (21 days for a Negative Declaration). A signed
affidavit of the posting shall be completed and included
in the project file.
6. The department clerk shall ensure that all notices are
mailed a minimum of 10 days prior to the hearing (21 days
for a Negative Declaration). A signed affidavit of
mailing shall be completed and attached to a copy of the
.nailing list, notice and mailing list affidavit
(completed by case planner) and then returned to the case

planner for inclusion in the project file.
7. The department clerk shall post the public hearing notice
on the' bulletin boards at City Hall and the Police
Department a minimum of 10 days prior to the hearing (21
days for a Negative Declaration). A signed affidavit of
the posting shall be completed and included in the
project file.
8. The case planner shall include and maintain in the
project file any stamped envelopes from returned hearing
notices.
Please take immediate steps to ensure that this procedure is
implemented immediately.

FOR THE
1990-91 FISCAL YEAR
I. PURPOSE
The purpose of this report is to set forth findings and the
engineering analysis for the Tustin Landscape and Lighting
District for the 1990-91 fiscal year. This district,
utilizing direct benefit assessments, will finance the cost of
providing maintenance and operation of street and highway
landscaping and street lighting in selected areas within the
Tustin City limits.
II. FINDINGS
The City Council of Tustin adopted Resolution No. 85-75 on
July 15, 1985 which formed the Tustin Landscape and Lighting
District and confirmed assessments for the first fiscal year,
1985-86. This report covers the levy of annual assessments
for the 1990-91 fiscal year.
The street lighting system in the district consists of 805
lights. A summary by type and size follows:

Additional street lights will be installed in the future as
properties are developed in the district.
The 1990-91 street and highway landscaping includes parkway
landscaping in the Tustin Ranch area, specifically: the south
side of Bryan Avenue between Browning Avenue and Tustin Ranch
Road; the north side of Bryan Avenue between Browning Avenue
and Jamboree Road; the east side of Browning Avenue between
River Ford Road and E1 Camino Real; the west side of Tustin
Ranch Road from the Santa Ana Freeway to Irvine Boulevard; the
east side of Tustin Ranch Road between Bryan Avenue and
Heritage Way; the south side of Irvine Boulevard east of
Tustin Ranch Road; the east side of Jamboree Road north of
Bryan Avenue; the north side of Irvine Boulevard between
Jamboree Road and West City Limit; the west side of Jamboree
Road between Irvine Boulevard and Tustin Ranch Road; Tustin
Ranch Road between Irvine Boulevard and Portola Parkway; La
Colina Drive between Tustin Ranch Road and West City Limit;
and Jamboree Road between Tustin Ranch Road and North City
Limit. The total landscaped area is 23.56 acres.
Part 2 of Division 15 of the Streets and Highways Code, the
Landscaping and Lighting Act of 1972, permits the establish-
ment of Assessment Districts by cities for the purpose of
providing certain public improvements which include main-
tenance and operation of street lights and landscaping.

The 1972 Act requires that maintenance assessments be levied
according to benefit rather than according to assessed value.
Section 22573 provides that:
"The net amount to be assessed upon lands
within an assessment district may be
apportioned by any formula or method which
fairly distributes the net amount among all
assessable lots or parcels in proportion to
the estimated benefit to be received by each
such lot or parcel from the improvements."
The Act also permits the designation of zones of benefit
within any individual assessment district if "by reasons of
variations in the nature, location, and extent of the improve-
ments, the various areas will receive different degrees of
benefit from the improvement" (Sec. 22547). Thus, the 1972
Act requires the levy of a true "assessment" rather than a
"special tax."
III. FINANCIAL ANALYSIS
The 1972 Act provides that the total cost can be recovered in
the assessment spread including incidental expenses. The
latter can include engineering fees, legal fees, printing,
mailing, postage, publishing, and all other costs identified
with the district proceedings.
The estimated expenditures for street lighting in the proposed
district for the fiscal year are as follows:

The estimated revenues for the district are as follows:

proposed district for the fiscal year are as follows:

Assessments $174,900
The assessment spread will be based upon $174,900.
IV. ENGINEERING ANALYSIS
A. Name
The district is entitled "Tustin Landscape and Lighting
District."
B. Boundary
The boundaries of the assessment district are as shown on
the Assessment Diagram. All parcels within said
boundaries and identified in the latest Orange County
Assessor's Parcel Maps are included in the district
excepting from the assessment for said costs and expenses
within the area described, the area of all public
streets, public avenues, public lanes, public roads,
public drives, public courts, public alleys, all
easements and rights of way, all public parks, greenbelts

and parkways, and all public property being used for
public purposes.
C. Facilities
The facilities or improvements are defined as street
lights, street and highway landscaping, their
appurtenances, energy and maintenance costs to operate
them.
D. Benefit Analysis
All parcels in the district will derive benefit from
street lighting and some from landscaping. The intent of
this report is to establish a methodology that fairly
distributes the cost of the district in relation to the
benefits received.
Lands and rights of way owned by railroads and public
utilities are included in this proposed assessment
district as permitted by Section 22595 of the Streets and
Highways Code.
There are 1252 parcels of property in the district
(including annexed and exempt parcels), all zoned for
residential or commercial use. The District will be
broken down for assessment purposes, as follows:
Zone RI: Residential - without lights, assessed
only for lighting incidental expenses.
There are 6 parcels within this zone with
10 dwelling units.

Zone CI:
Commercial, industrial, churches, and
undeveloped parcels - without lights,
assessed only for lighting incidental
expenses. There are 67 parcels in this
zone with 794.19 acres.
Zone Rl:
Single family detached residential - with
lights, assessed for lighting incidental
expenses and lighting costs. There are
593 parcels within this zone with 1327
dwelling units.
Zone R2:
Condominiums, townhouses, and apartments
- with lights, assessed for lighting
incidental expenses and lighting costs.
There are 522 parcels within this zone
with 3839 dwelling units.
Zone Cl:
Commercial, industrial, churches etc. -
with lights, assessed for lighting
incidental expenses and lighting costs.
There are 63 parcels in this zone with
235.83 acres.
Zone L:
Any of the above mentioned areas with
City maintained landscaping, assessed for
incidentals and landscaping maintenance
costs. There are 1131 parcels in this
zone with 1277 R1 dwelling units, 3678 R2
dwelling units, and 4839.00 commercial
acres.

Zone E: Exempt property. There is 1 parcel in
this zone. This includes publicly owned
property.
E. Assessments - Lighting Incidental Expenses
All parcels in the district will be assessed for the
lighting incidental expenses associated with the district
(except exempted properties). The method for spreading
the incidental cost is on an assessment unit (AU) basis
regardless of land use type. The assessment ratio will
be one (1) assessment unit (AU) for each single family
detached residential unit, 0.75 assessment units for
condominiums and apartments and six (6) assessment units
for each acre of commercial, industrial, etc. The
calculation is as follows:

Therefore, all parcels in Zones RI, R1, R2, and C1 will
receive an assessment of: $1'.22 per unit in Zone RI and
R1, $0.92 per unit in Zone R2, and $7.33 per acre in Zone
CI and C1.
F. Assessments - Lighting Costs
Parcels in Zones R1, R2 and C1 will be assessed for
lighting incidental expenses at a rate of $1.22 per
assessment unit (AU) plus an assessment for the cost of
operating and maintaining the lights in the district, as
calculated below.
The assessment ratio will be one (1) assessment unit (AU)
for each single family detached residential unit, 0.75
assessment units for condominiums and apartments and six
(6) assessment units for each acre of commercial,
industrial, etc. The calculation is as follows:

ment for these zones will include these amounts plus the
lighting incidental costs previously mentioned.
Assessments - Landscape Maintenance Costs
Parcels in Zone L will be assessed for incidental
expenses plus an assessment for the cost of maintaining
landscaping in the district.
The assessment ratio will be one (1) assessment unit (AU)
for each single family detached residential parcel (or
unit) and 0.75 assessment units for apartments and
condominiums and six (6) assessment units for each acre
of commercial, industrial, etc.
The calculation is as follows:
Landscaping Costs Plus Incidental Expenses = $73,100
Zone L: 1,277 units x 1 = 11,277.00 A.U.

V. SUMMARY
The individual assessments for each parcel in the Tustin
Landscape and Lighting District for the 1990-91 fiscal
year are contained in a list of assessments entitled
Exhibit "C" which is attached in the appendix and shall
be on file in the office of the City Clerk of the City of
Tustin.
