JULY 26, 1990 WILLIAM HUSTON, CITY MANAGER Consent Calendar No. 7 8-6-90 Inter - Com PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION LOT LINE ADJUSTMENT NO. 90-1 RECOMMENDATION: That the Tustin City Council adopt the attached resolution approving Lot Line Adjustment No. 90-1. BACKGROUND: The owner(s) of Parcel 1, Anna L. Sagraves and Maxwell Sagraves, and Tustin Homeowners Association, the owner of Parcel 2, have requested this lot line adjustment in order to adjust the lot line between the condominium development known as Tract No. 12273 and a future commercial development to the north of said tract. This adjustment will transfer approximately 185 square feet from the condominium development to the commercial development and provide a more uniform boundary between the two properties. DISCUSSION: The lot line adjustment process is provided for in Section 66412(d) of the Subdivision Map Act wherein the act makes provisions for the local agency to approve lot line adjustments where the land taken from one parcel is added to an adjacent parcel and where a greater number of parcels than originally existed is not thereby created. The attached documents, consisting of a resolution and the application for lot line adjustment, will provide this adjustment once the resolution has been adopted by council and the application approved by staff. This application has been reviewed by both the Community Development Department and the Engineering Division, and all proposed adjustments have been found to be in compliance with all zoning and setback require- ments of the City of Tustin and the provisions of the California Subdivision Map Act. Bob Ledendecker Director of Public Works/City Engineer BL:mv Attach. 1 21 "I 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 2i 2E RESOLUTION NO. 90-100 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 90-1 WHEREAS, Section 66412(d) of the Subdivision Map Act makes provisions for the local agency to approve lot line adjustments where the land taken from one parcel is added to an adjacent parcel and where a greater number of parcels than originally existed is not thereby created; and WHEREAS, the City Council of the City of Tustin has reviewed Lot Line Adjustment No. 90-1 and has made a finding that the real property described in Exhibit A and shown on Exhibit B complies with the provisions of the California Subdivision Map Act and applicable City of Tustin ordinances and regulations including the requirements for building sites; and WHEREAS, the City Council of the City of Tustin has made the following findings: 1. That the proposal is eligible for processing as a lot line adjustment pursuant to Section 66412(d) of the Subdivision Map Act; 2. That the requirements of the California Environmental Quality Act have been met; 3. That the proposal is consistent with the General Plan; and 4. That the resultant parcels will meet the requirements of the Zoning Code. NOW THEREFORE, BE IT RESOLVED that the proposed Lot Line Adjustment No. 90-1, as shown on Exhibits A and B, is hereby approved and that the parcels be considered building sites upon recordation of this document.
