This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk's office for clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the books located at the Police Department, Tustin Library and, on the evening of the meeting, at the rear of the Council Chambers. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited in the Council Chambers; however, if you desire to smoke, an outside speaker has been provided. I. CALL TO ORDER/PLEDGE OF ALLEGIANCE II. APPEAL OF CONDITIONAL USE PERMIT 90-15 The applicant, Beacon Bay Enterprises, Inc., has requested a continuance of their appeal of Condition No. 6.3 of Exhibit A of Planning Commission Resolution No. 2794, relating to allowable sign areas. Recommendation: Continue this public hearing to the September 4, 1990, City Council meeting as recommended by the Community Development Department. VI. PUBLIC INPUT (At this time members of the public may address the City Council regarding any items not on the agenda within the subject matter jurisdiction of the City Council provided that NO action may be taken on off -agenda items unless authorized by law.) Calendar for separate action. 1. APPROVAL OF MINUTES - AUGUST 6, 1990, REGULAR MEETING 2. APPROVAL OF DEMANDS IN THE AMOUNT OF $998,721.61 RATIFICATION OF PAYROLL IN THE AMOUNT OF $265,797.81 3. REJECTION OF CLAIM NO. 90-21 - CLAIMANT -ADELINE CARRASCO, DATE OF LOSS -6/15/901 DATE FILED WITH CITY -6/19/90 Reject subject claim for property damages in the amount of $350.00 as recommended by the City Attorney. 4. REJECTION OF CLAIM NO. 90-25 - CLAIMANT -JAY PHOTOGLOU, DATE OF LOSS -4/22/901 DATE FILED WITH CITY -7/26/90 Reject subject claim for personal and general damages of an undetermined -amount as recommended by the City Attorney. 5. RESOLUTION NO. 90-106 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 13908 Approve Final Tract Map No. 13908 by the adoption of Resolution No. 90-106, as submitted or revised, as recommended by the Community Development Department. 6. RESOLUTION NO. 90-104 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL PARCEL MAP NO. 89- 110 Adopt Resolution No. 90-104 approving Final Parcel Map 89-110 as recommended by the Community Development Department. 7. RESOLUTION NO. 90-112 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND REPAIR, AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR TRAFFIC SIGNAL IMPROVEMENTS AT VARIOUS LOCATIONS Adopt Resolution No. 90-112 accepting works of improvement and authorize the recordation of the Notice of Completion for the traffic signal improvements. Assuming no claims or stop notices are filed, it is further recommended that 30 days after date of recordation of the Notice of Completion, the City Council authorize payment of the final 10% retention amount of $24,603.50 as recommended by the Public Works Department/Engineering Division. 8. RESOLUTION NO. 90-109 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR CONSTRUCTION OF VEIvTA STORM DRAIN IMPROVEMENTS FROM WALNUT AVENUE TO F-10 CHANNEL, AND AUTHORIZING ADVERTISEMENT FOR BIDS Adopt Resolution No. 90-109 approving the plans and specifications for subject project and directing the City Clerk to advertise for bids as recommended by the Public Works Department/Engineering Division. 9. PURCHASE OF EQUIPMENT/ANNUAL CONTRACTS Authorize the Public Works Department/Field Services Division to solicit bids on equipment and annual supply contracts approved in the fiscal year 1990-91 budget as recommended by the Public Works Department/Field Services Division. PURCHASE OF vQUIPMENT Authorize he Public Works Departm t/Water Operations to solicit bids on equipment authorized in the fiscal year 1990- 91 budget as recommended by the Public Works Department/Water Operations Division. 11. RESOLUTION NO. 90-108 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND REPAIR, AND AUTHORIZING RECORDATION OF THE NOTICE OF COMPLETION FOR SIDEWALK AND CURB AND GUTTER REPAIR PROJECT, 1989-90 FISCAL YEAR Adopt Resolution No. 90-108 accepting works of improvement and repair and authorizing the recordation of the Notice of Completion for the Sidewalk and Curb and Gutter Repair project for fiscal year 1989-90 as recommended by the Public Works Department/Engineering Division. 12. RESOLUTION NO. 90-111 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 90-3 Adopt Resolution No. 90-111 approving Lot Line Adjustment No. 90-1 as recommended by the Public Works Department/Engineering Division. 13. RESOLUTION NO. 90-105 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FIXING AND DETERMINING THE AMOUNT OF REVENUE REQUIRED FROM PROPERTY TAXES OF THE CITY OF TUSTIN AND FIXING THE RATE OF TAXES ON THE TAXABLE PROPERTY WITHIN THE CITY OF TUSTIN TO SERVICE THE DEBT OF THE GENERAL OBLIGATION BONDS OF THE CITY FOR THE FISCAL YEAR 1990-91 Adopt Resolution No. 90-105 setting forth the 1990-91 Tax Rate for the 1973 Civic Center Bonds at $.00401 as recommended by the Finance Department. PURCHASING POLICY FOR RECYCLED PRODUCTS The County of Orange, State of California and the nation have reached a crisis situation in the area of solid waste disposal. To assist with this situation, many organizations, including governmental agencies are establishing policies to purchase recycled paper products and other recycled items such as plastics and glasphault. Recommendation: Adopt the following Resolution No. 90-110 establishing a purchasing policy for recycled products as recommended by the Public Works Department/Administrative Division: RESOLUTION NO. 90-110 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING A PURCHASING POLICY FOR RECYCLED PRODUCTS CITY COUNCIL AGENDA PAGE 3 AUGUST 20, 1990 2. CURBSIDE RECYCLING PROGRAM UPDATE The development and implementation of a recycling program within the City is one of the elements set forth in Assembly Bill 939 the Integrated Waste Management Act of 1989. Recommendation: Direct staff to further pursue the 2 -can automated curbside recycling program as recommended by the Public Works Department/Administrative Division. XI. NEW BUSINESS 1. BROWN ACT PUBLIC NOTICING AFFIRMATION At the August 6, 1990 City Council meeting, the Council was requested to agendize a Resolution reaffirming their commitment to compliance of specific Brown Act provisions. Recommendation: Adopt the following Resolution No. 90-107 prescribing and affirming procedures for agendas and notices of public hearings: RESOLUTION NO. 90-107 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, PRESCRIBING AND AFFIRMING PROCEDURES FOR AGENDAS AND NOTICES OF PUBLIC HEARINGS 2. REQUEST FOR STOP SIGN INSTALLATION ON YORBA STREET AT BONNER DRIVE At the August 6, 1990 City Council meeting, a request was made by Mrs. Helen Edgar for the City to install stop signs on Yorba Street at Bonner Drive. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. 3. TRAFFIC STUDY - SEVENTEENTH STREET AT MIMI'S CAFE DRIVEWAY At the August 6, 1990 City Council meeting, a concern was raised by Mrs. Helen Edgar regarding left turn movements from eastbound Seventeenth Street to the Mimi's Cafe driveway on the northerly side of Seventeenth Street. Recommendation: Receive and file subject report as recommended by the Public Works Department/Engineering Division. XII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - AUGUST 13, 1990 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of August 13, 1990. 2. SOUND WALL - EL CAMINO REAL Status report from Caltrans regarding a sound wall along E1 Camino Real during freeway widening project. AD HOC CHILD CARE COMMITTEE At the June 18, 1990 meeting, the City Council authorized the establishment of an Ad Hoc Child Care Committee to develop a comprehensive report on child care needs and resources in the Tustin area.
