HUSTON, CITY MANAGER FROM: OFFICE OF THE CITY CLERK NEW BUSINESS N0. 1 8-20-90 Inter- Coin SUBJECT: BROWN ACT PUBLIC NOTICING AFFIRMATION RECOMMENDATION: Adopt Resolution No. 90-107 prescribing and affirming procedures for agendas and notices of public hearings. BACKGROUND: At the August 6, 1990 City Council meeting, two members of the audience requested the City Council agendize a resolution to reaffirm their commitment to compliance of the Brown Act in light of recent State budget reductions reducing the obligations of local government to provide notices of public hearings. Valerie Whiteman Chief Deputy City Clerk 1 2 3 4i 5 6 7 8 9 10 11 12 13 1 15 16 17 18 19 20 21 22 23 24 25 26 - RESOLUTION NO. 90-107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA PRESCRIBING AND AFFIRMING PROCEDURES FOR AGENDAS AND NOTICES OF PUBLIC HEARINGS WHEREAS, the City of Tustin has for many years provided its citizens with the full measure of public notice of and information concerning public meetings and hearings to enable full citizen participation, and, WHEREAS, the State Legislature has recently seen fit as an expense -saving measure to reduce the obligations of local government to provide notices and information concerning public meetings and hearings and, WHEREAS, the City Council of the City of Tustin believes that it is in the best interests of the City of Tustin and its citizen's that the City continue with its existing practices concerning notices and information concerning public hearings and meetings without regard to the modifications recently enacted by the Legislature. NOW, THEREFORE, THE CITY COU14CIL OF THE CITY OF TUSTYN, CALIFORNIA HEREBY RESOLVES AS FOLLOWS: City staff is hereby directed to continue to comply with all provisions of the Ralph C. Brown Act, Government Code Section 54950 et seq., as prescribed by that act prior to January 1, 1990, without regard to changes in the Ralph C. Brown Act effected by amendments adopted in 1990 prior to the date of adoption of this resolution.
