AUGUST 20, 1990
I. CALL TO ORDER/PLEDGE OF ALLEGIANCE
The meeting was called to order by Mayor Edgar at 7:00 p.m. in the
City Council Chambers, 300 Centennial Way. The Pledge of Allegiance
was led by Councilmember Pontious.
II. INVOCATION
The Invocation was given by Pastor Henry Sellers, First Baptist
Church.

IV. PROCLAMATIONS
1. VOLUNTEER RECOGNITION - 140 NORTH "All STREET
Mayor Edgar announced that volunteers from the neighborhood,
community, Edney Tree Service, Great Western Reclamation, and the
Southern California Edison Company had assisted the property
owners in the clean-up of 140 North "A" Street. Individual
proclamations were given as follows: Nancy Allis, Larry Bales,
Dan Bigos, Leslie Bigos, Steve Blazek, Trina Blazek, John
Brandes, Catherine Burnett, Jeff Burnett, Pat Buttress, Kasey
Carter, Sue Carter, Jamie Creel, Sheryl Creel, Pat Davis, Michael
Doyle, Lawrence Edney from the Edney Tree Service, Joe Garza,
John Garza, Jennifer Goshorn, Gayle Grammer, Mark Gruber, Nick

2. BILL GRAY, CONTINENTAL CABLE VISION
Mayor Edgar read and presented a proclamation to Bill Gray who
left the! employment of Continental Cable Vision. The
proclamation commended Mr. Gray for his service to the community.
Bill Gray stated he was honored and thanked the City for the
recognition.
V. PUBLIC HEARING
1. APPEAL OF CONDITIONAL USE PERMIT 90-15
Mayor Edgar explained the applicant, Beacon Bay Enterprises,
Inc., had requested a continuance of their appeal of Condition
No. 6.3 of Exhibit A of Planning Commission Resolution No. 2794,
relating to allowable sign areas.

Mayor Edgar opened the Public Hearing at 7:12 p.m. There were
no speakers on the subject and the Public Bearing was closed.
It was moved by Pontious, seconded by Puckett, to continue this
public hearing to the September 4, 1990, City Council meeting.
VI. PUBLIC INPUT
1. TUSTIN ZIP CODE FOR ANNEXED AREAS
Gerald Feldman, 13191 Wickshire Lane, Santa Ana, representative
of the Bellewick Community Association, asked for the City's
assistance for Annexation No. 138 to receive a 92680 Tustin zip
code from the postal authorities. He said his community was
surrounded on three sides by areas with Tustin zip codes served
by the Tustin Post Office, and he would like his community's
address and zip code to reflect the city in which they live. The
current postal status in their community created confusion,
delayed mail, inconvenienced residents and interfered with public
services.
Mayor Edgar stated the City would continue their efforts to gain
a Tustin zip code for the subject area.
2. AMERICAN FLAG SONG
Frank Kazerski, 15610 Alliance Street, Tustin, sang a song he
composed about the American Flag and reported the song had
received nation-wide attention.
VII. CONSENT CALENDAR
It was moved by Puckett, seconded by Pontious, to approve the Consent
Calendar. Motion carried 5-0.
1. APPROVED MINUTES - AUGUST 6, 1990, REGULAR MEETING
2. APPROVED DEMANDS IN THE AMOUNT OF $998,721.61
RATIFIED PAYROLL IN THE AMOUNT OF $265,797.81
3. REJECTION OF CLAIM NO. 90-21 - CLAIMANT -ADELINE CARRASCO, DATE
OF LOSS -6/15/90, DATE FILED WITH CITY -6/19/90
Rejected subject claim for property damages in the amount of
$350.00.
4. REJECTION OF CLAIM NO. 90-25 - CLAIMANT -JAY PHOTOGLOU, DATE OF
LOSS -4/22/901 DATE FILED WITH CITY -7/26/90
Rejected subject claim for personal and general damages of an
undetermined amount.
S. RESOLUTION NO. 90-106 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 13908
Approved Final Tract Map No. 13908 by the adoption of
Resolution No. 90-106.
6. RESOLUTION NO. 90-104 -'A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL PARCEL MAP NO. 89-
110
Adopted Resolution No. 90-104 approving Final Parcel Map 89-
110.
7. RESOLUTION NO. 90-112 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND
REPAIR, AND AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR
TRAFFIC SIGNAL IMPROVEMENTS AT VARIOUS LOCATIONS
Adopted Resolution No. 90-112 accepting works of improvement
and authorized the recordation of the Notice of Completion for
the traffic signal improvements. Assuming no claims or stop
notices are filed, 30 days after date of recordation of the
Notice of Completion, the City Council authorized payment of
the final 10% retention amount of $24,603.50.

8. RESOLUTION NO. 90-109 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS
FOR CONSTRUCTION OF VENTA STORM DRAIN IMPROVEMENTS FROM WALNUT
AVENUE TO F-10 CHANNEL, AND AUTHORIZING ADVERTISEMENT FOR BIDS
Adopted Resolution No. 90-109 approving the plans and
specifications for subject project and directing the City
Clerk to advertise for bids.
9. PURCHASE OF EQUIPMENT/ANNUAL CONTRACTS
Authorized the Public Works Department/ Field Services Division
to solicit bids on equipment and annual supply contracts
approved in the fiscal year 1990-91 budget.
10. PURCHASE OF EQUIPMENT
Authorized the Public Works Department/Water Operations to
solicit bids on equipment authorized in the fiscal year 1990-
91 budget.
11. RESOLUTION NO. 90-108 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND
REPAIR, AND AUTHORIZING RECORDATION OF THE NOTICE OF COMPLETION
FOR SIDEWALK AND CURB AND GUTTER REPAIR PROJECT, 1989-90 FISCAL
YEAR
Adopted Resolution No. 90-108 accepting works of improvement
and repair and authorizing the recordation of the Notice of
Completion for the Sidewalk and Curb and Gutter Repair project
for fiscal year 1989-90.
12. RESOLUTION NO. 90-111 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO.
90-3

13. RESOLUTION NO. 90-105 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, FIXING AND DETERMINING THE AMOUNT OF
REVENUE REQUIRED FROM PROPERTY TAXES OF THE CITY OF TUSTIN AND
FIXING THE RATE OF TAXES ON THE TAXABLE PROPERTY WITHIN THE CITY
OF TUSTIN TO SERVICE THE DEBT OF THE GENERAL OBLIGATION BONDS OF
THE CITY FOR THE FISCAL YEAR 1990-91
Adopted Resolution No. 90-105 setting forth the 1990-91 Tax
Rate for the 1973 Civic Center Bonds at $.00401.

X. OLD BUSINESS
1. PURCHASING POLICY FOR RECYCLED PRODUCTS
Jennifer Raue, Administrative Assistant, reported the County of
Orange, State of California and the nation had reached a crisis
situation in the area of solid waste disposal. In order to
assist with the situation, she requested guidelines for the City
to utilize in purchasing recycled products such as paper,
plastics and glasphalt.
It was moved by Potts, seconded by Pontious, to adopt the
following Resolution No. 90-110 establishing a purchasing policy
for recycled products:

RECYCLED PRODUCTS
Mayor Pro Tem Puckett stated this gave Tustin an opportunity to
take a leadership role in purchasing recycled products.

Councilmember Pontious was pleased to see the City moving forward
on this project.
2. CURBSIDE RECYCLING PROGRAM UPDATE
Jennifer Raue, Administrative Assistant, reported the development
and implementation of a recycling program within the
Integrated

Councilmember Potts commended staff on the report.
Councilmember Pontious stated the Cityshould e e flexible

and she supported the 2 -can automated program.
Mayor Edgar said the long-term benefit with the automated system
justified support.
Council/staff discussionfollowed regarding timelines for
implementation, integrating with Orange County, commercial
recycling, multi -family dwelling services, bin types, and the
number of bins per residence.
It was moved by Puckett, seconded by Potts, to direct staff to
further pursue the 2 -can automated curbside recycling program.
Motion carried 5-0.
XI. NEW BUSINESS
1. BROWN ACT PUBLIC NOTICING AFFIRMATION
It was moved by Pontious, seconded bv_Potts, to adopt the
following Resolution No. 90-107 prescribing and affirming
procedures for agendas and notices of public hearings:

CITY OF TUSTIN, CALIFORNIA, PRESCRIBING AND AFFIRMING PROCEDURES
FOR AGENDAS AND NOTICES OF PUBLIC HEARINGS
The following member of the audience requested an amendment to
Resolution 90-107 encouraging the State to take similar action:
Al Shifberg-Mencher, 16282 Main Street, #3B, Tustin
Mayor Edgar suggested copies of Resolution No. 90-107 be
forwarded to Orange County State delegates.
Councilmember Prescott requested the prescribing and affirming
procedures for agendas and notices of public hearings be enacted
through an Ordinance and requested reagendizing in 8 months to
review the State's position.
It was added to the motion that the matter be reagendized in 8
months and copies of Resolution No. 90-107 be forwarded to the
State delegates from Orange County.
Motion carried 5-0.
2. REQUEST FOR STOP SIGN INSTALLATION ON YORBA STREET AT BONNER
DRIVE
Mayor Edgar said the City would perform a warrantstudy folrathe
stop sign installation and present results to the

It was moved by Puckett. seconded by Pontious, to receive and
file subject report.
3. TRAFFIC STUDY - SEVENTEENTH STREET AT MIMI'S CAFE DRIVEWAY
Mayor Edgar stated staff would continue to monitor the accident
history at this intersection and the research data would be
presented to the Council in December, 1990.
It was moved by Potts, seconded by Puckett, to receive and file
subject report.
Motion carried 5-0.
XII. REPORTS
1. PLANNING COMMISSION ACTION AGENDA - AUGUST 13, 1990
It was moved by Puckett, seconded by Potts, to ratify the
Planning Commission Action Agenda of August 13, 1990.
Motion carried 5-0.
2. SOUND WALL - EL CAMINO REAL
Mayor Edgar reported in response to a letter he sent to Caltrans
explaining Tustin's request that a noise wall be included in the
freeway widening project along E1 Camino Real, Caltrans
recommended deferring the noise wall until Stage III. Caltrans
explained that construction of the noise wall prior to widening
and raising the freeway grade would be difficult and very costly.
It was moved by Potts, seconded by Puckett, to receive and file
subject report.
Motion carried 5-0.
3. AD HOC CHILD CARE COMMITTEE
It was moved by Puckett, seconded by Pontious, to receive and
file subject report.
Motion carried 5-0.
Councilmember Pontious noted the next meeting of the Ad Hoc Child
Care Committee would be held August 28, 1990, 7:00 p.m. at the
Tustin Area Senior Center. She encouraged anyone in the
community who wished to become involved in the child care issue
to contact the Community Services Department.

XIV. OTHER BUSINESS
1. MAYOR PRO TEM PUCKETT'S 25TH WEDDING ANNIVERSARY
Mayor Pro Tem Puckett said that August 21, 1990, was his 25th
wedding anniversary.
2. ADJOURNMENT IN MEMORY OF DARRELL ESGAR, CHAD CHADWICK AND RUSSEL
WILLIAMS
Councilmember Prescott requested that the meeting be adjourned
in memory of Darrell Esgar, Chad Chadwick and Russel Williams,
who were homicide victims in Tustin on August 19, 1990.
3. BUILDING STANDARDS - NORTH TUSTIN SPECIFIC PLAN
During the analysis of incorporation of the North Tustin Specific
Plan, Mayor Edgar stated he felt that the City's building
standards were of high quality, he did not want the significance

of the City's existing standards minimized, and he wanted a
consistent plan throughout the City.
4. FREEWAY/ROAD CONSTRUCTION PROGRESS REPORTS FOR PUBLIC
Mayor Edgar requested staff monitor all freeway/road construction
and publish the progress and estimated completion dates for the
public's information. Council concurred.
XV. ADJOURNMENT
At 7:50 p.m., the meeting recessed to the Redevelopment Agency and
then adjourned in memory of Darrell Esgar, Chad Chadwick and Russel
Williams, to an Adjourned Regular Meeting on Tuesday, September 4,
1990, at 7:00 p.m.
