This agenda contains a brief general description of each item to be considered. Any person having a question concerning an item may call the City Clerk's office for ,clarification. Except as otherwise provided by law, no action shall be taken on any item not appearing in the following agenda. Copies of staff reports pertaining to this agenda are available for public use in the books located at the Police Department, Tustin Library and, on the evening of the meeting, at the rear of the Council Chambers. Listening devices for the hearing impaired are available upon request from the City Clerk. Smoking is prohibited in the Council Chambers; however, if you desire to smoke, an outside speaker has been provided. I. CALL TO ORDER/PLEDGE OF ALLEGIANCE II. CLOSED SESSION The City Council will recess to Closed Session to confer with the City Attorney regarding pending litigation pursuant to Government Code Section 54956.9(b)(1) (In the reasonable opinion of the City Council, based on an existing set of specific facts and circumstances, the threat of litigation against the City is likely or would be likely if discussed in an open and public meeting). VI. PUBLIC HEARINGS 1. FEE RESOLUTION The Community Development Department has reviewed the various documents duplicated for public use. As a result of this analysis, which included a listing of all documents and their respective number of pages, staff finds that the City is incurring costs that are not being recuperated. Recommendation: Adopt the following Resolution No. 90-119 establishing the fee for duplication of documents provided to the public by the Community Development Department as recommended by the Community Development Department: RESOLUTION NO. 90-119 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING A DOCUMENT DUPLICATION FEE FOR THE COMMUNITY DEVELOPMENT DEPARTMENT CITY COUNCIL AGENDA PAGE 1 SEPTEMBER 17, 1990 2. ZONE CHAN"' 90-1 AND APPEAL OF `NDITION 8.9 (PLANNING COMMISSION SOLUTION NO. 2816) OF CG. .'TIONAL USE PERMIT 90-3 (TUTT) ZONE CHANGE 90-1: Applicant is requesting a zone change for a .68 acre site located on the north side of Nisson Road east of Red Hill Avenue in order to accommodate development of a car wash. Recommendation: Pleasure of the City Council. APPEAL OF CONDITION 8.9 (PLANNING COMMISSION RESOLUTION NO. 2816) OF CONDITIONAL USE PERMIT 90-3: Applicant has filed a formal appeal of Condition 8.9 of Planning Commission Resolution No. 2816 which requires removal of an existing legal non -conforming billboard. Recommendation: That the City Council take one of the following actions as recommended by the Community Development Department: 1. Table appeal of CUP 90-3 if Zone Change 90-1 is denied by minute action; or 2. Delete Condition 8.9 of Planning Commission Resolution No. 2816 by adoption of the following Resolution No. 90-125: RESOLUTION N0. 90-125 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 90-3 AND THE DELETION OF CONDITION 8.9 OF PLANNING COMMISSION RESOLUTION NO. 2816 REQUIRING REMOVAL OF AN EXISTING LEGAL NON -CONFORMING BILLBOARD VII. VIII. CONSENT CALENDAR All matters listed under Consent Calendar are considered routine and will be enacted by one motion. APPROVAL OF MINUTES - SEPTEMBER 4, 1990, ADJOURNED REGULAR MEETING 2. APPROVAL OF DEMANDS IN THE AMOUNT OF $1,478,497.58 RATIFICATION OF PAYROLL IN THE AMOUNT OF $256,980.43 3. REJECTION OF CLAIM NO. 90-26; CLAIMANT-FERIDOUN REZAI, DATE OF LOSS -3/9/901 DATE FILED WITH CITY -8/20/90 Reject subject claim for general damages in the amount of $785,000 as recommended by the City Attorney. RESOLUTION NO. 90-122 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR THE INSTALLATION OF STREET LIGHT CONDUIT ON SYCAMORE AVENUE FROM CANTERBURY AVENUE TO 6001+ EASTERLY OF CANTERBURY AVENUE Adopt Resolution No. 90-122 approving the plans and specifications for the subject project and directing the City Clerk to advertise for bids as recommended by the Public Works Department/Engineering Division. 6. AWARD OF CONTRACT FOR THE CONSTRUCTION OF EAST TUSTIN MEDIAN ISLAND LANDSCAPING AND IRRIGATION Award the contract for the subject project to the low bidder, Tracy & Haigh Landscape, Inc. of Rancho Santa Margarita, in the amount of $398,868.50 as recommended by the Public Works Department/Engineering Division. 7. RESOLUTION NO. 90-124 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING SPECIFICATIONS FOR THE ANNUAL ASPHALT CONCRETE PAVEMENT REPAIR PROGRAM Adopt Resolution No. 90-124 approving specifications for subject project and authorizing advertisement for bids as recommended by the Public Works Department/Engineering Division. S. RESOLUTION NO. 90-123 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 90-2 Adopt Resolution No. 90-123 approving Lot Line Adjustment No. 90-2 as recommended by the Public Works Department/Engineering Division. 9. RESOLUTION NO. 90-118 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 13746 Approve Final Tract Map No. 13746 by the adoption of Resolution No. 90-118, as submitted or revised, as recommended by the Community Development Department. 10. PHOTOCOPIER EQUIPMENT STUDY Authorize the Director of Administrative Services to sign a sixty (60) month lease agreement for photocopier equipment, maintenance, supplies and service with the following equipment vendors: University Copy Systems, Pitney Bowes, Standard Office Systems, and Gestetner for a total of $45,000.00. The 1990-91 adopted budget incorporated the allocation of these funds for equipment and duplication services as recommended by the Administrative Services Department. 11. APPROVAL OF CONSULTANT SERVICES PROGRAM FOR THE CITY OF TUSTIN Authorize the City Manager to Agreement for Noise Monitoring as recommended by the Community AGREEMENT FOR NOISE MONITORING execute the Consultant Service Services for the City of Tustin Development Department. ORDINANCE NO. 1048 - APRIL GENERAL MUNICIPAL ELECTIONS The following Ordinance No. 1048 had first reading by title only and introduction at the September 4, 1990 City Council meeting: ORDINANCE NO. 1048 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, REPEALING ORDINANCE NO. 980 WHICH REQUIRED THE CITY'S GENERAL MUNICIPAL ELECTION TO BE CONSOLIDATED WITH THE STATEWIDE GENERAL ELECTION HELD IN NOVEMBER OF EVEN NUMBERED YEARS PURSUANT TO SECTION 36503.5 OF THE GOVERNMENT CODE Recommendation: M.O. - Ordinance No. 1048 have second reading by title only. M.O. - Ordinance No. 1048 be passed and adopted (roll call vote) . 2. URGENCY ORDINANCE NO. 1050 - TRASH SERVICE, TUSTIN MARINE BASE The Ordinance is drafted in terms of an Urgency Ordinance based upon the need to include State and Federal facilities in order to carry out the City's duty to comply with the California Integrated Solid Waste Management Act of 1989. ORDINANCE NO. 1050 - AN URGENCY ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING SECTION 4332 OF THE TUSTIN CITY CODE RELATIVE TO SOLID WASTE COLLECTION AND DISPOSAL Recommendation: M.O. - Ordinance No. 1050 have first reading by title only and introduction. M.O. - Ordinance No. 1050 be passed and adopted (roll call vote). XI. OLD BUSINESS 1. AIRPORT STATUS REPORT - JOHN WAYNE AIRPORT (JWA) PHASE 2 ACCESS PLAN The John Wayne Airport (JWA) Phase 2 Access Plan covers the operations of JWA for commercial and commuter airlines from 1990 through 2005. Recommendation: Pleasure of the City Council. XII. NEW BUSINESS 1. VOLUNTARY MANAGER'S CERTIFICATE/LICENSING PROGRAM FOR MULTIPLE FAMILY PROJECTS The overall objective of this program is to provide residents of multiple family dwellings with a more healthy and safer living environment through property maintenance; Fire, Building and Zoning Code compliance; crime prevention and emergency trained management. XIII. REPORTS 1. PLANNING COMMISSION ACTION AGENDA - SEPTEMBER 10, 1990 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of September 10, 1990. 2. INVESTMENT SCHEDULE AS OF AUGUST 31, 1990 Investment schedule with maturities, 12 months or less. Recommendation: Receive and file subject report as recommended by the Finance Department. 3. CURBSIDE RESIDENTIAL RECYCLING PROGRAM UPDATE At the City Council meeting of August 20, 1990, Council directed staff to further pursue the automated -commingled curbside residential recycling program for City of Tustin single-family dwellings. Recommendation: Receive and file subject report as recommended by the Public Works Department/Administration Division. 4. SALE OF SURPLUS EQUIPMENT On July 7, 1990, the City Council declared specified equipment surplus and not required for public use. The equipment was sold at public auction on August 5, 1990. Recommendation: Receive and file notice of sale of surplus equipment as recommended by the Public Works Department/Field Services Division. XIV. PUBLIC INPUT XV. OTHER BUSINESS 1. CITY MANAGER 2. BACRGROUNDIDISCUSSION The Community Development Department maintains numerous documents including the zoning code, the sign code, the subdivision code and various development standards and regulations for specific planning areas. These documents are available to the public for reference at our customer service counter. However, in many cases, a developer or other interested party requests to take a copy of a document with them for their own record. The Community Development Department currently has fees established for distribution of the zoning code, sign code and general plan elements. These fees were adopted by City Council Resolution No. 80-28 and are stated as follows: Zoning Code..............$5.00 Sign Code................$2.00 General Plan Element ..... $5.00 These fees are flat rates and do not reflect actual City costs incurred for duplication. Furthermore, there are currently no fees stated for any of the district planning regulations. Although Resolution No. 80-28 set a duplication charge for other City business transactions at $.25 per page plus sales tax. Community Development Department documents were apparently not specifically covered. The Community Development Department has reviewed the various documents duplicated for public use. City Council Report Fee Resolution September 17, 1990 Page 2 By utilizing a duplication fee per page, staff would be afforded the opportunity to keep the fee charged for the duplication of a document current, adjustable and reflective of the actual City incurred cost. Staff could review these documents for any changes in number of pages as a result of any code amendments and would consequently automatically update the fee charged based on the $.25 a page charge. CONCLUSION In order to maintain consistency with other City departments that already apply the $.25 per page document duplication fee and in view of above analysis, staff recommends that the City Council adopt Resolution No. 90-119 to establish a $.25 per page duplication fee for the Community Development Department. The City council of the City of Tustin, California, does hereby resolve as follows: I. The City Council finds and determines as follows: A. That the Community Development Department duplicates various documents for public use and distribution. B. That fees for the duplication of documents by the Community Development Department do not cover City incurred costs for providing this public service. C. That this project is a statutory exemption from the requirements of the California Environmental Quality Act, pursuant to Section 15273. II. The City Council hereby establishes a publication/duplication fee of $.25 per page plus sales tax for documents duplicated for the public by the Community Development Department. The establishment of this fee supersedes any existing fees and shall be applied uniformly except where, in the discretion of the City Manager, reduced fees are justified by special circumstances.
